11	11	1 AN ACT concerning live adult performances.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 1. Short title. This Act may be cited as the
15	15	5 Prohibition on Government Sponsored Sexual Performances Act.
16	16	6 Section 5. Definitions. As used in this Act:
17	17	7 "Live adult performance" means:
18	18	8 (1) a live performance in which persons appear in a
19	19	9 state of nudity or semi-nudity;
20	20	10 (2) a live performance that is characterized by actual
21	21	11 or simulated acts of sexual penetration or sexual conduct
22	22	12 as defined in Section 11-0.1 of the Criminal Code of 2012;

24	24	14 (3) a live performance that features dancers, exotic
25	25	15 dances, strippers, vogue type movements, or male or female
26	26	16 impersonators who provide entertainment that appeals to
27	27	17 the prurient interest of persons under 18 years of age.
28	28	18 "Nudity" or "state of nudity" means (i) the showing of the
29	29	19 human male or female genitals, pubic area, vulva, anus, anal
30	30	20 cleft or cleavage with less than a fully opaque covering; (ii)
31	31	21 the showing of the female breast with less than a fully opaque
32	32	22 covering of any part of the nipple; or (iii) the showing of the
33	33	23 covered male genitals in a discernibly turgid state.

68	68	1 "Semi-nudity" means a state of dress in which opaque
69	69	2 clothing fails to cover the genitals, anus, anal cleft or
70	70	3 cleavage, pubic area, vulva, and nipple and areola of the
71	71	4 female breast below a horizontal line across the top of the
72	72	5 areola at its highest point. "Semi-nudity" includes the entire
73	73	6 lower portion of the female breast, but does not include any
74	74	7 portion of the cleavage of the human female breast exhibited
75	75	8 by wearing apparel provided the areola is not exposed in whole
76	76	9 or part.
77	77	10 Section 10. Prohibition of live performances containing
78	78	11 adult content for persons under the age of 18.
79	79	12 (a) A unit of local government or a school district may not
80	80	13 allow a live adult performance to be held on publicly owned or
81	81	14 operated property under its control.
82	82	15 (b) Notwithstanding any other provision of law, the State
83	83	16 must stop distributing all funds to a unit of local government
84	84	17 or school district that violates this Section.
85	85	18 Section 15. Home rule preemption. A home rule unit may not
86	86	19 regulate live adult performances in a manner inconsistent with
87	87	20 this Act. This Section is a limitation under subsection (i) of
88	88	21 Section 6 of Article VII of the Illinois Constitution on the
89	89	22 concurrent exercise by home rule units of powers and functions
90	90	23 exercised by the State.
91	91	24 Section 999. Effective date. This Act takes effect upon
