1111 1 AN ACT concerning revenue.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Energy Transition Act is amended by
1515 5 changing Section 5-5 as follows:

1717 7 (Section scheduled to be repealed on September 15, 2045)
1818 8 Sec. 5-5. Definitions. As used in this Act:
1919 9 "Apprentice" means a participant in an apprenticeship
2020 10 program approved by and registered with the United States
2121 11 Department of Labor's Bureau of Apprenticeship and Training.
2222 12 "Apprenticeship program" means an apprenticeship and
2323 13 training program approved by and registered with the United
2424 14 States Department of Labor's Bureau of Apprenticeship and
2525 15 Training.
2626 16 "Black, indigenous, and people of color" or "BIPOC" means
2727 17 people who are members of the groups described in
2828 18 subparagraphs (a) through (e) of paragraph (A) of subsection
2929 19 (1) of Section 2 of the Business Enterprise for Minorities,
3030 20 Women, and Persons with Disabilities Act.
3131 21 "Community-based organization organizations" means an
3232 22 organization that: (1) provides employment, skill development,
3333 23 or related services to members of the community; (2) includes

6868 1 community colleges, nonprofits, and local governments; (3) has

7272 5 "Community-based organization" also means an entity that
7373 6 currently receives federal funding from the federal Workforce
7474 7 Innovation and Opportunity Act.
7575 8 "Department" means the Department of Commerce and Economic
7676 9 Opportunity, unless the text solely specifies a particular
7777 10 Department.
7878 11 "Director" means the Director of Commerce and Economic
7979 12 Opportunity.
8080 13 "Equity eligible contractor" or "eligible contractor"
8181 14 means:
8282 15 (1) a business that is majority-owned by equity
8383 16 investment eligible individuals or persons who are or have
8484 17 been participants in the Clean Jobs Workforce Network
8585 18 Program, Clean Energy Contractor Incubator Program,
8686 19 Returning Residents Clean Jobs Training Program, Illinois
8787 20 Climate Works Preapprenticeship Program, or Clean Energy
8888 21 Primes Contractor Accelerator Program;
8989 22 (2) a nonprofit or cooperative that is
9090 23 majority-governed by equity investment eligible
9191 24 individuals or persons who are or have been participants
9292 25 in the Clean Jobs Workforce Network Program, Clean Energy
9393 26 Contractor Incubator Program, Returning Residents Clean

107107 4 (3) an equity investment eligible person or an
108108 5 individual who is or has been a participant in the Clean
109109 6 Jobs Workforce Network Program, Clean Energy Contractor
110110 7 Incubator Program, Returning Residents Clean Jobs Training
111111 8 Program, Illinois Climate Works Preapprenticeship Program,
112112 9 or Clean Energy Primes Contractor Accelerator Program and
113113 10 who is offering personal services as an independent
114114 11 contractor.
115115 12 "Equity focused populations" means (i) low-income persons;
116116 13 (ii) persons residing in equity investment eligible
117117 14 communities; (iii) persons who identify as black, indigenous,
118118 15 and people of color; (iv) formerly convicted persons; (v)
119119 16 persons who are or were in the child welfare system; (vi)
120120 17 energy workers; (vii) dependents of displaced energy workers;
121121 18 (viii) women; (ix) LGBTQ+, transgender, or gender
122122 19 nonconforming persons; (x) persons with disabilities; and (xi)
123123 20 members of any of these groups who are also youth.
124124 21 "Equity investment eligible community" and "eligible
125125 22 community" are synonymous and mean the geographic areas
126126 23 throughout Illinois which would most benefit from equitable
127127 24 investments by the State designed to combat discrimination and
128128 25 foster sustainable economic growth. Specifically, the eligible

140140 1 (1) R3 Areas as established pursuant to Section 10-40
141141 2 of the Cannabis Regulation and Tax Act, where residents
142142 3 have historically been excluded from economic
143143 4 opportunities, including opportunities in the energy
144144 5 sector; and
145145 6 (2) Environmental justice communities, as defined by
146146 7 the Illinois Power Agency pursuant to the Illinois Power
147147 8 Agency Act, but excluding racial and ethnic indicators,
148148 9 where residents have historically been subject to
149149 10 disproportionate burdens of pollution, including pollution
150150 11 from the energy sector.
151151 12 "Equity investment eligible person" and "eligible person"
152152 13 are synonymous and mean the persons who would most benefit
153153 14 from equitable investments by the State designed to combat
154154 15 discrimination and foster sustainable economic growth.
155155 16 Specifically, eligible persons means the following people:
156156 17 (1) persons whose primary residence is in an equity
157157 18 investment eligible community;
158158 19 (2) persons who are graduates of or currently enrolled
159159 20 in the foster care system; or
160160 21 (3) persons who were formerly incarcerated.
161161 22 "Climate Works Hub" means a nonprofit organization
162162 23 selected by the Department to act as a workforce intermediary
163163 24 and to participate in the Illinois Climate Works
164164 25 Preapprenticeship Program. To qualify as a Climate Works Hub,
165165 26 the organization must demonstrate the following:

176176 1 (1) the ability to effectively serve diverse and
177177 2 underrepresented populations, including by providing
178178 3 employment services to such populations;
179179 4 (2) experience with the construction and building
180180 5 trades;
181181 6 (3) the ability to recruit, prescreen, and provide
182182 7 preapprenticeship training to prepare workers for
183183 8 employment in the construction and building trades; and
184184 9 (4) a plan to provide the following:
185185 10 (A) preparatory classes;
186186 11 (B) workplace readiness skills, such as resume
187187 12 preparation and interviewing techniques;
188188 13 (C) strategies for overcoming barriers to entry
189189 14 and completion of an apprenticeship program; and
190190 15 (D) any prerequisites for acceptance into an
191191 16 apprenticeship program.
