11	11	1 AN ACT concerning local government.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 5. The Public Officer Prohibited Activities Act is
15	15	5 amended by changing Section 1 as follows:
16	16	6 (50 ILCS 105/1) (from Ch. 102, par. 1)
17	17	7 Sec. 1. County board. No member of a county board, during
18	18	8 the term of office for which he or she is elected, may be
19	19	9 appointed to, accept, or hold any office other than (i)
20	20	10 chairman of the county board or member of the regional
21	21	11 planning commission by appointment or election of the board of
22	22	12 which he or she is a member, (ii) alderperson of a city or
23	23	13 member of the board of trustees of a village or incorporated
24	24	14 town if the city, village, or incorporated town has fewer than
25	25	15 1,000 inhabitants and is located in a county having fewer than
26	26	16 50,000 inhabitants, or (iii) trustee of a forest preserve
27	27	17 district created under Section 18.5 of the Conservation
28	28	18 District Act, unless he or she first resigns from the office of
29	29	19 county board member or unless the holding of another office is
30	30	20 authorized by law. Any such prohibited appointment or election
31	31	21 is void. This Section shall not preclude a member of the county
32	32	22 board from being appointed or selected to serve as (i) a member
33	33	23 of a County Extension Board as provided in Section 7 of the

68	68	1 County Cooperative Extension Law, (ii) a member of an
69	69	2 Emergency Telephone System Board as provided in Section 15.4
70	70	3 of the Emergency Telephone System Act, (iii) a member of the
71	71	4 board of review as provided in Section 6-30 of the Property Tax
72	72	5 Code, or (iv) a public administrator or public guardian as
73	73	6 provided in Section 13-1 of the Probate Act of 1975, or (v) a
74	74	7 member of an intergovernmental joint self-insurance pool board
75	75	8 as provided in Section 6 of the Intergovernmental Cooperation
76	76	9 Act. Nothing in this Act shall be construed to prohibit an
77	77	10 elected county official from holding elected office in another
78	78	11 unit of local government so long as there is no contractual
79	79	12 relationship between the county and the other unit of local
80	80	13 government. This amendatory Act of 1995 is declarative of
81	81	14 existing law and is not a new enactment.
