11	11	1 AN ACT concerning revenue.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 5. The Energy Transition Act is amended by
15	15	5 changing Section 5-5 as follows:
16	16	6 (20 ILCS 730/5-5)
17	17	7 (Section scheduled to be repealed on September 15, 2045)
18	18	8 Sec. 5-5. Definitions. As used in this Act:
19	19	9 "Apprentice" means a participant in an apprenticeship
20	20	10 program approved by and registered with the United States
21	21	11 Department of Labor's Bureau of Apprenticeship and Training.
22	22	12 "Apprenticeship program" means an apprenticeship and
23	23	13 training program approved by and registered with the United
24	24	14 States Department of Labor's Bureau of Apprenticeship and
25	25	15 Training.
26	26	16 "Black, indigenous, and people of color" or "BIPOC" means
27	27	17 people who are members of the groups described in
28	28	18 subparagraphs (a) through (e) of paragraph (A) of subsection
29	29	19 (1) of Section 2 of the Business Enterprise for Minorities,
30	30	20 Women, and Persons with Disabilities Act.
31	31	21 "Community-based organization organizations" means an
32	32	22 organization that: (1) provides employment, skill development,
33	33	23 or related services to members of the community; (2) includes

68	68	1 community colleges, nonprofits, and local governments; (3) has
69	69	2 at least one main operating office in the community or region
70	70	3 it serves; and (4) demonstrates relationships with local
71	71	4 residents and other organizations serving the community.
72	72	5 "Community-based organization" also means an entity that
73	73	6 currently receives federal funding from the federal Workforce
74	74	7 Innovation and Opportunity Act.
75	75	8 "Department" means the Department of Commerce and Economic
76	76	9 Opportunity, unless the text solely specifies a particular
77	77	10 Department.
78	78	11 "Director" means the Director of Commerce and Economic
79	79	12 Opportunity.
80	80	13 "Equity eligible contractor" or "eligible contractor"
81	81	14 means:
82	82	15 (1) a business that is majority-owned by equity
83	83	16 investment eligible individuals or persons who are or have
84	84	17 been participants in the Clean Jobs Workforce Network
85	85	18 Program, Clean Energy Contractor Incubator Program,
86	86	19 Returning Residents Clean Jobs Training Program, Illinois
87	87	20 Climate Works Preapprenticeship Program, or Clean Energy
88	88	21 Primes Contractor Accelerator Program;
89	89	22 (2) a nonprofit or cooperative that is
90	90	23 majority-governed by equity investment eligible
91	91	24 individuals or persons who are or have been participants
92	92	25 in the Clean Jobs Workforce Network Program, Clean Energy
93	93	26 Contractor Incubator Program, Returning Residents Clean

105	105	2 Preapprenticeship Program, or Clean Energy Primes
106	106	3 Contractor Accelerator Program; or
107	107	4 (3) an equity investment eligible person or an
108	108	5 individual who is or has been a participant in the Clean
109	109	6 Jobs Workforce Network Program, Clean Energy Contractor
110	110	7 Incubator Program, Returning Residents Clean Jobs Training
111	111	8 Program, Illinois Climate Works Preapprenticeship Program,
112	112	9 or Clean Energy Primes Contractor Accelerator Program and
113	113	10 who is offering personal services as an independent
114	114	11 contractor.
115	115	12 "Equity focused populations" means (i) low-income persons;
116	116	13 (ii) persons residing in equity investment eligible
117	117	14 communities; (iii) persons who identify as black, indigenous,
118	118	15 and people of color; (iv) formerly convicted persons; (v)
119	119	16 persons who are or were in the child welfare system; (vi)
120	120	17 energy workers; (vii) dependents of displaced energy workers;
121	121	18 (viii) women; (ix) LGBTQ+, transgender, or gender
122	122	19 nonconforming persons; (x) persons with disabilities; and (xi)
123	123	20 members of any of these groups who are also youth.
124	124	21 "Equity investment eligible community" and "eligible
125	125	22 community" are synonymous and mean the geographic areas
126	126	23 throughout Illinois which would most benefit from equitable
127	127	24 investments by the State designed to combat discrimination and
128	128	25 foster sustainable economic growth. Specifically, the eligible
129	129	26 community means the following areas:

140	140	1 (1) R3 Areas as established pursuant to Section 10-40
141	141	2 of the Cannabis Regulation and Tax Act, where residents
142	142	3 have historically been excluded from economic
143	143	4 opportunities, including opportunities in the energy
144	144	5 sector; and
145	145	6 (2) Environmental justice communities, as defined by
146	146	7 the Illinois Power Agency pursuant to the Illinois Power
147	147	8 Agency Act, but excluding racial and ethnic indicators,
148	148	9 where residents have historically been subject to
149	149	10 disproportionate burdens of pollution, including pollution
150	150	11 from the energy sector.
151	151	12 "Equity investment eligible person" and "eligible person"
152	152	13 are synonymous and mean the persons who would most benefit
153	153	14 from equitable investments by the State designed to combat
154	154	15 discrimination and foster sustainable economic growth.
155	155	16 Specifically, eligible persons means the following people:
156	156	17 (1) persons whose primary residence is in an equity
157	157	18 investment eligible community;
158	158	19 (2) persons who are graduates of or currently enrolled
159	159	20 in the foster care system; or
160	160	21 (3) persons who were formerly incarcerated.
161	161	22 "Climate Works Hub" means a nonprofit organization
162	162	23 selected by the Department to act as a workforce intermediary
163	163	24 and to participate in the Illinois Climate Works
164	164	25 Preapprenticeship Program. To qualify as a Climate Works Hub,
165	165	26 the organization must demonstrate the following:

176	176	1 (1) the ability to effectively serve diverse and
177	177	2 underrepresented populations, including by providing
178	178	3 employment services to such populations;
179	179	4 (2) experience with the construction and building
180	180	5 trades;
181	181	6 (3) the ability to recruit, prescreen, and provide
182	182	7 preapprenticeship training to prepare workers for
183	183	8 employment in the construction and building trades; and
184	184	9 (4) a plan to provide the following:
185	185	10 (A) preparatory classes;
186	186	11 (B) workplace readiness skills, such as resume
187	187	12 preparation and interviewing techniques;
188	188	13 (C) strategies for overcoming barriers to entry
189	189	14 and completion of an apprenticeship program; and
190	190	15 (D) any prerequisites for acceptance into an
191	191	16 apprenticeship program.
