1515 1 AN ACT concerning State government.
1616 2 Be it enacted by the People of the State of Illinois,
1717 3 represented in the General Assembly:
1818 4 Section 5. The Department of Human Services Act is amended
1919 5 by adding Section 10-80 as follows:

2121 7 Sec. 10-80. Administration of the Illinois Developmental
2222 8 Disabilities Services Scratch-Off Fund. The Department of
2323 9 Human Services shall administer the Illinois Developmental
2424 10 Disabilities Services Scratch-off Fund. The Department shall
2525 11 pass all of the moneys deposited in the Fund as grants for
2626 12 services provided by the Independent Service Coordination
2727 13 agencies as defined in Section 10 of the Disabilities Services
2828 14 Act of 2003.
2929 15 Section 10. The Illinois Lottery Law is amended by
3030 16 changing Sections 9.3 and 20 and by adding Section 21.18 as

8181 4 proceeds of lottery tickets and shares sold in the following

8383 6 (1) The payment of prizes and retailer bonuses.
8484 7 (2) The payment of costs incurred in the operation and
8585 8 administration of the Lottery, including the payment of
8686 9 sums due to the private manager under the management
8787 10 agreement with the Department and including costs of
8888 11 administering the Lottery sports wagering program pursuant
8989 12 to Section 25-70 of the Sports Wagering Act.
9090 13 (3) On the last day of each month or as soon thereafter
9191 14 as possible, the State Comptroller shall direct and the
9292 15 State Treasurer shall transfer from the State Lottery Fund
9393 16 to the Common School Fund the Department's estimate of net
9494 17 lottery proceeds.
9595 18 (4) If an amount in excess of the annual net lottery
9696 19 proceeds is transferred for a fiscal year, then the
9797 20 Department shall offset the monthly transfers of estimated
9898 21 net lottery proceeds during the following fiscal year by
9999 22 that excess amount. If an amount less than the annual net

101101 24 after the related annual fiscal year audit is completed
102102 25 following such fiscal year, the Department shall direct

115115 2 paragraphs (1) and (2), into the Common School Fund as

117117 4 (b) The net lottery proceeds shall be determined by
118118 5 deducting from total annual lottery proceeds the expenditures
119119 6 required by paragraphs (1) and (2) of subsection (a). The
120120 7 total annual lottery proceeds and annual net lottery proceeds
121121 8 shall be determined according to generally accepted accounting
122122 9 principles for governmental entities and verified by an annual
123123 10 fiscal year audit.

126126 13 Sec. 20. State Lottery Fund.
127127 14 (a) There is created in the State Treasury a special fund
128128 15 to be known as the State Lottery Fund. Such fund shall consist
129129 16 of all revenues received from (1) the sale of lottery tickets
130130 17 or shares, (net of commissions, fees representing those
131131 18 expenses that are directly proportionate to the sale of
132132 19 tickets or shares at the agent location, and prizes of less
133133 20 than $600 which have been validly paid at the agent level), (2)
134134 21 application fees, and (3) all other sources including moneys
135135 22 credited or transferred thereto from any other fund or source
136136 23 pursuant to law. Interest earnings of the State Lottery Fund
137137 24 shall be credited to the Common School Fund.

188188 4 Sec. 21.18. Scratch-off for developmental disabilities
189189 5 services.
190190 6 (a) If a scratch-off game is discontinued pursuant to
191191 7 Section 21.4, then the Department shall offer a special
192192 8 instant scratch-off game for the benefit of the Illinois
193193 9 Developmental Disabilities Services Scratch-Off Fund for
194194 10 developmental disabilities services under the Independent
195195 11 Service Coordination agencies. The game shall commence as soon
196196 12 practical after the discontinuation, at the discretion of the
197197 13 Director, and shall operate for 5 years. The operation of the
198198 14 game shall be governed by this Law and any rules adopted by the
199199 15 Department.
200200 16 (b) The net revenue from the developmental disabilities
201201 17 services scratch-off game shall be deposited into the Illinois
202202 18 Developmental Disabilities Services Scratch-Off Fund. Moneys
203203 19 received for the purposes of this Section, including, without
204204 20 limitation, net revenue from the special instant scratch-off
205205 21 game and from gifts, grants, and awards from any public or
206206 22 private entity, must be deposited into the Fund. For the
207207 23 purposes of this subsection, "net revenue" means the total
208208 24 amount for which tickets have been sold less the sum of the
209209 25 amount paid out in the prizes and the actual administrative

220220 1 expenses of the Department solely related to the scratch-off
221221 2 game under this Section.
222222 3 (c) During the time that tickets are sold for the
223223 4 developmental disabilities research, support, education, and
224224 5 awareness scratch-off game, the Department shall not
225225 6 unreasonably diminish the efforts devoted to marketing any
226226 7 other instant scratch-off lottery game.
227227 8 (d) The Department may adopt any rules necessary to
228228 9 implement and administer the provisions of this Section.
229229 10 Section 15. The State Finance Act is amended by adding
230230 11 Section 5.1030 as follows:
