311 1 AN ACT concerning safety.
412 2 Be it enacted by the People of the State of Illinois,
513 3 represented in the General Assembly:
614 4 Section 5. The Environmental Protection Act is amended by
715 5 changing Section 15 as follows:

917 7 Sec. 15. Plans and specifications; demonstration of
1018 8 capability; record retention.
1119 9 (a) Owners of public water supplies, their authorized
1220 10 representative, or legal custodians, shall submit plans and
1321 11 specifications to the Agency and obtain written approval
1422 12 before construction of any proposed public water supply
1523 13 installations, changes, or additions is started. Plans and
1624 14 specifications shall be complete and of sufficient detail to
1725 15 show all proposed construction, changes, or additions that may
1826 16 affect sanitary quality, mineral quality, or adequacy of the
1927 17 public water supply; and, where necessary, said plans and
2028 18 specifications shall be accompanied by supplemental data as
2129 19 may be required by the Agency to permit a complete review
2230 20 thereof. In the case of water main installation projects, all
23-21 water main and appurtenances, including, but not limited to,
24-22 fire hydrants and valves that are under the ownership and
25-23 control of a public water supply and located in a public right
31+21 water main-related appurtenances, and specifically fire
32+22 hydrants and valves, shall be included in the Agency's written
33+23 approval. Fire hydrants and valves shall be designed and

34-1 of way or utility access easement, shall be included in the
35-2 Agency's written approval. Design review and permitting of
36-3 water main and fire hydrants is the sole responsibility of the
37-4 Agency and water main and fire hydrants shall be installed in
38-5 accordance with the written Agency permit. Fire hydrants
39-6 connected to a plumbing system shall be installed in
40-7 accordance with the Illinois Plumbing License Law and the
41-8 rules and ordinances issued thereunder.
42-9 (b) All new public water supplies established after
43-10 October 1, 1999 shall demonstrate technical, financial, and
44-11 managerial capacity as a condition for issuance of a
45-12 construction or operation permit by the Agency or its
46-13 designee. The demonstration shall be consistent with the
47-14 technical, financial, and managerial provisions of the federal
48-15 Safe Drinking Water Act (P.L. 93-523), as now or hereafter
49-16 amended. The Agency is authorized to adopt rules in accordance
50-17 with the Illinois Administrative Procedure Act to implement
51-18 the purposes of this subsection. Such rules must take into
52-19 account the need for the facility, facility size,
53-20 sophistication of treatment of the water supply, and financial
54-21 requirements needed for operation of the facility.
55-22 (c) Except as otherwise provided under Board rules, owners
56-23 and operators of community water systems must maintain all
57-24 records, reports, and other documents related to the operation
58-25 of the community water system for a minimum of 10 years.

73+6 Specifications for Water and Sewer Construction in Illinois
74+7 published by the Standard Specifications for Water and Sewer
75+8 Construction Committee, and the local fire code in effect for
76+9 the area of the proposed installation.
