1111 1 AN ACT concerning State government.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Illinois Procurement Code is amended by
1515 5 adding Section 45-59 as follows:
1616 6 (30 ILCS 500/45-59 new)
1717 7 Sec. 45-59. Veteran-owned small business set-asides.
1818 8 (a) It is the public policy of this State to promote and
1919 9 encourage the continued economic development of small
2020 10 businesses owned by qualified veterans and for these
2121 11 veteran-owned small businesses to participate in the State's
2222 12 procurement process as prime contractors. Set-aside contracts
2323 13 will promote the certification of qualified veteran-owned
2424 14 small businesses by the Commission on Equity and Inclusion and
2525 15 promote contract awards to those businesses by State agencies.
2626 16 (b) As used in this Section:
2727 17 "Veteran-owned small business" means either a qualified
2828 18 service-disabled veteran-owned small business or a qualified
2929 19 veteran-owned small business, as defined in subsection (e) of
3030 20 Section 45-57 of this Code.
3131 21 (c) Each chief chief procurement officer has the authority
3232 22 to designate as a veteran-owned small business set-aside a
3333 23 fair proportion of construction, supply, and service contracts

6868 1 for award to veteran-owned small businesses in Illinois.
6969 2 Advertisements for bids or offers for these contracts shall
7070 3 specify designation as a veteran-owned small business
7171 4 set-aside. In awarding the contracts, only bids or offers from
7272 5 qualified veteran-owned small businesses shall be considered.
7373 6 A veteran small business set-aside designation may be
7474 7 withdrawn by the purchasing agency when deemed in the best
7575 8 interests of the State. Upon withdrawal, all bids or offers
7676 9 with respect to the contract shall be rejected, and the
7777 10 bidders or offerors shall be notified of the reason for
7878 11 rejection. The contract shall then be awarded in accordance
7979 12 with this Code without the designation of veteran small
8080 13 business set-aside.
8181 14 Each chief procurement officer may adopt rules to
8282 15 implement and administer the use of veteran-owned small
8383 16 business set-asides.
8484 17 (d) By November 1 of each year, each chief procurement
8585 18 officer shall report to the General Assembly on all the
8686 19 following for the immediately preceding fiscal year:
8787 20 (1) the total number of veteran-owned small businesses
8888 21 that submitted bids or offers for set-aside contracts
8989 22 under this Section;
9090 23 (2) the total number of set-aside contracts awarded to
9191 24 veteran-owned small businesses under this Section; and
9292 25 (3) the total value of set-aside contracts awarded to
9393 26 veteran-owned small businesses under this Section.
