1111 1 AN ACT concerning regulation.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Liquor Control Act of 1934 is amended by
1515 5 changing Sections 8-1, 8-2, 8-3, 8-4, 8-5, 8-6, 8-7, 8-9,
1616 6 8-10, 8-11, 8-12, and 8-14 and by adding Article XIII as

1919 9 Sec. 8-1. A tax is imposed upon the privilege of engaging
2020 10 in business as a manufacturer or as an importing distributor
2121 11 of alcoholic liquor other than beer at the rate of $0.185 per
2222 12 gallon until September 1, 2009 and $0.231 per gallon beginning
2323 13 September 1, 2009 for cider containing not less than 0.5%
2424 14 alcohol by volume nor more than 7% alcohol by volume, $0.73 per
2525 15 gallon until September 1, 2009 and $1.39 per gallon beginning
2626 16 September 1, 2009 for wine other than cider containing less

6868 1 distributor of beer at the rate of $0.185 per gallon until
6969 2 September 1, 2009 and $0.231 per gallon beginning September 1,

7979 12 A tax is imposed upon the privilege of engaging in
8080 13 business as a hemp beverage manufacturer or as a hemp beverage
8181 14 importing distributor at the rate of $8.55 for each gallon
8282 15 containing 80 mg of THC or less and not less than 70 mg of THC,
8383 16 $7.48 for each gallon containing less than 70 mg of THC and not
8484 17 less than 60 mg of THC, $6.41 for each gallon containing less
8585 18 than 60 mg of THC and not less than 50 mg of THC, $5.34 for
8686 19 each gallon containing less than 50 mg of THC and not less than
8787 20 40 mg of THC, $4.27 for each gallon containing less than 40 mg
8888 21 of THC, manufactured by a hemp manufacturer and sold or used by
8989 22 such hemp manufacturer, or as agent for any other person, or
9090 23 sold or used by such importing hemp distributor, or as agent
9191 24 for any other person.
9292 25 For purposes of this Section, "beer" means beer, ale,

104104 1 name or description containing one-half of one percent or more
105105 2 of alcohol by volume, brewed or produced from malt, wholly or

107107 4 For the purpose of this Section, "cider" means any
108108 5 alcoholic beverage obtained by the alcohol fermentation of the

111111 8 The credit or refund created by this Act shall apply to all
112112 9 beer taxes in the calendar years 1982 through 1986.
113113 10 The increases made by this amendatory Act of the 91st
114114 11 General Assembly in the rates of taxes imposed under this
115115 12 Section shall apply beginning on July 1, 1999.
116116 13 A tax at the rate of 1 per gallon on beer and 48 per
117117 14 gallon on hemp beverages, alcohol, and spirits is also imposed
118118 15 upon the privilege of engaging in business as a retailer or
119119 16 hemp beverage retailer or as a distributor or hemp beverage
120120 17 distributor who is not also an importing distributor or hemp
121121 18 beverage importing distributor with respect to all beer, and
122122 19 all alcohol, and spirits, and hemp beverages owned or
123123 20 possessed by such retailer, hemp beverage retailer, or
124124 21 distributor, or hemp beverage distributor when this amendatory
125125 22 Act of 1969, or any amendatory Act applicable to hemp
126126 23 beverages, becomes effective, and with respect to which the
127127 24 additional tax imposed by this amendatory Act upon

142142 3 to the additional tax imposed by this paragraph of this
143143 4 Section shall be required to inventory such alcoholic liquor
144144 5 or hemp beverage and to pay this additional tax in a manner
145145 6 prescribed by the Department.
146146 7 The provisions of this Section shall be construed to apply
147147 8 to any importing distributor or importing hemp distributor
148148 9 engaging in business in this State, whether licensed or not.
149149 10 However, such tax is not imposed upon any such business as
150150 11 to any alcoholic liquor or hemp beverage shipped outside
151151 12 Illinois by an Illinois licensed manufacturer, hemp beverage
152152 13 manufacturer, or importing distributor, or hemp beverage
153153 14 importing distributor, nor as to any alcoholic liquor or hemp
154154 15 beverage delivered in Illinois by an Illinois licensed
155155 16 manufacturer, hemp beverage manufacturer, or importing
156156 17 distributor, or hemp beverage distributor to a purchaser for
157157 18 immediate transportation by the purchaser to another state
158158 19 into which the purchaser has a legal right, under the laws of

193193 18 Or for scientific, chemical, experimental or mechanical
194194 19 purposes;
195195 20 Nor is the tax imposed upon the privilege of engaging in
196196 21 any business in interstate commerce or otherwise, which
197197 22 business may not, under the Constitution and Statutes of the
198198 23 United States, be made the subject of taxation by this State.
199199 24 The tax herein imposed shall be in addition to all other
200200 25 occupation or privilege taxes imposed by the State of Illinois
201201 26 or political subdivision thereof.

212212 1 If any alcoholic liquor or hemp beverage alcoholic liquor

223223 12 shall be reduced by the amount of the taxes which have been
224224 13 paid by the selling manufacturer, hemp beverage manufacturer,
225225 14 importing distributor, or hemp beverage importing distributor
226226 15 manufacturer or importing distributor under this Act as to
227227 16 such alcoholic liquor or hemp beverage so used to the
228228 17 Department of Revenue.
229229 18 If any person received any alcoholic liquors or hemp
230230 19 beverages from a manufacturer, hemp beverage manufacturer,
231231 20 importing distributor, or hemp beverage importing distributor
232232 21 manufacturer or importing distributor, with respect to which
233233 22 alcoholic liquors or hemp beverages no tax is imposed under
234234 23 this Article, and such alcoholic liquor or hemp beverage shall
235235 24 thereafter be disposed of in such manner or under such
236236 25 circumstances as may cause the same to become the base for the
237237 26 tax imposed by this Article, such person shall make the same

249249 2 other provisions of this Article relating to manufacturers and

251251 4 Nothing in this Article shall be construed to require the
252252 5 payment to the Department of the taxes imposed by this Article
253253 6 more than once with respect to any quantity of alcoholic
254254 7 liquor or hemp beverage sold or used within this State.
255255 8 No tax is imposed by this Act on sales of alcoholic liquor
256256 9 or hemp beverage by Illinois licensed foreign importers to

258258 11 All of the proceeds of the additional tax imposed by
259259 12 Public Act 96-34 shall be deposited by the Department into the
260260 13 Capital Projects Fund. The remainder of the tax imposed by
261261 14 this Act shall be deposited by the Department into the General
262262 15 Revenue Fund.
263263 16 A manufacturer of beer that imports or transfers beer into
264264 17 this State must comply with the provisions of this Section
265265 18 with regard to the beer imported into this State.
266266 19 The provisions of this Section 8-1 are severable under
267267 20 Section 1.31 of the Statute on Statutes.

283283 1 tax-free by such manufacturer from another manufacturer, hemp
284284 2 beverage manufacturer, importing distributor, or hemp beverage
285285 3 importing distributor manufacturer or importing distributor,
286286 4 and of each importing distributor as to alcoholic liquor or
287287 5 hemp beverage purchased by such importing distributor from
288288 6 foreign importers or from anyone from any point in the United

299299 17 Each manufacturer and each importing distributor shall
300300 18 make payment under one of the following methods: (1) on or
301301 19 before the 15th day of each calendar month, file in person or
302302 20 by United States first-class mail, postage pre-paid, with the
303303 21 Department of Revenue, on forms prescribed and furnished by
304304 22 the Department, a report in writing in such form as may be
305305 23 required by the Department in order to compute, and assure the
306306 24 accuracy of, the tax due on all taxable sales and uses of
307307 25 alcoholic liquor or hemp beverage occurring during the

319319 1 the report shall accompany the report or, (2) on or before the
320320 2 15th day of each calendar month, electronically file with the
321321 3 Department of Revenue, on forms prescribed and furnished by
322322 4 the Department, an electronic report in such form as may be

324324 6 accuracy of, the tax due on all taxable sales and uses of

331331 13 calendar month following the calendar month in which such
332332 14 alcoholic liquor or hemp beverage is sold or used by that
333333 15 manufacturer, hemp beverage manufacturer, importing
334334 16 distributor, or hemp beverage importing distributor
335335 17 manufacturer or importing distributor other than in an
336336 18 authorized tax-free manner shall pay to the Department the
337337 19 amount of the tax imposed pursuant to Section 8-1, less a
338338 20 discount which is allowed to reimburse the manufacturer, hemp
339339 21 beverage manufacturer, importing distributor, or hemp beverage
340340 22 importing distributor manufacturer or importing distributor
341341 23 for the expenses incurred in keeping and maintaining records,
342342 24 preparing and filing the electronic returns, remitting the
343343 25 tax, and supplying data to the Department upon request.

358358 4 (2) For original returns due on or after October 1,
359359 5 2003 through September 30, 2004, the discount shall be 2%

363363 9 whichever is less.
364364 10 The Department may, if it deems it necessary in order to
365365 11 insure the payment of the tax imposed by this Article, require
366366 12 returns to be made more frequently than and covering periods
367367 13 of less than a month. Such return shall contain such further
368368 14 information as the Department may reasonably require.
369369 15 It shall be presumed that all alcoholic liquors or hemp
370370 16 beverages acquired or made by any hemp beverage importing
371371 17 distributor, importing distributor, hemp beverage
372372 18 manufacturer, or manufacturer importing distributor or
373373 19 manufacturer have been sold or used by him in this State and
374374 20 are the basis for the tax imposed by this Article unless
375375 21 proven, to the satisfaction of the Department, that such
376376 22 alcoholic liquors or hemp beverages are (1) still in the
377377 23 possession of such importing distributor or manufacturer, or
378378 24 (2) prior to the termination of possession have been lost by
379379 25 theft or through unintentional destruction, or (3) that such

396396 6 this Act, as shown on an original report, the manufacturer,

399399 9 distributor may credit such excess payment against liability
400400 10 subsequently to be remitted to the Department under this Act,
401401 11 in accordance with reasonable rules adopted by the Department.
402402 12 If the Department subsequently determines that all or any part
403403 13 of the credit taken was not actually due to the manufacturer,
404404 14 hemp beverage manufacturer, importing distributor, or hemp
405405 15 beverage importing distributor manufacturer or importing
406406 16 distributor, the manufacturer's, hemp beverage manufacturer's,
407407 17 importing distributor's, or hemp beverage importing
408408 18 distributor's manufacturer's or importing distributor's
409409 19 discount shall be reduced by an amount equal to the difference
410410 20 between the discount as applied to the credit taken and that
411411 21 actually due, and the manufacturer, hemp beverage
412412 22 manufacturer, importing distributor, or hemp beverage
413413 23 importing distributor manufacturer or importing distributor
414414 24 shall be liable for penalties and interest on such difference.
415415 25 The Department may require any foreign importer to file
416416 26 monthly information returns, by the 15th day of the month

432432 6 Every entity licensed or registered as a manufacturer,

437437 11 distributor that in the preceding year had less than $50,000
438438 12 of tax liability under this Article, shall also file, with the
439439 13 Department, a bond in an amount not less than $1,000 and not to
440440 14 exceed $100,000 on a form to be approved by, and with a surety
441441 15 or sureties satisfactory to, the Department. The Department
442442 16 shall not require more than one bond in the event an entity is
443443 17 licensed under this Act and registered under Article XIII.
444444 18 Such bond shall be conditioned upon the manufacturer, hemp
445445 19 beverage manufacturer, importing distributor, or hemp beverage
446446 20 importing distributor manufacturer or importing distributor
447447 21 paying to the Department all moneys monies becoming due from
448448 22 such manufacturer, hemp beverage manufacturer, importing
449449 23 distributor, or hemp beverage importing distributor
450450 24 manufacturer or importing distributor under this Article. The
451451 25 Department shall fix the penalty of such bond in each case,

517517 19 fails to pay any amount due under this Article, his bond with
518518 20 the Department shall be deemed forfeited, and the Department
519519 21 may institute a suit in its own name on such bond.

521521 23 Commission may revoke or suspend the license of any
522522 24 manufacturer or importing distributor and the Hemp Beverage

554554 20 the Department, continuously complied with the conditions of
555555 21 the bond under this Act for a period of 2 years shall be
556556 22 considered to be a prior continuous compliance taxpayer. In
557557 23 determining the consecutive period of time for qualification
558558 24 as a prior continuous compliance taxpayer, any consecutive
559559 25 period of time of qualifying compliance immediately prior to

588588 18 Act. Any taxpayer who fails to pay an admitted or established
589589 19 liability under this Act may also be required to post bond or
590590 20 other acceptable security with the Department guaranteeing the
591591 21 payment of such admitted or established liability.
592592 22 The Department shall discharge any surety and shall
593593 23 release and return any bond or security deposit assigned,
594594 24 pledged or otherwise provided to it by a taxpayer under this
595595 25 Section within 30 days after: (1) such taxpayer becomes a

825825 6 rules of evidence, and no informality in any proceeding, or in
826826 7 the manner of taking testimony, shall invalidate any
827827 8 assessment, order, decision, rule or regulation made or
828828 9 approved or confirmed by the Department. The Director of
829829 10 Revenue or any duly designated officer or employee of the
830830 11 Department shall have power to administer oaths to such
831831 12 persons; and the Department shall have the power to issue
832832 13 subpoenas and subpoenas duces tecum, and the Department, or
833833 14 any other party to a proceeding pending before the Department,
834834 15 may apply to the circuit court to compel the attendance and
835835 16 testimony of witnesses and the production of books, papers,
836836 17 records and memoranda, by an attachment for contempt as
837837 18 provided for such purposes in civil cases.
838838 19 The Department or any officer or employee thereof, or any
839839 20 party in an investigation or hearing before the Department,
840840 21 may cause the depositions of witnesses within the State to be
841841 22 taken in the manner prescribed by law for like depositions in
842842 23 civil actions in courts of this State, and to that end compel
843843 24 the attendance of witnesses and the production of books,
844844 25 papers, records and memoranda.

15361536 14 by the Hemp Beverage Commission. The Hemp Beverage Commission
15371537 15 shall approve the application for a self-distribution
15381538 16 exemption if the hemp beverage manufacturer or the hemp
15391539 17 beverage non-resident dealer: (1) is in compliance with the
15401540 18 State, revenue, and hemp beverage laws; (2) is not a member of
15411541 19 any affiliated group that manufactures, directly or
15421542 20 indirectly, more than 25,000 gallons of its hemp beverages;
15431543 21 (3) shall not annually manufacture for sale more than 25,000
15441544 22 of hemp beverages; (4) shall not annually sell more than
15451545 23 25,000 gallons of its hemp beverages to hemp beverage
15461546 24 retailers; and (5) pursuant to subsection (e) of Section 6-4
15471547 25 of this Act, shall have the same privilege as beer

15721572 14 Commission may fine, suspend, or revoke a self-distribution
15731573 15 exemption after a hearing if it finds that the exemption
15741574 16 holder has made a material misrepresentation in its
15751575 17 application, violated a revenue law of Illinois or hemp
15761576 18 beverage laws, exceeded production of 25,000 gallons of hemp
15771577 19 beverages, or become part of an affiliated group producing
15781578 20 more than 25,000 gallons of hemp beverages.
15791579 21 (E) Except in hearings for violations of this Article

18201820 17 a hemp beverage non-resident dealer's license.
18211821 18 (3) A hemp beverage importing distributor shall allow
18221822 19 the importation of hemp beverages by the registrant into
18231823 20 this State from any point in the United States outside
18241824 21 this State, and the purchase of hemp beverage in
18251825 22 containers not more than 16 fluid ounces. The hemp
18261826 23 beverage importing distributor's registration shall permit
18271827 24 such registrant to purchase hemp beverages from Illinois
18281828 25 hemp beverage non-resident dealers only. No person

18511851 12 (a) It is a violation of this Article for any hemp beverage

18551855 16 (b) All permitted happy hours under Section 6-28.5 are

18581858 19 hemp beverages shall be in person and may not be given, sold,
18591859 20 transferred, or delivered to any non-registrant or
18601860 21 non-licensee via any electronic or Internet marketplace, or
18611861 22 any location outside of the registrant's premises other than
18621862 23 as provided in this Article. A hemp beverage retailer may not
18631863 24 ship or deliver hemp beverages.

18781878 4 (e) No hemp beverage may be given, sold, transferred, or
18791879 5 delivered to any person under 21 years of age. A hemp beverage
18801880 6 retailer shall refuse to sell hemp beverage to any person
18811881 7 unless the person produces a government-issued identification
18821882 8 showing that the person is 21 years of age or older, which must
18831883 9 be verified at the point of sale.
18841884 10 (f) No person shall process, manufacture, label,
18851885 11 distribute for sale, sell, offer for sale, market, or
18861886 12 advertise any hemp beverage within this State without
18871887 13 obtaining a registration under this Article.
18881888 14 (g) A registrant shall distribute for sale or offer for
18891889 15 sale intermediate hemp products to a person or entity that is
18901890 16 not registered as a hemp beverage manufacturer under this
18911891 17 Article. A registrant shall not market or advertise
18921892 18 intermediate hemp products for purchase by any hemp beverage
18931893 19 retailer, non-licensee, or non-registrant.
18941894 20 (h) A registrant shall not process, manufacture,
18951895 21 distribute for sale, sell, offer for sale, market, or
18961896 22 advertise any hemp beverage unless the product complies with
18971897 23 the labeling, packaging, minimum testing, and other
18981898 24 requirements of this Article and any administrative rules
18991899 25 adopted by the Hemp Beverage Commission.

19221922 12 (a) Hemp beverages manufactured, processed, distributed,
19231923 13 sold, or offered for sale in this State shall:
19241924 14 (1) be manufactured in accordance with this Article;
19251925 15 (2) be subject to the following minimum requirements:
19261926 16 (A) contain a total THC concentration of no
19271927 17 greater than 10 mg in a container not less than 7.5
19281928 18 ounces, and 60 mg of THC per package for products sold

19521952 7 (b) A hemp beverage manufacturer shall do all of the
19531953 8 following with regard to hemp beverages manufactured,
19541954 9 processed, distributed, sold, or offered for sale in this

19561956 11 (A) maintain sufficient records to demonstrate that
19571957 12 any hemp or hemp extract used by the licensee was grown,
19581958 13 derived, extracted, and transported in accordance with
19591959 14 applicable laws and licensing requirement of the
19601960 15 jurisdiction or jurisdictions from which such hemp or hemp
19611961 16 extract was sourced and for hemp received from an
19621962 17 out-of-state grower, processors shall also maintain
19631963 18 records of the out-of-state grower registration or license
19641964 19 number in the respective jurisdiction;
19651965 20 (B) keep all designated extracting and manufacturing
19661966 21 areas safe and sanitary, including, but not limited to,
19671967 22 ensuring that those areas are adequately lit, cleaned, and
19681968 23 smoke-free;
19691969 24 (C) not use, in the extraction or manufacturing of any
19701970 25 hemp beverage, synthetic cannabinoids, artificially
19711971 26 derived cannabinoids, or tetrahydrocannabinol created

19921992 11 Commission and the Department of Revenue shall implement the

20332033 18 (b) No hemp beverage offered for retail sale shall be made
20342034 19 attractive to individuals under 21 years of age, imitate a
20352035 20 candy label, or use cartoons or other images popularly used to
20362036 21 advertise to children or otherwise be marketed to individuals
20372037 22 under 21 years of age.
20382038 23 (c) No hemp beverage shall be marketed, advertised, or
20392039 24 offered for sale in a manner that:
20402040 25 (1) would cause a reasonable consumer to be confused

20652065 14 leaf, however, cannabis leaves when used as part of a
20662066 15 warning are exempt from this prohibition;
20672067 16 (7) includes any image designed or likely to appeal to
20682068 17 minors, including cartoons, fruits, toys, animals, or
20692069 18 children, or any other likeness to images, characters, or
20702070 19 phrases that are popularly used to advertise to children,
20712071 20 or any packaging or labeling that bears reasonable
20722072 21 resemblance to any product available for consumption as a
20732073 22 commercially available candy or that promotes consumption
20742074 23 of cannabis or hemp beverage;
20752075 24 (8) includes any image or name of an alcoholic
20762076 25 beverage, or any other likeness to images, characters, or

20982098 11 children and pets;
20992099 12 (2) this product is derived from hemp and may contain
21002100 13 THC which could result in a failed drug test;
21012101 14 (3) this product has not been evaluated or approved by
21022102 15 the Food and Drug Administration for safety or efficacy;

21042104 17 (4) if you are pregnant or nursing you should consult
21052105 18 your health care provider before use.
21062106 19 (e) All hemp beverage shall be tested by a laboratory with
21072107 20 a valid ISO/IEC 17025 accreditation for the premises and for
21082108 21 the testing of one or more of the analytes; maintain a valid
21092109 22 scope of accreditation, issued by an accreditation body, that
21102110 23 attests to the laboratory's competence to perform testing of
21112111 24 hemp cannabinoid products; maintain method validation reports
21122112 25 for all testing performed; maintain standard operating
21132113 26 procedures for the sampling of hemp cannabinoid products; and
