---|
10 | 19 | | 8 (a) In this Code, unless the context otherwise requires: |
---|
11 | 20 | | 9 (1) "Accuser" means a person who signs and swears to |
---|
12 | 21 | | 10 charges, any person who directs that charges nominally be |
---|
13 | 22 | | 11 signed and sworn to by another, and any other person who |
---|
14 | 23 | | 12 has an interest other than an official interest in the |
---|
15 | 24 | | 13 prosecution of the accused. |
---|
16 | 25 | | 14 (2) "Cadet" or "candidate" means a person who is |
---|
17 | 26 | | 15 enrolled in or attending a State military academy, a |
---|
18 | 27 | | 16 regional training institute, or any other formal education |
---|
19 | 28 | | 17 program for the purpose of becoming a commissioned officer |
---|
20 | 29 | | 18 in the State military forces. |
---|
21 | 30 | | 19 (3) "Classified information" means: |
---|
22 | 31 | | 20 (A) any information or material that has been |
---|
23 | 32 | | 21 determined by an official of the United States or any |
---|
24 | 33 | | 22 state pursuant to law, an Executive order, or |
---|
25 | 34 | | 23 regulation to require protection against unauthorized |

43 | 80 | | 10 nonjudicial punishment under Article 15 of this Code. The |
---|
44 | 81 | | 11 term "commander" has the same meaning as "commanding |

45 | 82 | | 12 officer" unless the context otherwise requires. |

46 | 83 | | 13 (6) "Convening authority" includes, in addition to the |
---|
47 | 84 | | 14 person who convened the court, a commissioned officer |
---|
48 | 85 | | 15 commanding for the time being or a successor in command to |
---|
49 | 86 | | 16 the convening authority. |
---|
50 | 87 | | 17 (7) "Day" for all purposes means calendar day |
---|
51 | 88 | | 18 beginning at 0000 hours (12:00 a.m.) and ending at 2359 |
---|
52 | 89 | | 19 hours, 59 seconds (12:59, 59 seconds p.m.), and is not |
---|
53 | 90 | | 20 synonymous with the term "unit training assembly". Any |

85 | 122 | | 16 (B) certified as a non-federally recognized judge |
---|
86 | 123 | | 17 advocate, under regulations adopted pursuant to this |
---|
87 | 124 | | 18 paragraph, by the senior judge advocate of the |
---|
88 | 125 | | 19 commander of the force in the State military forces of |
---|
89 | 126 | | 20 which the accused is a member, as competent to perform |
---|
90 | 127 | | 21 such military justice duties required by this Code. If |

91 | 128 | | 22 there is no such judge advocate available, then such |

92 | 129 | | 23 certification may be made by such senior judge |
