11	11	1 AN ACT concerning criminal law.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 5. The Criminal Code of 2012 is amended by
15	15	5 changing Section 12-2 as follows:
16	16	6 (720 ILCS 5/12-2) (from Ch. 38, par. 12-2)
17	17	7 Sec. 12-2. Aggravated assault.
18	18	8 (a) Offense based on location of conduct. A person commits
19	19	9 aggravated assault when he or she commits an assault against
20	20	10 an individual who is on or about a public way, public property,
21	21	11 a public place of accommodation or amusement, or a sports
22	22	12 venue, or in a church, synagogue, mosque, or other building,
23	23	13 structure, or place used for religious worship.
24	24	14 (b) Offense based on status of victim. A person commits
25	25	15 aggravated assault when, in committing an assault, he or she
26	26	16 knows the individual assaulted to be any of the following:
27	27	17 (1) A person with a physical disability or a person 60
28	28	18 years of age or older and the assault is without legal
29	29	19 justification.
30	30	20 (2) A teacher or school employee upon school grounds
31	31	21 or grounds adjacent to a school or in any part of a
32	32	22 building used for school purposes.

70	70	3 (3) A park district employee upon park grounds or
71	71	4 grounds adjacent to a park or in any part of a building
72	72	5 used for park purposes.
73	73	6 (4) A community policing volunteer, private security
74	74	7 officer, or utility worker:
75	75	8 (i) performing his or her official duties;
76	76	9 (ii) assaulted to prevent performance of his or
77	77	10 her official duties; or
78	78	11 (iii) assaulted in retaliation for performing his
79	79	12 or her official duties.
80	80	13 (4.1) A peace officer, fireman, emergency management
81	81	14 worker, or emergency medical services personnel:
82	82	15 (i) performing his or her official duties;
83	83	16 (ii) assaulted to prevent performance of his or
84	84	17 her official duties; or
85	85	18 (iii) assaulted in retaliation for performing his
86	86	19 or her official duties.
87	87	20 (5) A correctional officer or probation officer:
88	88	21 (i) performing his or her official duties;
89	89	22 (ii) assaulted to prevent performance of his or
90	90	23 her official duties; or
91	91	24 (iii) assaulted in retaliation for performing his

104	104	1 juvenile detention center employee who provides direct and
105	105	2 continuous supervision of residents of a juvenile
106	106	3 detention center, including a county juvenile detention
107	107	4 center employee who supervises recreational activity for
108	108	5 residents of a juvenile detention center, or a Department
109	109	6 of Human Services employee, Department of Human Services
110	110	7 officer, or employee of a subcontractor of the Department
111	111	8 of Human Services supervising or controlling sexually
112	112	9 dangerous persons or sexually violent persons:
113	113	10 (i) performing his or her official duties;
114	114	11 (ii) assaulted to prevent performance of his or
115	115	12 her official duties; or
116	116	13 (iii) assaulted in retaliation for performing his
117	117	14 or her official duties.
118	118	15 (7) An employee of the State of Illinois, a municipal
119	119	16 corporation therein, or a political subdivision thereof,
120	120	17 performing his or her official duties.
121	121	18 (8) A transit employee performing his or her official
122	122	19 duties, or a transit passenger.
123	123	20 (9) A sports official or coach actively participating
124	124	21 in any level of athletic competition within a sports
125	125	22 venue, on an indoor playing field or outdoor playing
126	126	23 field, or within the immediate vicinity of such a facility

128	128	25 (10) A person authorized to serve process under
129	129	26 Section 2-202 of the Code of Civil Procedure or a special

140	140	1 process server appointed by the circuit court, while that
141	141	2 individual is in the performance of his or her duties as a
142	142	3 process server.
143	143	4 (c) Offense based on use of firearm, device, or motor
144	144	5 vehicle. A person commits aggravated assault when, in
145	145	6 committing an assault, he or she does any of the following:
146	146	7 (1) Uses a deadly weapon, an air rifle as defined in
147	147	8 Section 24.8-0.1 of this Act, or any device manufactured
148	148	9 and designed to be substantially similar in appearance to
149	149	10 a firearm, other than by discharging a firearm.
150	150	11 (2) Discharges a firearm, other than from a motor
151	151	12 vehicle.
152	152	13 (3) Discharges a firearm from a motor vehicle.
153	153	14 (4) Wears a hood, robe, or mask to conceal his or her
154	154	15 identity.
155	155	16 (5) Knowingly and without lawful justification shines
156	156	17 or flashes a laser gun sight or other laser device
157	157	18 attached to a firearm, or used in concert with a firearm,
158	158	19 so that the laser beam strikes near or in the immediate
159	159	20 vicinity of any person.
160	160	21 (6) Uses a firearm, other than by discharging the
161	161	22 firearm, against a peace officer, community policing
162	162	23 volunteer, fireman, private security officer, emergency
163	163	24 management worker, emergency medical services personnel,
164	164	25 employee of a police department, employee of a sheriff's
165	165	26 department, or traffic control municipal employee:

177	177	2 (ii) assaulted to prevent performance of his or
178	178	3 her official duties; or
179	179	4 (iii) assaulted in retaliation for performing his

181	181	6 (7) Without justification operates a motor vehicle in
182	182	7 a manner which places a person, other than a person listed
183	183	8 in subdivision (b)(4), in reasonable apprehension of being
184	184	9 struck by the moving motor vehicle.
185	185	10 (8) Without justification operates a motor vehicle in
186	186	11 a manner which places a person listed in subdivision
187	187	12 (b)(4), in reasonable apprehension of being struck by the
188	188	13 moving motor vehicle.
189	189	14 (9) Knowingly video or audio records the offense with
190	190	15 the intent to disseminate the recording.
191	191	16 (d) Sentence. Aggravated assault as defined in subdivision
192	192	17 (a), (b)(1), (b)(2), (b)(3), (b)(4), (b)(7), (b)(8), (b)(9),
193	193	18 (c)(1), (c)(4), or (c)(9) is a Class A misdemeanor, except
194	194	19 that aggravated assault as defined in subdivision (b)(4) and
195	195	20 (b)(7) is a Class 4 felony if a Category I, Category II, or
196	196	21 Category III weapon is used in the commission of the assault.
197	197	22 Aggravated assault as defined in subdivision (b)(2.1),
198	198	23 (b)(4.1), (b)(5), (b)(6), (b)(10), (c)(2), (c)(5), (c)(6), or
199	199	24 (c)(7) is a Class 4 felony. Aggravated assault as defined in
200	200	25 subdivision (c)(3) or (c)(8) is a Class 3 felony.
201	201	26 (e) For the purposes of this Section, "Category I weapon",
