11	11	1 AN ACT concerning local government.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 5. The River Edge Redevelopment Zone Act is
15	15	5 amended by changing Section 10-5.3 as follows:
16	16	6 (65 ILCS 115/10-5.3)
17	17	7 Sec. 10-5.3. Certification of River Edge Redevelopment
18	18	8 Zones.
19	19	9 (a) Approval of designated River Edge Redevelopment Zones
20	20	10 shall be made by the Department by certification of the
21	21	11 designating ordinance. The Department shall promptly issue a
22	22	12 certificate for each zone upon its approval. The certificate
23	23	13 shall be signed by the Director of the Department, shall make
24	24	14 specific reference to the designating ordinance, which shall
25	25	15 be attached thereto, and shall be filed in the office of the
26	26	16 Secretary of State. A certified copy of the River Edge
27	27	17 Redevelopment Zone Certificate, or a duplicate original
28	28	18 thereof, shall be recorded in the office of the recorder of
29	29	19 deeds of the county in which the River Edge Redevelopment Zone
30	30	20 lies.
31	31	21 (b) A River Edge Redevelopment Zone shall be effective
32	32	22 upon its certification. The Department shall transmit a copy
33	33	23 of the certification to the Department of Revenue, and to the

68	68	1 designating municipality. Upon certification of a River Edge
69	69	2 Redevelopment Zone, the terms and provisions of the
70	70	3 designating ordinance shall be in effect, and may not be
71	71	4 amended or repealed except in accordance with Section 10-5.4.
72	72	5 (c) A River Edge Redevelopment Zone shall be in effect for
73	73	6 the period stated in the certificate, which shall in no event
74	74	7 exceed 30 calendar years. Zones shall terminate at midnight of
75	75	8 December 31 of the final calendar year of the certified term,
76	76	9 except as provided in Section 10-5.4.
77	77	10 (d) In calendar years 2006 and 2007, the Department may
78	78	11 certify one pilot River Edge Redevelopment Zone in the City of
79	79	12 East St. Louis, one pilot River Edge Redevelopment Zone in the
80	80	13 City of Rockford, and one pilot River Edge Redevelopment Zone
81	81	14 in the City of Aurora.
82	82	15 In calendar year 2009, the Department may certify one
83	83	16 pilot River Edge Redevelopment Zone in the City of Elgin.
84	84	17 On or after the effective date of this amendatory Act of
85	85	18 the 97th General Assembly, the Department may certify one
86	86	19 additional pilot River Edge Redevelopment Zone in the City of
87	87	20 Peoria.
88	88	21 On or after the effective date of this amendatory Act of
89	89	22 the 103rd General Assembly, the Department may certify 2
90	90	23 additional pilot River Edge Redevelopment Zones, including one
91	91	24 in the City of Joliet and one in the City of Kankakee.
92	92	25 On or after the effective date of this amendatory Act of
93	93	26 the 103rd General Assembly, the Department may certify 7

105	105	2 in the City of East Moline, one in the City of Moline, one in
106	106	3 the City of Ottawa, one in the City of LaSalle, one in the City
107	107	4 of Peru, one in the City of Rock Island, and one in the City of
108	108	5 Quincy.
109	109	6 On or after the effective date of this amendatory Act of
110	110	7 the 104th General Assembly, the Department may certify one
111	111	8 additional pilot River Edge Redevelopment Zone in the City of
112	112	9 Sterling.
113	113	10 After certifying the additional pilot River Edge
114	114	11 Redevelopment Zones authorized by the above paragraphs, the
115	115	12 Department may not certify any additional River Edge
116	116	13 Redevelopment Zones, but it may amend and rescind
117	117	14 certifications of existing River Edge Redevelopment Zones in
118	118	15 accordance with Section 10-5.4, except that no River Edge
119	119	16 Redevelopment Zone may be extended on or after the effective
120	120	17 date of this amendatory Act of the 97th General Assembly. Each
121	121	18 River Edge Redevelopment Zone in existence on the effective
122	122	19 date of this amendatory Act of the 97th General Assembly shall
123	123	20 continue until its scheduled termination under this Act,
124	124	21 unless the Zone is decertified sooner. At the time of its term
125	125	22 expiration each River Edge Redevelopment Zone will become an
126	126	23 open enterprise zone, available for the previously designated
127	127	24 area or a different area to compete for designation as an
128	128	25 enterprise zone. No preference for designation as a Zone will
129	129	26 be given to the previously designated area.
