Provides that, beginning on January 1, 2030, a third-party delivery service shall not employ or contract with a person to deliver goods from a store or restaurant unless the person making the delivery uses a non-carbon emitting mode of transportation. Provides that the provision does not apply to a delivery that requires a person to travel 15 miles or more to complete the delivery. Provides that a third-party delivery service that violates the provision is subject to a business offense not to exceed $1,000. Limits the concurrent exercise of home rule powers. 1111 1 AN ACT concerning transportation.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Illinois Vehicle Code is amended by adding
1515 5 Section 11-1433 as follows:
1616 6 (625 ILCS 5/11-1433 new)
1717 7 Sec. 11-1433. Third-party delivery service; zero-emission
1818 8 deliveries.
1919 9 (a) As used in this Section, "third-party delivery
2020 10 service" has the meaning given to that term in the Fair Food
2121 11 and Retail Delivery Act.
2222 12 (b) Beginning on January 1, 2030, a third-party delivery
2323 13 service shall not employ or contract with a person to deliver
2424 14 goods from a store or restaurant unless the person making the
2525 15 delivery uses a non-carbon emitting mode of transportation.
2626 16 This subsection does not apply to a delivery that requires a
2727 17 person to travel 15 miles or more to complete the delivery.
2828 18 (c) A third-party delivery service that violates this
2929 19 Section is subject to a business offense not to exceed $1,000.
3030 20 (d) A home rule municipality may not regulate deliveries
3131 21 pertaining to third-party delivery services in a manner
3232 22 inconsistent with this Section. This Section is a limitation
3333 23 under subsection (i) of Section 6 of Article VII of the
