11	11	1 AN ACT concerning transportation.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 5. The Illinois Vehicle Code is amended by adding
15	15	5 Section 11-1433 as follows:
16	16	6 (625 ILCS 5/11-1433 new)
17	17	7 Sec. 11-1433. Third-party delivery service; zero-emission
18	18	8 deliveries.
19	19	9 (a) As used in this Section, "third-party delivery
20	20	10 service" has the meaning given to that term in the Fair Food
21	21	11 and Retail Delivery Act.
22	22	12 (b) Beginning on January 1, 2030, a third-party delivery
23	23	13 service shall not employ or contract with a person to deliver
24	24	14 goods from a store or restaurant unless the person making the
25	25	15 delivery uses a non-carbon emitting mode of transportation.
26	26	16 This subsection does not apply to a delivery that requires a
27	27	17 person to travel 15 miles or more to complete the delivery.
28	28	18 (c) A third-party delivery service that violates this
29	29	19 Section is subject to a business offense not to exceed $1,000.
30	30	20 (d) A home rule municipality may not regulate deliveries
31	31	21 pertaining to third-party delivery services in a manner
32	32	22 inconsistent with this Section. This Section is a limitation
33	33	23 under subsection (i) of Section 6 of Article VII of the
