1111 1 AN ACT concerning finance.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Illinois Procurement Code is amended by
1515 5 changing Section 25-65 as follows:
1616 6 (30 ILCS 500/25-65)
1717 7 Sec. 25-65. Contracts performed outside the United States.
1818 8 Prior to contracting or as a requirement of solicitation of
1919 9 any State contracts for services as defined in Section
2020 10 1-15.90, whichever is appropriate, potential contractors shall
2121 11 disclose in a statement of work where services will be
2222 12 performed under that contract, including any subcontracts, and
2323 13 whether any services under that contract, including any
2424 14 subcontracts, are anticipated to be performed outside the
2525 15 United States.
2626 16 In awarding the contract or evaluating the bid or offer,
2727 17 the chief procurement officer shall may consider such
2828 18 disclosure and the economic impact to the State of Illinois
2929 19 and its residents.
3030 20 The chief procurement officer may not award a contract to
3131 21 a vendor if more than 10% of the services contracted, based on
3232 22 the cost of services, are to be performed outside of the United

6868 1 If the chief procurement officer awards a contract to a
6969 2 vendor based upon disclosure that work will be performed in
7070 3 the United States and during the term of the contract the
7171 4 contractor or a subcontractor proceeds to shift work outside
7272 5 of the United States, the contractor shall be deemed in breach
7373 6 of contract, unless the chief procurement officer shall have
7474 7 first determined in writing that circumstances require the
7575 8 shift of work or that termination of the contract would not be
7676 9 in the State's best interest.
7777 10 Nothing in this Section is intended to contravene any
7878 11 existing treaty, law, agreement, or regulation of the United
7979 12 States.
8080 13 The chief procurement officer appointed pursuant to
8181 14 paragraph (4) of subsection (a) of Section 10-20 shall prepare
8282 15 and deliver to the General Assembly, no later than September
8383 16 1, 2015, a report on the impact of outsourcing services for
8484 17 State agencies subject to the jurisdiction of the chief
8585 18 procurement officer. The report shall include the State's cost
8686 19 of procurement and shall identify those contracts where it was
8787 20 disclosed that services were provided outside of the United
8888 21 States, including a description and value of those services.
8989 22 Each State agency subject to the jurisdiction of the chief
9090 23 procurement officer appointed pursuant to paragraph (4) of
9191 24 subsection (a) of Section 10-20 must provide the chief
9292 25 procurement officer the information necessary to comply with
9393 26 this Section on or before June 1, 2015. The requirement for
