11 104TH GENERAL ASSEMBLY State of Illinois 2025 and 2026 SB1335 Introduced 1/28/2025, by Sen. Dale Fowler SYNOPSIS AS INTRODUCED: 430 ILCS 65/5 from Ch. 38, par. 83-5 Amends the Firearm Owners Identification Card Act. Provides that if the Illinois State Police fails to renew a Firearm Owner's Identification Card within 60 business days, provided the applicant submitted his or her renewal application prior to the expiration of his or her Firearm Owner's Identification Card, the renewal application for the Firearm Owner's Identification Card shall be granted unless subject to revocation or suspension. Provides that failure of the Illinois State Police to approve or deny an application or renew an application within the time frames under these provisions shall constitute a civil violation, and in addition to any other penalty provided by law, may incur a civil penalty in an amount not to exceed $500 for each violation and, in the case of a continuing violation, every day such violation continues shall be deemed a separate violation. Provides that penalties shall be collected by the State Treasurer, who shall deposit the money into the General Revenue Fund. 1111 1 AN ACT concerning safety.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Firearm Owners Identification Card Act is
1515 5 amended by changing Section 5 as follows:

1717 7 Sec. 5. Application and renewal.
1818 8 (a) The Illinois State Police shall either approve or deny
1919 9 all applications within 30 days from the date they are
2020 10 received, except as provided in subsections (b) and (c), and
2121 11 every applicant found qualified under Section 8 of this Act by
2222 12 the Illinois State Police shall be entitled to a Firearm
2323 13 Owner's Identification Card upon the payment of a $10 fee and
2424 14 applicable processing fees. The processing fees shall be
2525 15 limited to charges by the State Treasurer for using the
2626 16 electronic online payment system. Any applicant who is an
2727 17 active duty member of the Armed Forces of the United States, a
2828 18 member of the Illinois National Guard, or a member of the
2929 19 Reserve Forces of the United States is exempt from the
3030 20 application fee. $5 of each fee derived from the issuance of a
3131 21 Firearm Owner's Identification Card or renewals thereof shall
3232 22 be deposited in the State Police Firearm Services Fund and $5
3333 23 into the State Police Firearm Enforcement Fund.

6868 1 (b) Renewal applications shall be approved or denied
6969 2 within 60 business days, provided the applicant submitted his
7070 3 or her renewal application prior to the expiration of his or
7171 4 her Firearm Owner's Identification Card. If a renewal
7272 5 application has been submitted prior to the expiration date of
7373 6 the applicant's Firearm Owner's Identification Card, the
7474 7 Firearm Owner's Identification Card shall remain valid while
7575 8 the Illinois State Police processes the application, unless
7676 9 the person is subject to or becomes subject to revocation
7777 10 under this Act. The cost for a renewal application shall be $10
7878 11 and may include applicable processing fees, which shall be
7979 12 limited to charges by the State Treasurer for using the
8080 13 electronic online payment system, which shall be deposited
8181 14 into the State Police Firearm Services Fund. If the Illinois
8282 15 State Police fails to renew a Firearm Owner's Identification
8383 16 Card within 60 business days, provided the applicant submitted
8484 17 his or her renewal application prior to the expiration of his
8585 18 or her Firearm Owner's Identification Card, the renewal
8686 19 application for the Firearm Owner's Identification Card shall
8787 20 be granted unless subject to revocation or suspension.
8888 21 (c) If the Firearm Owner's Identification Card of a
8989 22 licensee under the Firearm Concealed Carry Act expires during
9090 23 the term of the licensee's concealed carry license, the
9191 24 Firearm Owner's Identification Card and the license remain
9292 25 valid and the licensee does not have to renew his or her
9393 26 Firearm Owner's Identification Card during the duration of the
