1313 1 AN ACT concerning gaming.
1414 2 Be it enacted by the People of the State of Illinois,
1515 3 represented in the General Assembly:
1616 4 Section 5. The Video Gaming Act is amended by changing
1717 5 Sections 60 and 75 as follows:
1818 6 (230 ILCS 40/60)
1919 7 Sec. 60. Imposition and distribution of tax.
2020 8 (a) A tax of 30% is imposed on net terminal income and
2121 9 shall be collected by the Board.
2222 10 (a-5) Of the tax collected under this subsection (a) from
2323 11 terminal income generated in municipalities with a population
2424 12 less than 2,000,000 and counties, five-sixths shall be
2525 13 deposited into the Capital Projects Fund and one-sixth shall
2626 14 be deposited into the Local Government Video Gaming
2727 15 Distributive Fund.
2828 16 (a-10) Of the tax collected under subsection (a) from
2929 17 terminal income generated in municipalities with a population
3030 18 greater than or equal to 2,000,000, eleven-fifteenths shall be
3131 19 deposited into the Capital Projects Fund and four-fifteenths
3232 20 shall be deposited into the Local Government with Greater than
3333 21 2,000,000 Residents Video Gaming Distributive Fund.
3434 22 (b) Beginning on July 1, 2019, an additional tax of 3% is

7474 1 Board.
7575 2 Beginning on July 1, 2020, an additional tax of 1% is
7676 3 imposed on net terminal income and shall be collected by the
7777 4 Board.
7878 5 Beginning on July 1, 2024, an additional tax of 1% is
7979 6 imposed on net terminal income and shall be collected by the
8080 7 Board.
8181 8 The tax collected under this subsection (b) shall be
8282 9 deposited into the Capital Projects Fund.
8383 10 (c) Revenues generated from the play of video gaming
8484 11 terminals shall be deposited by the terminal operator, who is
8585 12 responsible for tax payments, in a specially created, separate
8686 13 bank account maintained by the video gaming terminal operator
8787 14 to allow for electronic fund transfers of moneys for tax
8888 15 payment.
8989 16 (d) Each licensed establishment, licensed truck stop
9090 17 establishment, licensed large truck stop establishment,
9191 18 licensed fraternal establishment, and licensed veterans
9292 19 establishment shall maintain an adequate video gaming fund,
9393 20 with the amount to be determined by the Board.
9494 21 (e) The State's percentage of net terminal income shall be
9595 22 reported and remitted to the Board within 15 days after the
9696 23 15th day of each month and within 15 days after the end of each
9797 24 month by the video terminal operator. A video terminal
9898 25 operator who falsely reports or fails to report the amount due
9999 26 required by this Section is guilty of a Class 4 felony and is

110110 1 subject to termination of his or her license by the Board. Each
111111 2 video terminal operator shall keep a record of net terminal
112112 3 income in such form as the Board may require. All payments not
113113 4 remitted when due shall be paid together with a penalty
114114 5 assessment on the unpaid balance at a rate of 1.5% per month.

117117 8 Sec. 75. Revenue sharing; Local Government Video Gaming
118118 9 Distributive Fund.
119119 10 (a) As soon as may be after the first day of each month,
120120 11 the Department of Revenue shall allocate among those
121121 12 municipalities with a population less than 2,000,000 and
122122 13 counties of this State that have not prohibited video gaming
123123 14 pursuant to Section 27 or Section 70 the amount available in
124124 15 the Local Government Video Gaming Distributive Fund, a special
125125 16 fund in the State Treasury, as provided in Section 60. The
126126 17 Department shall then certify such allocations to the State
127127 18 Comptroller, who shall pay over to those eligible
128128 19 municipalities and counties the respective amounts allocated
129129 20 to them. The amount of such funds allocable to each such
130130 21 municipality and county shall be in proportion to the tax
131131 22 revenue generated from video gaming within the eligible
132132 23 municipality or county compared to the tax revenue generated
133133 24 from video gaming Statewide.

145145 1 the Department of Revenue shall allocate among those
146146 2 municipalities of this State with a population greater than or
147147 3 equal to 2,000,000 that have not prohibited video gaming
148148 4 pursuant to Section 27 or 70 the amount available in the Local
149149 5 Government with Greater than 2,000,000 Residents Video Gaming
150150 6 Distributive Fund, a special fund that is created in the State
151151 7 treasury, as provided in Section 60. The Department shall then
152152 8 certify such allocations to the State Comptroller, who shall
153153 9 pay over to those eligible municipalities the respective
154154 10 amount allocated.
155155 11 (b) The amounts allocated and paid to a municipality or
156156 12 county of this State pursuant to the provisions of this
157157 13 Section may be used for any general corporate purpose
158158 14 authorized for that municipality or county.
159159 15 (c) Upon determination by the Department that an amount
160160 16 has been paid pursuant to this Section in excess of the amount
161161 17 to which the county or municipality receiving such payment was
162162 18 entitled, the county or municipality shall, upon demand by the
163163 19 Department, repay such amount. If such repayment is not made
164164 20 within a reasonable time, the Department shall withhold from
165165 21 future payments an amount equal to such overpayment. The
166166 22 Department shall redistribute the amount of such payment to
167167 23 the county or municipality entitled thereto.
