317 1 AN ACT concerning regulation.
418 2 Be it enacted by the People of the State of Illinois,
519 3 represented in the General Assembly:
6-4 Section 5. The Illinois Dental Practice Act is amended by
7-5 changing Sections 4, 17, 18, and 18.1 and by adding Sections
8-6 13.2 and 13.4 as follows:

10-8 (Section scheduled to be repealed on January 1, 2026)
11-9 Sec. 4. Definitions. As used in this Act:
12-10 "Address of record" means the designated address recorded
13-11 by the Department in the applicant's or licensee's application
14-12 file or license file as maintained by the Department's
15-13 licensure maintenance unit. It is the duty of the applicant or
16-14 licensee to inform the Department of any change of address and
17-15 those changes must be made either through the Department's
18-16 website or by contacting the Department.
19-17 "Department" means the Department of Financial and
20-18 Professional Regulation.
21-19 "Secretary" means the Secretary of Financial and
22-20 Professional Regulation.
23-21 "Board" means the Board of Dentistry.
24-22 "Dentist" means a person who has received a general
25-23 license pursuant to subsection paragraph (a) of Section 11 of
20+4 Section 5. The Regulatory Sunset Act is amended by
21+5 changing Section 4.36 and by adding Section 4.46 as follows:

23+7 Sec. 4.36. Acts repealed on January 1, 2026. The following

34119 1 this Act and who may perform any intraoral and extraoral
35120 2 procedure required in the practice of dentistry and to whom is
36121 3 reserved the responsibilities specified in Section 17.
37122 4 "Dental hygienist" means a person who holds a license
38123 5 under this Act to perform dental services as authorized by
39124 6 Section 18.
40125 7 "Dental assistant" means an appropriately trained person
41126 8 who, under the supervision of a dentist, provides dental
42127 9 services as authorized by Section 17.
43128 10 "Expanded function dental assistant" means a dental
44129 11 assistant who has completed the training required by Section
45130 12 17.1 of this Act.
46131 13 "Dental laboratory" means a person, firm, or corporation
47132 14 which:
48133 15 (i) engages in making, providing, repairing, or
49134 16 altering dental prosthetic appliances and other artificial
50135 17 materials and devices which are returned to a dentist for
51136 18 insertion into the human oral cavity or which come in
52137 19 contact with its adjacent structures and tissues; and
53138 20 (ii) utilizes or employs a dental technician to
54139 21 provide such services; and
55140 22 (iii) performs such functions only for a dentist or
56141 23 dentists.
57142 24 "Supervision" means supervision of a dental hygienist or a
58143 25 dental assistant requiring that a dentist authorize the

74159 5 "General supervision" means supervision of a dental
75160 6 hygienist requiring that the patient be a patient of record,
76161 7 that the dentist examine the patient in accordance with
77162 8 Section 18 prior to treatment by the dental hygienist, and
78163 9 that the dentist authorize the procedures which are being
79164 10 carried out by a notation in the patient's record, but not
80165 11 requiring that a dentist be present when the authorized
81166 12 procedures are being performed. The issuance of a prescription
82167 13 to a dental laboratory by a dentist does not constitute
83168 14 general supervision.
84169 15 "Public member" means a person who is not a health
85170 16 professional. For purposes of board membership, any person
86171 17 with a significant financial interest in a health service or
87172 18 profession is not a public member.
88173 19 "Dentistry" means the healing art which is concerned with
89174 20 the examination, diagnosis, treatment planning, and care of
90175 21 conditions within the human oral cavity and its adjacent
91176 22 tissues and structures, as further specified in Section 17.
92177 23 "Branches of dentistry" means the various specialties of
93178 24 dentistry which, for purposes of this Act, shall be limited to
94179 25 the following: endodontics, oral and maxillofacial surgery,

112197 7 "Dental technician" means a person who owns, operates, or
113198 8 is employed by a dental laboratory and engages in making,
114199 9 providing, repairing, or altering dental prosthetic appliances
115200 10 and other artificial materials and devices which are returned
116201 11 to a dentist for insertion into the human oral cavity or which
117202 12 come in contact with its adjacent structures and tissues.
118203 13 "Informed consent" means legally valid consent that is
119204 14 given by a patient or legal guardian, that is recorded in
120205 15 writing or digitally, that authorizes intervention or
121206 16 treatment services from the treating dentist, and that
122207 17 documents agreement to participate in those services and
123208 18 knowledge of the risks, benefits, and alternatives, including
124209 19 the decision to withdraw from or decline treatment.
125210 20 "Impaired dentist" or "impaired dental hygienist" means a
126211 21 dentist or dental hygienist who is unable to practice with
127212 22 reasonable skill and safety because of a physical or mental
128213 23 disability as evidenced by a written determination or written
129214 24 consent based on clinical evidence, including deterioration
130215 25 through the aging process, loss of motor skills, abuse of

154239 13 "Dental responder" means a dentist or dental hygienist who
155240 14 is appropriately certified in disaster preparedness,
156241 15 immunizations, and dental humanitarian medical response
157242 16 consistent with the Society of Disaster Medicine and Public
158243 17 Health and training certified by the National Incident
159244 18 Management System or the National Disaster Life Support
160245 19 Foundation.
161246 20 "Mobile dental van or portable dental unit" means any
162247 21 self-contained or portable dental unit in which dentistry is
163248 22 practiced that can be moved, towed, or transported from one
164249 23 location to another in order to establish a location where
165250 24 dental services can be provided.
166251 25 "Public health dental hygienist" means a hygienist who
167252 26 holds a valid license to practice in the State, has 2 years of

190275 13 written public health supervision agreement with that public
191276 14 health dental hygienist while working in an approved facility
192277 15 or program that allows the public health dental hygienist to
193278 16 treat patients, without a dentist first examining the patient
194279 17 and being present in the facility during treatment, (1) who
195280 18 are eligible for Medicaid or (2) who are uninsured or whose
196281 19 household income is not greater than 300% of the federal
197282 20 poverty level.
198283 21 "Teledentistry" means the use of telehealth systems and
199284 22 methodologies in dentistry and includes patient diagnosis,
200285 23 treatment planning, care, and education delivery for a patient
201286 24 of record using synchronous and asynchronous communications
202287 25 under an Illinois licensed dentist's authority as provided

218303 5 maintain a patient's airway and spontaneous ventilation is
219304 6 adequate; and (3) cardiovascular function is usually
220305 7 maintained.
221306 8 "Deep sedation" means a drug-induced depression of
222307 9 consciousness during which: (1) patients cannot be easily
223308 10 aroused, but respond purposefully following repeated or
224309 11 painful stimulation; (2) the ability to independently maintain
225310 12 ventilatory function may be impaired; (3) patients may require
226311 13 assistance in maintaining airways and spontaneous ventilation
227312 14 may be inadequate; and (4) cardiovascular function is usually
228313 15 maintained.
229314 16 "General anesthesia" means a drug-induced loss of
230315 17 consciousness during which: (1) patients are not arousable,
231316 18 even by painful stimulation; (2) the ability to independently
232317 19 maintain ventilatory function is often impaired; (3) patients
233318 20 often require assistance in maintaining airways and positive
234319 21 pressure ventilation may be required because of depressed
235320 22 spontaneous ventilation or drug-induced depression of
236321 23 neuromuscular function; and (4) cardiovascular function may be
237322 24 impaired.
238323 25 "Venipuncture" means the puncture of a vein as part of a
239324 26 medical procedure, typically to withdraw a blood sample or for

265-16 (a) An applicant for licensure as general dentist under

297-13 (3) a request by the Department that the applicant

376+7 Board Examination;
377+8 (4) a letter of good standing from the dental school
378+9 in which the student is enrolled; and
379+10 (5) documentation of either a current Basic Life
380+11 Support certification or current certification in
381+12 cardiopulmonary resuscitation and automated external
382+13 defibrillator use.
383+14 (c) A licensee holding a temporary dental hygiene license
384+15 must practice under the supervision of a dentist.

451+11 for the purpose of assisting in the application of teeth
452+12 whitening materials. A person does not practice dentistry
453+13 when he or she discloses to the consumer that he or she is
454+14 not licensed as a dentist under this Act and (i) discusses
455+15 the use of teeth whitening materials with a consumer
456+16 purchasing these materials; (ii) provides instruction on
457+17 the use of teeth whitening materials with a consumer
458+18 purchasing these materials; or (iii) provides appropriate
459+19 equipment on-site to the consumer for the consumer to
460+20 self-apply teeth whitening materials.
461+21 The fact that any person engages in or performs, or offers
462+22 to engage in or perform, any of the practices, acts, or
463+23 operations set forth in this Section, shall be prima facie

594+10 made available to the Department upon request. A
595+11 dental assistant must have successfully completed an
596+12 approved coronal polishing and dental sealant course
597+13 prior to taking the amalgam and composite restoration
598+14 course.
599+15 A dentist utilizing dental assistants shall not
600+16 supervise more than 4 dental assistants at any one
601+17 time for placing, carving, and finishing of amalgam
602+18 restorations or for placing, packing, and finishing
603+19 composite restorations.
604+20 (3) Any and all correction of malformation of
605+21 teeth or of the jaws.
606+22 (4) Administration of anesthetics, except for
607+23 monitoring of nitrous oxide, moderate sedation, deep

877+6 under the general supervision of a dentist. A dental hygienist
878+7 may not provide other dental hygiene treatment in a
879+8 school-based setting, including but not limited to
880+9 administration or monitoring of nitrous oxide or
881+10 administration of local anesthetics. The school-based
882+11 procedures may be performed provided the patient is located at
883+12 a public or private school and the program is being conducted
884+13 by a State, county or local public health department
885+14 initiative or in conjunction with a dental school or dental
886+15 hygiene program. The dentist shall personally examine and
887+16 diagnose the patient and determine which services are
888+17 necessary to be performed, which shall be contained in an
889+18 order to the hygienist and a notation in the patient's record.
890+19 Any such order for sealants must be implemented within 120
891+20 days after its issuance. Any such order for oral prophylactic
892+21 procedures or fluoride treatments must be implemented within
893+22 180 days after its issuance. An updated medical history and

835-14 by the hygienist immediately prior to beginning the procedures
836-15 to ensure that the patient's health has not changed in any
837-16 manner to warrant a reexamination by the dentist.
838-17 (e) School-based oral health care, consisting of and
839-18 limited to oral prophylactic procedures, sealants, and
840-19 fluoride treatments, may be provided by a dental hygienist
841-20 under the general supervision of a dentist. A dental hygienist
842-21 may not provide other dental hygiene treatment in a
843-22 school-based setting, including but not limited to
844-23 administration or monitoring of nitrous oxide or
845-24 administration of local anesthetics. The school-based
