13	13	1 AN ACT concerning criminal law.
14	14	2 Be it enacted by the People of the State of Illinois,
15	15	3 represented in the General Assembly:
16	16	4 Section 5. The Illinois Controlled Substances Act is
17	17	5 amended by changing Sections 208 and 401 and by adding Section
18	18	6 309.1 as follows:

20	20	8 Sec. 208. (a) The controlled substances listed in this
21	21	9 Section are included in Schedule III.
22	22	10 (b) Unless specifically excepted or unless listed in

25	25	13 substances having a stimulant effect on the central nervous
26	26	14 system, including its salts, isomers (whether optical

263	263	11 Sec. 401. Manufacture or delivery, or possession with
264	264	12 intent to manufacture or deliver, a controlled substance, a
265	265	13 counterfeit substance, or controlled substance analog. Except
266	266	14 as authorized by this Act, it is unlawful for any person
267	267	15 knowingly to manufacture or deliver, or possess with intent to
268	268	16 manufacture or deliver, a controlled substance other than
269	269	17 methamphetamine and other than bath salts as defined in the
270	270	18 Bath Salts Prohibition Act sold or offered for sale in a retail
271	271	19 mercantile establishment as defined in Section 16-0.1 of the
272	272	20 Criminal Code of 2012, a counterfeit substance, or a
273	273	21 controlled substance analog. A violation of this Act with
274	274	22 respect to each of the controlled substances listed herein
275	275	23 constitutes a single and separate violation of this Act. For
276	276	24 purposes of this Section, "controlled substance analog" or
277	277	25 "analog" means a substance, other than a controlled substance,

289	289	2 Administration or, if approved, is not dispensed or possessed
290	290	3 in accordance with State or federal law, and that has a
291	291	4 chemical structure substantially similar to that of a
292	292	5 controlled substance in Schedule I or II, or that was
293	293	6 specifically designed to produce an effect substantially
294	294	7 similar to that of a controlled substance in Schedule I or II.
295	295	8 Examples of chemical classes in which controlled substance
296	296	9 analogs are found include, but are not limited to, the
297	297	10 following: phenethylamines, N-substituted piperidines,
298	298	11 morphinans, ecgonines, quinazolinones, substituted indoles,
299	299	12 and arylcycloalkylamines. For purposes of this Act, a
300	300	13 controlled substance analog shall be treated in the same
301	301	14 manner as the controlled substance to which it is
302	302	15 substantially similar.
303	303	16 (a) Any person who violates this Section with respect to
304	304	17 the following amounts of controlled or counterfeit substances
305	305	18 or controlled substance analogs, notwithstanding any of the
306	306	19 provisions of subsections (c), (d), (e), (f), (g) or (h) to the
307	307	20 contrary, is guilty of a Class X felony and shall be sentenced
308	308	21 to a term of imprisonment as provided in this subsection (a)
309	309	22 and fined as provided in subsection (b):
310	310	23 (1)(A) not less than 6 years and not more than 30 years
311	311	24 with respect to 15 grams or more but less than 100 grams of
312	312	25 a substance containing heroin, or an analog thereof;

549	549	10 (b) Any person sentenced with respect to violations of
550	550	11 paragraph (1), (2), (3), (7), or (7.5) of subsection (a)
551	551	12 involving 100 grams or more of the controlled substance named
552	552	13 therein, may in addition to the penalties provided therein, be
553	553	14 fined an amount not more than $500,000 or the full street value
554	554	15 of the controlled or counterfeit substance or controlled
555	555	16 substance analog, whichever is greater. The term "street
556	556	17 value" shall have the meaning ascribed in Section 110-5 of the
557	557	18 Code of Criminal Procedure of 1963. Any person sentenced with
558	558	19 respect to any other provision of subsection (a), may in
559	559	20 addition to the penalties provided therein, be fined an amount
560	560	21 not to exceed $500,000.
561	561	22 (b-1) Excluding violations of this Act when the controlled
562	562	23 substance is fentanyl, any person sentenced to a term of
563	563	24 imprisonment with respect to violations of Section 401, 401.1,
564	564	25 405, 405.1, 405.2, or 407, when the substance containing the
565	565	26 controlled substance contains any amount of fentanyl, 3 years

581	581	6 or controlled substance analogs, notwithstanding any of the
582	582	7 provisions of subsections (a), (b), (d), (e), (f), (g) or (h)
583	583	8 to the contrary, is guilty of a Class 1 felony. The fine for
584	584	9 violation of this subsection (c) shall not be more than
