11	11	1 AN ACT concerning business.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 5. The Consumer Fraud and Deceptive Business
15	15	5 Practices Act is amended by changing Section 2PP as follows:
16	16	6 (815 ILCS 505/2PP)
17	17	7 Sec. 2PP. Mail; disclosure.
18	18	8 (a) It is an unlawful practice under this Act for a company
19	19	9 not connected to the company from which the recipient has
20	20	10 purchased or obtained goods, services, or other merchandise to
21	21	11 knowingly mail or send or cause to be mailed or sent a postcard
22	22	12 or letter to a recipient in this State if the postcard or
23	23	13 letter:
24	24	14 (1) the postcard or letter contains a request that the
25	25	15 recipient contact the sender by mail, telephone, email,
26	26	16 website, or other prescribed means; and
27	27	17 (2) the postcard or letter is mailed or sent to induce
28	28	18 the recipient to contact the sender by mail, telephone,
29	29	19 email, website, or other prescribed means so that goods,
30	30	20 services, or other merchandise, as defined in Section 1,
31	31	21 may be offered for sale to the recipient; and
32	32	22 (3) the postcard or letter does not disclose or
33	33	23 disclaim that it is not a bill and that it is a

68	68	1 solicitation for goods, services, or other merchandise, as
69	69	2 defined in Section 1, that may be offered for sale if the
70	70	3 recipient contacts the sender by mail, telephone, email,
71	71	4 website, or any other prescribed means; and
72	72	5 (4) the postcard or letter does not disclose or
73	73	6 disclaim any and all affiliations or lack thereof; and .
74	74	7 (5) creates the impression that the sender is the same
75	75	8 company from which the recipient purchased or obtained
76	76	9 goods, services, or other merchandise or is affiliated
77	77	10 with that company when no legal or commercial affiliation
78	78	11 exists between that company and the sender.
79	79	12 (b) All disclosures and disclaimers appearing on a
80	80	13 postcard or letter required by this Section must be
81	81	14 conspicuously located at the top of the postcard or letter, be
82	82	15 easily readable in clear and unambiguous language, and be
83	83	16 printed in at least 14-point bold-face font in a
84	84	17 black-outlined box. Postcards or letters that are sent in
85	85	18 compliance with 39 U.S.C. Section 3001 are deemed to be in
86	86	19 compliance with this Section.
