1313 1 AN ACT concerning education.
1414 2 Be it enacted by the People of the State of Illinois,
1515 3 represented in the General Assembly:
1616 4 Section 5. Findings. The General Assembly finds that, to
1717 5 address the increasing mental health and behavioral health
1818 6 needs of students in our schools, a new social work associate
1919 7 endorsement on an Educator License with Stipulations is needed
2020 8 to expand the availability of qualified social workers to work
2121 9 within school settings. The new endorsement created under this
2222 10 Act is designed for Master of Social Work professionals who
2323 11 hold current licenses issued by the Department of Financial
2424 12 and Professional Regulation under the Clinical Social Work and
2525 13 Social Work Practice Act as either a licensed clinical social
2626 14 worker or a licensed social worker. The intent of this Act is
2727 15 to expand the availability of qualified social workers in our
2828 16 schools, not to replace or supplant professional educator
2929 17 license holders or to fill professional educator license
3030 18 vacancies. This Act is also intended to encourage the holders
3131 19 of social work associate endorsements to pursue a Professional
3232 20 Educator License with a school support personnel endorsement
3333 21 in the area of school social work.

7575 2 Sec. 21B-20. Types of licenses. The State Board of
7676 3 Education shall implement a system of educator licensure,
7777 4 whereby individuals employed in school districts who are
7878 5 required to be licensed must have one of the following
7979 6 licenses: (i) a professional educator license; (ii) an
8080 7 educator license with stipulations; (iii) a substitute
8181 8 teaching license; or (iv) until June 30, 2028, a short-term
8282 9 substitute teaching license. References in law regarding
8383 10 individuals certified or certificated or required to be
8484 11 certified or certificated under Article 21 of this Code shall
8585 12 also include individuals licensed or required to be licensed
8686 13 under this Article. The first year of all licenses ends on June
8787 14 30 following one full year of the license being issued.
8888 15 The State Board of Education, in consultation with the
8989 16 State Educator Preparation and Licensure Board, may adopt such
9090 17 rules as may be necessary to govern the requirements for
9191 18 licenses and endorsements under this Section.
9292 19 (1) Professional Educator License. Persons who (i)
9393 20 have successfully completed an approved educator
9494 21 preparation program and are recommended for licensure by
9595 22 the Illinois institution offering the educator preparation
9696 23 program, (ii) have successfully completed the required
9797 24 testing under Section 21B-30 of this Code, (iii) have
9898 25 successfully completed coursework on the psychology of,

109109 1 the identification of, and the methods of instruction for
110110 2 the exceptional child, including, without limitation,
111111 3 children with learning disabilities, (iv) have
112112 4 successfully completed coursework in methods of reading
113113 5 and reading in the content area, and (v) have met all other
114114 6 criteria established by rule of the State Board of
115115 7 Education shall be issued a Professional Educator License.
116116 8 All Professional Educator Licenses are valid until June 30
117117 9 immediately following 5 years of the license being issued.
118118 10 The Professional Educator License shall be endorsed with
119119 11 specific areas and grade levels in which the individual is
120120 12 eligible to practice. For an early childhood education
121121 13 endorsement, an individual may satisfy the student
122122 14 teaching requirement of his or her early childhood teacher
123123 15 preparation program through placement in a setting with
124124 16 children from birth through grade 2, and the individual
125125 17 may be paid and receive credit while student teaching. The
126126 18 student teaching experience must meet the requirements of
127127 19 and be approved by the individual's early childhood
128128 20 teacher preparation program.
129129 21 Individuals can receive subsequent endorsements on the
130130 22 Professional Educator License. Subsequent endorsements
131131 23 shall require a minimum of 24 semester hours of coursework
132132 24 in the endorsement area and passage of the applicable
133133 25 content area test, unless otherwise specified by rule.

146146 2 that limits the license holder to one particular position
147147 3 or does not require completion of an approved educator
148148 4 program or both.
149149 5 An individual with an Educator License with
150150 6 Stipulations must not be employed by a school district or
151151 7 any other entity to replace any presently employed teacher
152152 8 who otherwise would not be replaced for any reason.
153153 9 An Educator License with Stipulations may be issued

156156 12 (B) Alternative provisional educator. An
157157 13 alternative provisional educator endorsement on an
158158 14 Educator License with Stipulations may be issued to an
159159 15 applicant who, at the time of applying for the
160160 16 endorsement, has done all of the following:
161161 17 (i) Graduated from a regionally accredited
162162 18 college or university with a minimum of a
163163 19 bachelor's degree.
164164 20 (ii) Successfully completed the first phase of
165165 21 the Alternative Educator Licensure Program for
166166 22 Teachers, as described in Section 21B-50 of this
167167 23 Code.
168168 24 (iii) Passed a content area test, as required
169169 25 under Section 21B-30 of this Code.

182182 2 third year by an individual meeting the requirements set
183183 3 forth in Section 21B-50 of this Code.
184184 4 (C) Alternative provisional superintendent. An
185185 5 alternative provisional superintendent endorsement on
186186 6 an Educator License with Stipulations entitles the
187187 7 holder to serve only as a superintendent or assistant
188188 8 superintendent in a school district's central office.
189189 9 This endorsement may only be issued to an applicant
190190 10 who, at the time of applying for the endorsement, has
191191 11 done all of the following:
192192 12 (i) Graduated from a regionally accredited
193193 13 college or university with a minimum of a master's
194194 14 degree in a management field other than education.
195195 15 (ii) Been employed for a period of at least 5
196196 16 years in a management level position in a field
197197 17 other than education.
198198 18 (iii) Successfully completed the first phase
199199 19 of an alternative route to superintendent
200200 20 endorsement program, as provided in Section 21B-55
201201 21 of this Code.
202202 22 (iv) Passed a content area test required under
203203 23 Section 21B-30 of this Code.
204204 24 The endorsement is valid for 2 fiscal years in
205205 25 order to complete one full year of serving as a
206206 26 superintendent or assistant superintendent.

218218 2 (E) Career and technical educator. A career and
219219 3 technical educator endorsement on an Educator License
220220 4 with Stipulations may be issued to an applicant who
221221 5 has a minimum of 60 semester hours of coursework from a
222222 6 regionally accredited institution of higher education
223223 7 or an accredited trade and technical institution and
224224 8 has a minimum of 2,000 hours of experience outside of
225225 9 education in each area to be taught.
226226 10 The career and technical educator endorsement on
227227 11 an Educator License with Stipulations is valid until
228228 12 June 30 immediately following 5 years of the
229229 13 endorsement being issued and may be renewed.
230230 14 An individual who holds a valid career and
231231 15 technical educator endorsement on an Educator License
232232 16 with Stipulations but does not hold a bachelor's
233233 17 degree may substitute teach in career and technical
234234 18 education classrooms.
235235 19 An individual who holds a valid career and
236236 20 technical educator endorsement on an Educator License
237237 21 with Stipulations is entitled to all of the rights and
238238 22 privileges granted to a holder of a Professional
239239 23 Educator License.

241241 25 (G) Transitional bilingual educator. A

254254 2 the purpose of providing instruction in accordance
255255 3 with Article 14C of this Code to an applicant who
256256 4 provides satisfactory evidence that he or she meets

258258 6 (i) Possesses adequate speaking, reading, and
259259 7 writing ability in the language other than English
260260 8 in which transitional bilingual education is
261261 9 offered.
262262 10 (ii) Has the ability to successfully
263263 11 communicate in English.
264264 12 (iii) Either possessed, within 5 years
265265 13 previous to his or her applying for a transitional

268268 16 authorization issued by a foreign country or holds

296296 8 other than English in the public schools, an

299299 11 endorsement, provided that the applicant provides
300300 12 satisfactory evidence that he or she meets all of the
301301 13 following requirements:
302302 14 (i) Holds a transitional bilingual
303303 15 endorsement.
304304 16 (ii) Has demonstrated proficiency in the
305305 17 language for which the endorsement is to be issued
306306 18 by passing the applicable language content test
307307 19 required by the State Board of Education.
308308 20 (iii) Holds a bachelor's degree or higher from
309309 21 a regionally accredited institution of higher
310310 22 education or, for individuals educated in a
311311 23 country other than the United States, holds a
312312 24 degree from an institution of higher learning in a

335335 11 (I) Visiting international educator. A visiting
336336 12 international educator endorsement on an Educator
337337 13 License with Stipulations may be issued to an
338338 14 individual who is being recruited by a particular
339339 15 school district that conducts formal recruitment
340340 16 programs outside of the United States to secure the
341341 17 services of qualified teachers and who meets all of
342342 18 the following requirements:
343343 19 (i) Holds the equivalent of a minimum of a
344344 20 bachelor's degree issued in the United States.
345345 21 (ii) Has been prepared as a teacher at the
346346 22 grade level for which he or she will be employed.
347347 23 (iii) Has adequate content knowledge in the
348348 24 subject to be taught.
349349 25 (iv) Has an adequate command of the English

363363 3 shall be permitted to teach in bilingual education
364364 4 programs in the language that was the medium of
365365 5 instruction in his or her teacher preparation program,
366366 6 provided that he or she passes the English Language
367367 7 Proficiency Examination or another test of writing
368368 8 skills in English identified by the State Board of
369369 9 Education, in consultation with the State Educator
370370 10 Preparation and Licensure Board.
371371 11 A visiting international educator endorsement on
372372 12 an Educator License with Stipulations is valid for 5
373373 13 years and shall not be renewed.
374374 14 (J) Paraprofessional educator. A paraprofessional
375375 15 educator endorsement on an Educator License with
376376 16 Stipulations may be issued to an applicant who holds a
377377 17 high school diploma or its recognized equivalent and
378378 18 (i) holds an associate's degree or a minimum of 60
379379 19 semester hours of credit from a regionally accredited
380380 20 institution of higher education; (ii) has passed a
381381 21 paraprofessional competency test under subsection
382382 22 (c-5) of Section 21B-30; or (iii) is at least 18 years
383383 23 of age and will be using the Educator License with
384384 24 Stipulations exclusively for grades prekindergarten
385385 25 through grade 8, until the individual reaches the age

398398 2 subparagraph (J). The paraprofessional educator
399399 3 endorsement is valid until June 30 immediately
400400 4 following 5 years of the endorsement being issued and
401401 5 may be renewed through application and payment of the
402402 6 appropriate fee, as required under Section 21B-40 of
403403 7 this Code. An individual who holds only a
404404 8 paraprofessional educator endorsement is not subject
405405 9 to additional requirements in order to renew the

407407 11 (K) Chief school business official. A chief school
408408 12 business official endorsement on an Educator License
409409 13 with Stipulations may be issued to an applicant who
410410 14 qualifies by having a master's degree or higher, 2
411411 15 years of full-time administrative experience in school
412412 16 business management or 2 years of university-approved
413413 17 practical experience, and a minimum of 24 semester
414414 18 hours of graduate credit in a program approved by the
415415 19 State Board of Education for the preparation of school
416416 20 business administrators and by passage of the
417417 21 applicable State tests, including an applicable
418418 22 content area test.
419419 23 The chief school business official endorsement may
420420 24 also be affixed to the Educator License with
421421 25 Stipulations of any holder who qualifies by having a

614614 2 A substitute teacher may only teach in the place of a
615615 3 licensed teacher who is under contract with the employing
616616 4 board. If, however, there is no licensed teacher under
617617 5 contract because of an emergency situation, then a
618618 6 district may employ a substitute teacher for no longer
619619 7 than 30 calendar days per each vacant position in the
620620 8 district if the district notifies the appropriate regional
621621 9 office of education within 5 business days after the
622622 10 employment of the substitute teacher in that vacant
623623 11 position. A district may continue to employ that same
624624 12 substitute teacher in that same vacant position for 90
625625 13 calendar days or until the end of the semester, whichever
626626 14 is greater, if, prior to the expiration of the
627627 15 30-calendar-day period then current, the district files a
628628 16 written request with the appropriate regional office of
629629 17 education for a 30-calendar-day extension on the basis
630630 18 that the position remains vacant and the district
631631 19 continues to actively seek qualified candidates and
632632 20 provides documentation that it has provided training
633633 21 specific to the position, including training on meeting
634634 22 the needs of students with disabilities and English
635635 23 learners if applicable. Each extension request shall be
636636 24 granted in writing by the regional office of education. An
637637 25 emergency situation is one in which an unforeseen vacancy

659659 11 through the 2022-2023 school year, otherwise 90 school
660660 12 days for any one licensed teacher under contract in the
661661 13 same school year. A substitute teacher who holds a
662662 14 Professional Educator License or Educator License with
663663 15 Stipulations shall not teach for more than 120 school days
664664 16 for any one licensed teacher under contract in the same
665665 17 school year. The limitations in this paragraph (3) on the
666666 18 number of days a substitute teacher may be employed do not
667667 19 apply to any school district operating under Article 34 of
668668 20 this Code.
669669 21 A school district may not require an individual who
670670 22 holds a valid Professional Educator License or Educator
671671 23 License with Stipulations to seek or hold a Substitute
672672 24 Teaching License to teach as a substitute teacher.
673673 25 (4) Short-Term Substitute Teaching License. Beginning

768768 13 Section 25.432 of Title 23 of the Illinois Administrative Code

770770 15 requirement for short-term approval, and an applicant for a
771771 16 social work associate endorsement on an Educator License with
772772 17 Stipulations is not required to pass a content area test.
773773 18 There shall be no exception to this requirement.
774774 19 (d-5) The State Board shall consult with any applicable
775775 20 vendors within 90 days after July 28, 2023 (the effective date
776776 21 of Public Act 103-402) to develop a plan to transition the test
777777 22 of content area knowledge in the endorsement area of
778778 23 elementary education, grades one through 6, by July 1, 2026 to

978978 7 (g) The content area knowledge test and the teacher
979979 8 performance assessment shall be the tests that from time to
980980 9 time are designated by the State Board of Education, in
981981 10 consultation with the State Educator Preparation and Licensure
982982 11 Board, and may be tests prepared by an educational testing
983983 12 organization or tests designed by the State Board of
984984 13 Education, in consultation with the State Educator Preparation
985985 14 and Licensure Board. The test of content area knowledge shall
986986 15 assess content knowledge in a specific subject field. The
987987 16 tests must be designed to be racially neutral to ensure that no
988988 17 person taking the tests is discriminated against on the basis
989989 18 of race, color, national origin, or other factors unrelated to
990990 19 the person's ability to perform as a licensed employee. The
991991 20 score required to pass the tests shall be fixed by the State
992992 21 Board of Education, in consultation with the State Educator
993993 22 Preparation and Licensure Board. The State Board of
994994 23 Education's rules for scoring the content area knowledge test
995995 24 may include scoring and retaking of each test section

10201020 13 (i) The rules developed to implement and enforce the
10211021 14 testing requirements under this Section shall include, without
10221022 15 limitation, provisions governing test selection, test
10231023 16 validation, and determination of a passing score,
10241024 17 administration of the tests, frequency of administration,
10251025 18 applicant fees, frequency of applicants taking the tests, the
10261026 19 years for which a score is valid, and appropriate special
10271027 20 accommodations. The State Board of Education shall develop
10281028 21 such rules as may be needed to ensure uniformity from year to
10291029 22 year in the level of difficulty for each form of an assessment.

10451045 3 (a) Beginning with the start of the new licensure system

10921092 14 (3) Except as provided in subdivision (2) of this
10931093 15 subsection (a), a A $50 application fee for each
10941094 16 endorsement or approval.
10951095 17 (4) A $10 per year registration fee for the course of
10961096 18 the validity cycle to register the license, which shall be
10971097 19 paid to the regional office of education having
10981098 20 supervision and control over the school in which the
10991099 21 individual holding the license is to be employed. If the
11001100 22 individual holding the license is not y et employed, then
11011101 23 the license may be registered in any county in this State.
11021102 24 The registration fee must be paid in its entirety the
11031103 25 first time the individual registers the license for a

11311131 17 (5) The license renewal fee for an Educator License
11321132 18 with Stipulations with a paraprofessional educator

11341134 20 (b) All application fees paid pursuant to subdivisions (1)
11351135 21 through (3) of subsection (a) of this Section shall be
11361136 22 deposited into the Teacher Certificate Fee Revolving Fund and
11371137 23 shall be used, subject to appropriation, by the State Board of
11381138 24 Education to provide the technology and human resources
11391139 25 necessary for the timely and efficient processing of

11601160 10 Certificate Fee Revolving Fund is not subject to
11611161 11 administrative charge transfers, authorized under Section 8h
11621162 12 of the State Finance Act, from the Teacher Certificate Fee
11631163 13 Revolving Fund into any other fund of this State, and moneys in
11641164 14 the Teacher Certificate Fee Revolving Fund shall not revert
11651165 15 back to the General Revenue Fund at any time.
11661166 16 The regional superintendent of schools shall deposit the
11671167 17 registration fees paid pursuant to subdivision (4) of
11681168 18 subsection (a) of this Section into the institute fund
11691169 19 established pursuant to Section 3-11 of this Code.
11701170 20 (c) The State Board of Education and each regional office
11711171 21 of education are authorized to charge a service or convenience
11721172 22 fee for the use of credit cards for the payment of license
11731173 23 fees. This service or convenience fee shall not exceed the
11741174 24 amount required by the credit card processing company or
11751175 25 vendor that has entered into a contract with the State Board or
