11	11	1 AN ACT concerning finance.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 5. The Illinois Procurement Code is amended by
15	15	5 changing Section 25-65 as follows:
16	16	6 (30 ILCS 500/25-65)
17	17	7 Sec. 25-65. Contracts performed outside the United States.
18	18	8 Prior to contracting or as a requirement of solicitation of
19	19	9 any State contracts for services as defined in Section
20	20	10 1-15.90, whichever is appropriate, potential contractors shall
21	21	11 disclose in a statement of work where services will be
22	22	12 performed under that contract, including any subcontracts, and
23	23	13 whether any services under that contract, including any
24	24	14 subcontracts, are anticipated to be performed outside the
25	25	15 United States.
26	26	16 In awarding the contract or evaluating the bid or offer,
27	27	17 the chief procurement officer shall may consider such
28	28	18 disclosure and the economic impact to the State of Illinois
29	29	19 and its residents.
30	30	20 The chief procurement officer may not award a contract to
31	31	21 a vendor if more than 10% of the services contracted, based on
32	32	22 the cost of services, are to be performed outside of the United

68	68	1 If the chief procurement officer awards a contract to a
69	69	2 vendor based upon disclosure that work will be performed in
70	70	3 the United States and during the term of the contract the
71	71	4 contractor or a subcontractor proceeds to shift work outside
72	72	5 of the United States, the contractor shall be deemed in breach
73	73	6 of contract, unless the chief procurement officer shall have
74	74	7 first determined in writing that circumstances require the
75	75	8 shift of work or that termination of the contract would not be
76	76	9 in the State's best interest.
77	77	10 Nothing in this Section is intended to contravene any
78	78	11 existing treaty, law, agreement, or regulation of the United
79	79	12 States.
80	80	13 The chief procurement officer appointed pursuant to
81	81	14 paragraph (4) of subsection (a) of Section 10-20 shall prepare
82	82	15 and deliver to the General Assembly, no later than September
83	83	16 1, 2015, a report on the impact of outsourcing services for
84	84	17 State agencies subject to the jurisdiction of the chief
85	85	18 procurement officer. The report shall include the State's cost
86	86	19 of procurement and shall identify those contracts where it was
87	87	20 disclosed that services were provided outside of the United
88	88	21 States, including a description and value of those services.
89	89	22 Each State agency subject to the jurisdiction of the chief
90	90	23 procurement officer appointed pursuant to paragraph (4) of
91	91	24 subsection (a) of Section 10-20 must provide the chief
92	92	25 procurement officer the information necessary to comply with
93	93	26 this Section on or before June 1, 2015. The requirement for
