311 1 AN ACT concerning transportation.
412 2 Be it enacted by the People of the State of Illinois,
513 3 represented in the General Assembly:
614 4 Section 5. The Illinois Vehicle Code is amended by
715 5 changing Section 6-104 as follows:

917 7 Sec. 6-104. Classification of Driver - Special
1018 8 Restrictions.
1119 9 (a) A driver's license issued under the authority of this
1220 10 Act shall indicate the classification for which the applicant
1321 11 therefor has qualified by examination or by such other means
1422 12 that the Secretary of State shall prescribe. Driver's license
1523 13 classifications shall be prescribed by rule or regulation
1624 14 promulgated by the Secretary of State and such may specify
1725 15 classifications as to operation of motor vehicles of the first
1826 16 division, or of those of the second division, whether operated
1927 17 singly or in lawful combination, and whether for-hire or
2028 18 not-for-hire, and may specify such other classifications as
2129 19 the Secretary deems necessary.
2230 20 No person shall operate a motor vehicle unless such person
2331 21 has a valid license with a proper classification to permit the
2432 22 operation of such vehicle, except that any person may operate
2533 23 a moped if such person has a valid current Illinois driver's

3468 1 license, regardless of classification.
3569 2 Notwithstanding any other provision of this Code or any
3670 3 rule adopted under this Code, a nonresident who is employed as
3771 4 a public safety worker, as defined in Section 6-117.2, may
3872 5 operate in this State an authorized emergency vehicle, as
3973 6 defined in Section 1-105, if the nonresident possesses the
4074 7 license class required by the nonresident's state of residence
41-8 to operate similar equipment.
42-9 (b) No person who is under the age of 21 years or has had
43-10 less than 1 year of driving experience shall drive: (1) in
44-11 connection with the operation of any school, day camp, summer
45-12 camp, or nursery school, any public or private motor vehicle
46-13 for transporting children to or from any school, day camp,
47-14 summer camp, or nursery school, or (2) any motor vehicle of the
48-15 second division when in use for the transportation of persons
49-16 for compensation.
50-17 (c) No person who is under the age of 18 years shall be
51-18 issued a license for the purpose of transporting property for
52-19 hire, or for the purpose of transporting persons for
53-20 compensation in a motor vehicle of the first division.
54-21 (d) No person shall drive: (1) a school bus when
55-22 transporting school children unless such person possesses a
56-23 valid school bus driver permit or is accompanied and
57-24 supervised, for the specific purpose of training prior to
58-25 routine operation of a school bus, by a person who has held a
59-26 valid school bus driver permit for at least one year; or (2)
75+8 to operate similar equipment and the nonresident has completed
76+9 the Fire Service Vehicle Operator program of the Illinois
77+10 State Fire Marshal.
78+11 (b) No person who is under the age of 21 years or has had
79+12 less than 1 year of driving experience shall drive: (1) in

90+23 (d) No person shall drive: (1) a school bus when
91+24 transporting school children unless such person possesses a
92+25 valid school bus driver permit or is accompanied and
93+26 supervised, for the specific purpose of training prior to

70-1 any other vehicle owned or operated by or for a public or
71-2 private school, or a school operated by a religious
72-3 institution, where such vehicle is being used over a regularly
73-4 scheduled route for the transportation of persons enrolled as
74-5 a student in grade 12 or below, in connection with any activity
75-6 of the entities unless such person possesses a valid school
76-7 bus driver permit.
77-8 (d-5) No person may drive a bus that does not meet the
78-9 special requirements for school buses provided in Sections
79-10 12-801, 12-802, 12-803, and 12-805 of this Code that has been
80-11 chartered for the sole purpose of transporting students
81-12 regularly enrolled in grade 12 or below to or from
82-13 interscholastic athletic or interscholastic or school
83-14 sponsored activities unless the person has a valid and
84-15 properly classified commercial driver's license as provided in
85-16 subsection (c-1) of Section 6-508 of this Code in addition to
86-17 any other permit or license that is required to operate that
87-18 bus. This subsection (d-5) does not apply to any bus driver
88-19 employed by a public transportation provider authorized to
89-20 conduct local or interurban transportation of passengers when
90-21 the bus is not traveling a specific school bus route but is on
91-22 a regularly scheduled route for the transporting of other fare
92-23 paying passengers.
93-24 A person may operate a chartered bus described in this
94-25 subsection (d-5) if he or she is not disqualified from driving
95-26 a chartered bus of that type and if he or she holds a CDL that

104+1 routine operation of a school bus, by a person who has held a
105+2 valid school bus driver permit for at least one year; or (2)
106+3 any other vehicle owned or operated by or for a public or
107+4 private school, or a school operated by a religious
108+5 institution, where such vehicle is being used over a regularly
109+6 scheduled route for the transportation of persons enrolled as
110+7 a student in grade 12 or below, in connection with any activity
111+8 of the entities unless such person possesses a valid school
112+9 bus driver permit.
113+10 (d-5) No person may drive a bus that does not meet the

106-1 is:
107-2 (1) issued to him or her by any other state or
108-3 jurisdiction in accordance with 49 CFR 383;
109-4 (2) not suspended, revoked, or canceled; and
110-5 (3) valid under 49 CFR 383, subpart F, for the type of
111-6 vehicle being driven.
112-7 A person may also operate a chartered bus described in
113-8 this subsection (d-5) if he or she holds a valid CDL and a
114-9 valid school bus driver permit that was issued on or before
115-10 December 31, 2003.
116-11 (e) No person shall drive a religious organization bus
117-12 unless such person has a valid and properly classified drivers
118-13 license or a valid school bus driver permit.
119-14 (f) No person shall drive a motor vehicle for the purpose
120-15 of providing transportation for the elderly in connection with
121-16 the activities of any public or private organization unless
122-17 such person has a valid and properly classified driver's
123-18 license issued by the Secretary of State.
124-19 (g) No person shall drive a bus which meets the special
125-20 requirements for school buses provided in Section 12-801,
126-21 12-802, 12-803 and 12-805 of this Code for the purpose of
127-22 transporting persons 18 years of age or less in connection
128-23 with any youth camp licensed under the Youth Camp Act or any
129-24 child care facility licensed under the Child Care Act of 1969
130-25 unless such person possesses a valid school bus driver permit
131-26 or is accompanied and supervised, for the specific purpose of

140+1 subsection (d-5) if he or she is not disqualified from driving

142-1 training prior to routine operation of a school bus, by a
143-2 person who has held a valid school bus driver permit for at
144-3 least one year; however, a person who has a valid and properly
145-4 classified driver's license issued by the Secretary of State
146-5 may operate a school bus for the purpose of transporting
147-6 persons 18 years of age or less in connection with any such
148-7 youth camp or child care facility if the "SCHOOL BUS" signs are
149-8 covered or concealed and the stop signal arm and flashing
150-9 signal systems are not operable through normal controls.
151-10 (h) No person shall operate an autocycle unless he or she
152-11 has a valid Class D driver's license.
