Mike Porfirio SYNOPSIS AS INTRODUCED: 20 ILCS 2105/2105-410 new Amends the Department of Professional Regulation Law of the Civil Administrative Code of Illinois. Provides for a temporary permit, which is a 3-year, non-renewable authorization to practice in this State, for active duty military members, military spouses, and veterans. Provides eligibility and application requirements for a temporary permit. Provides that temporary permits are valid for 3 years from the date of issuance and shall not be renewed. Provides that a temporary permitholder may practice within the scope of the permitholder's out-of-state license if the permitholder complies with all State laws, rules, regulations, and standards of practice applicable to the permitholder's profession. Provides that a temporary permit shall not be issued for a profession requiring emergency or public safety certifications unless the issuance of the temporary permit is authorized by the licensing board of the profession. 1111 1 AN ACT concerning regulation.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Department of Professional Regulation Law
1515 5 of the Civil Administrative Code of Illinois is amended by
1616 6 adding Section 2105-410 as follows:
1717 7 (20 ILCS 2105/2105-410 new)
1818 8 Sec. 2105-410. Temporary professional licensure for
1919 9 military members, military spouses, and veterans.
2020 10 (a) The purpose of this Section is to facilitate
2121 11 employment opportunities for active-duty military members,
2222 12 military spouses, and veterans by allowing temporary practice
2323 13 under an out-of-state professional license while completing
2424 14 State licensure requirements.
2525 15 (b) As used in this Section:
2626 16 "Active-duty military member" means a person serving in
2727 17 the United States Armed Forces on active duty.
2828 18 "Military spouse" means the spouse of an active-duty
2929 19 military member.
3030 20 "Professional license or certificate" means a license,
3131 21 permit, certification, or other authorization required by law
3232 22 to practice or work in a profession or occupation.
3333 23 "Temporary permit" means a 3-year, non-renewable

6868 1 authorization to practice in this State under this Section.
6969 2 "Veteran" means an individual who has served in the United
7070 3 States Armed Forces and received an honorable or general
7171 4 discharge.
7272 5 (c) To be eligible for a temporary permit, an applicant
7373 6 must meet all of the following requirements:
7474 7 (1) The applicant must be an active-duty military
7575 8 member, military spouse, or veteran.
7676 9 (2) The applicant must hold a valid, unencumbered
7777 10 professional license or certificate in good standing from
7878 11 another state.
7979 12 (3) The applicant must provide proof of:
8080 13 (A) residency in this State or relocation to this
8181 14 State due to military orders; and
8282 15 (B) the applicant's military status or the
8383 16 applicant's spouse's military status, which may be
8484 17 established through a military identification card, a
8585 18 Certificate of Release or Discharge from Active Duty
8686 19 (DD-214), or equivalent documentation.
8787 20 The Department shall issue a temporary permit upon the
8888 21 receipt of a completed application and a verification of
8989 22 eligibility. Temporary permits are valid for 3 years from the
9090 23 date of issuance and shall not be renewed.
9191 24 (d) A temporary permitholder may practice within the scope
9292 25 of the permitholder's out-of-state license if the permitholder
9393 26 complies with all State laws, rules, regulations, and

104104 1 standards of practice applicable to the permitholder's
105105 2 profession.
106106 3 (e) To obtain a permanent State license, a temporary
107107 4 permitholder must meet all State licensure requirements before
108108 5 the expiration of the 3-year period under subsection (c).
109109 6 Failure to obtain permanent licensure within the 3-year
110110 7 period under subsection (c) shall result in the termination of
111111 8 the temporary permit.
112112 9 (f) A temporary permit shall not be issued for a
113113 10 profession that requires a licensee to have emergency or
114114 11 public safety certifications unless the issuance of the
115115 12 temporary permit is authorized by the licensing board of the
116116 13 profession.
117117 14 This Section does not apply to a license governed by an
118118 15 interstate licensure compact unless the applicable interstate
119119 16 licensure compact provides otherwise.
120120 17 (g) The Department may adopt rules necessary to implement
