11	11	1 AN ACT concerning regulation.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 5. The Health Care Violence Prevention Act is
15	15	5 amended by changing Section 15 as follows:

17	17	7 Sec. 15. Workplace safety.
18	18	8 (a) A health care worker who contacts law enforcement or
19	19	9 files a report with law enforcement against a patient or
20	20	10 individual because of workplace violence shall provide notice
21	21	11 to management of the health care provider by which he or she is
22	22	12 employed within 3 days after contacting law enforcement or
23	23	13 filing the report.
24	24	14 (a-5) A health care provider shall report any incident of
25	25	15 verbal aggression or physical assault of a health care worker
26	26	16 employed by the health care provider in the health care
27	27	17 provider's emergency department to the Department of Public
28	28	18 Health. The Department of Public Health shall track
29	29	19 information reported under this subsection to assess each
30	30	20 health care provider's progress in systemically limiting the
31	31	21 verbal aggression toward and physical assault of health care
32	32	22 workers.

68	68	1 a health care worker from exercising his or her right to
69	69	2 contact law enforcement or file a report with law enforcement
70	70	3 because of workplace violence.
71	71	4 (c) A health care provider that employs a health care
72	72	5 worker shall display a notice, either by physical or
73	73	6 electronic means, stating that verbal aggression will not be
74	74	7 tolerated and physical assault will be reported to law
75	75	8 enforcement. The notice shall also be displayed in each
76	76	9 emergency department of the health care provider.
77	77	10 (d) The health care provider shall offer immediate
78	78	11 post-incident services for a health care worker directly
79	79	12 involved in a workplace violence incident caused by patients
80	80	13 or their visitors, including acute treatment and access to
81	81	14 psychological evaluation.
