1111 1 AN ACT concerning regulation.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Health Care Violence Prevention Act is
1515 5 amended by changing Section 15 as follows:

1717 7 Sec. 15. Workplace safety.
1818 8 (a) A health care worker who contacts law enforcement or
1919 9 files a report with law enforcement against a patient or
2020 10 individual because of workplace violence shall provide notice
2121 11 to management of the health care provider by which he or she is
2222 12 employed within 3 days after contacting law enforcement or
2323 13 filing the report.
2424 14 (a-5) A health care provider shall report any incident of
2525 15 verbal aggression or physical assault of a health care worker
2626 16 employed by the health care provider in the health care
2727 17 provider's emergency department to the Department of Public
2828 18 Health. The Department of Public Health shall track
2929 19 information reported under this subsection to assess each
3030 20 health care provider's progress in systemically limiting the
3131 21 verbal aggression toward and physical assault of health care
3232 22 workers.
3333 23 (b) No management of a health care provider may discourage

6868 1 a health care worker from exercising his or her right to
6969 2 contact law enforcement or file a report with law enforcement
7070 3 because of workplace violence.
7171 4 (c) A health care provider that employs a health care
7272 5 worker shall display a notice, either by physical or
7373 6 electronic means, stating that verbal aggression will not be
7474 7 tolerated and physical assault will be reported to law
7575 8 enforcement. The notice shall also be displayed in each
7676 9 emergency department of the health care provider.
7777 10 (d) The health care provider shall offer immediate
7878 11 post-incident services for a health care worker directly
7979 12 involved in a workplace violence incident caused by patients
8080 13 or their visitors, including acute treatment and access to
8181 14 psychological evaluation.
