13	13	1 AN ACT concerning government.
14	14	2 Be it enacted by the People of the State of Illinois,
15	15	3 represented in the General Assembly:
16	16	4 Section 5. The Freedom of Information Act is amended by
17	17	5 changing Sections 2, 7, and 9.5 as follows:

19	19	7 Sec. 2. Definitions. As used in this Act:
20	20	8 (a) "Public body" means all legislative, executive,
21	21	9 judicial, administrative, or advisory bodies of the State, or
22	22	10 their components, state universities and colleges, counties,
23	23	11 townships, cities, villages, incorporated towns, school
24	24	12 districts and all other municipal corporations, boards,
25	25	13 bureaus, committees, or commissions of this State, any
26	26	14 subsidiary bodies of any of the foregoing including but not
27	27	15 limited to committees and subcommittees thereof, and a School
28	28	16 Finance Authority created under Article 1E of the School Code.
29	29	17 "Public body" does not include a child death review team or the
30	30	18 Illinois Child Death Review Teams Executive Council
31	31	19 established under the Child Death Review Team Act, or a
32	32	20 regional youth advisory board or the Statewide Youth Advisory
33	33	21 Board established under the Department of Children and Family
34	34	22 Services Statewide Youth Advisory Board Act.

76	76	3 (c) "Public records" means all records, reports, forms,
77	77	4 writings, letters, memoranda, books, papers, maps,
78	78	5 photographs, microfilms, cards, tapes, recordings, electronic
79	79	6 data processing records, electronic communications, recorded
80	80	7 information and all other documentary materials pertaining to
81	81	8 the transaction of public business, regardless of physical
82	82	9 form or characteristics, having been prepared by or for, or
83	83	10 having been or being used by, received by, in the possession
84	84	11 of, or under the control of any public body. For the judicial
85	85	12 body and its components, "public records" includes, but is not
86	86	13 limited to, the following records in possession of the
87	87	14 judicial body or its components, as long as the record has been
88	88	15 anonymized and all personally identifiable information,
89	89	16 including, but not limited to, personally identifiable
90	90	17 information of a juvenile, such as the juvenile's name and
91	91	18 date of birth, has been anonymized: juvenile court and
92	92	19 juvenile detention information; criminal charges; detention
93	93	20 date; release date; reason for detention; orders for pretrial
94	94	21 services; orders for electronic monitoring and case
95	95	22 disposition; and contracts related to pretrial or post
96	96	23 adjudication services, programs, or monitoring and any
97	97	24 finalized reports or evaluations of those programs.
98	98	25 (c-5) "Private information" means unique identifiers,
99	99	26 including a person's social security number, driver's license

110	110	1 number, employee identification number, biometric identifiers,
111	111	2 personal financial information, passwords or other access
112	112	3 codes, medical records, home or personal telephone numbers,
113	113	4 and personal email addresses. Private information also
114	114	5 includes home address and personal license plates, except as
115	115	6 otherwise provided by law or when compiled without possibility
116	116	7 of attribution to any person. For a public body that is a
117	117	8 HIPAA-covered entity, "private information" includes
118	118	9 electronic medical records and all information, including
119	119	10 demographic information, contained within or extracted from an
120	120	11 electronic medical records system operated or maintained by
121	121	12 the public body in compliance with State and federal medical
122	122	13 privacy laws and regulations, including, but not limited to,
123	123	14 the Health Insurance Portability and Accountability Act and
124	124	15 its regulations, 45 CFR Parts 160 and 164. As used in this
125	125	16 subsection, "HIPAA-covered entity" has the meaning given to
126	126	17 the term "covered entity" in 45 CFR 160.103.
127	127	18 (c-10) "Commercial purpose" means the use of any part of a
128	128	19 public record or records, or information derived from public
129	129	20 records, in any form for sale, resale, or solicitation or
130	130	21 advertisement for sales or services. For purposes of this
131	131	22 definition, requests made by news media and non-profit,
132	132	23 scientific, or academic organizations shall not be considered
133	133	24 to be made for a "commercial purpose" when the principal
134	134	25 purpose of the request is (i) to access and disseminate
135	135	26 information concerning news and current or passing events,

147	147	2 public, or (iii) for the purpose of academic, scientific, or
148	148	3 public research or education.
149	149	4 (d) "Copying" means the reproduction of any public record
150	150	5 by means of any photographic, electronic, mechanical or other
151	151	6 process, device or means now known or hereafter developed and
152	152	7 available to the public body.
153	153	8 (e) "Head of the public body" means the president, mayor,
154	154	9 chairman, presiding officer, director, superintendent,
155	155	10 manager, supervisor or individual otherwise holding primary
156	156	11 executive and administrative authority for the public body, or
157	157	12 such person's duly authorized designee.
158	158	13 (f) "News media" means a newspaper or other periodical
159	159	14 issued at regular intervals whether in print or electronic
160	160	15 format, a news service whether in print or electronic format,
161	161	16 a radio station, a television station, a television network, a
162	162	17 community antenna television service, or a person or
163	163	18 corporation engaged in making news reels or other motion
164	164	19 picture news for public showing.
165	165	20 (g) "Recurrent requester", as used in Section 3.2 of this
166	166	21 Act, means a person that, in the 12 months immediately
167	167	22 preceding the request, has submitted to the same public body
168	168	23 (i) a minimum of 50 requests for records, (ii) a minimum of 15
169	169	24 requests for records within a 30-day period, or (iii) a
170	170	25 minimum of 7 requests for records within a 7-day period. For

182	182	1 non-profit, scientific, or academic organizations shall not be
183	183	2 considered in calculating the number of requests made in the
184	184	3 time periods in this definition when the principal purpose of
185	185	4 the requests is (i) to access and disseminate information
186	186	5 concerning news and current or passing events, (ii) for
187	187	6 articles of opinion or features of interest to the public, or
188	188	7 (iii) for the purpose of academic, scientific, or public
189	189	8 research or education.
190	190	9 For the purposes of this subsection (g), "request" means a
191	191	10 written document (or oral request, if the public body chooses
192	192	11 to honor oral requests) that is submitted to a public body via
193	193	12 personal delivery, mail, telefax, electronic mail, or other
194	194	13 means available to the public body and that identifies the
195	195	14 particular public record the requester seeks. One request may
196	196	15 identify multiple records to be inspected or copied.
197	197	16 (h) "Voluminous request" means a request that: (i)
198	198	17 includes more than 5 individual requests for more than 5
199	199	18 different categories of records or a combination of individual
200	200	19 requests that total requests for more than 5 different
201	201	20 categories of records in a period of 20 business days; or (ii)
202	202	21 requires the compilation of more than 500 letter or
203	203	22 legal-sized pages of public records unless a single requested
204	204	23 record exceeds 500 pages. "Single requested record" may
205	205	24 include, but is not limited to, one report, form, e-mail,
206	206	25 letter, memorandum, book, map, microfilm, tape, or recording.

221	221	4 current or passing events; (2) for articles of opinion or

223	223	6 academic, scientific, or public research or education.
224	224	7 For the purposes of this subsection (h), "request" means a
225	225	8 written document, or oral request, if the public body chooses
226	226	9 to honor oral requests, that is submitted to a public body via
227	227	10 personal delivery, mail, telefax, electronic mail, or other
228	228	11 means available to the public body and that identifies the
229	229	12 particular public record or records the requester seeks. One
230	230	13 request may identify multiple individual records to be
231	231	14 inspected or copied.
232	232	15 (i) "Severance agreement" means a mutual agreement between
233	233	16 any public body and its employee for the employee's
234	234	17 resignation in exchange for payment by the public body.

239	239	22 (1) When a request is made to inspect or copy a public
240	240	23 record that contains information that is exempt from
241	241	24 disclosure under this Section, but also contains information

254	254	2 shall make the remaining information available for inspection
255	255	3 and copying. Subject to this requirement, the following shall
256	256	4 be exempt from inspection and copying:
257	257	5 (a) Information specifically prohibited from
258	258	6 disclosure by federal or State law or rules and
259	259	7 regulations implementing federal or State law.
260	260	8 (b) Private information, unless disclosure is required
261	261	9 by another provision of this Act, a State or federal law,
262	262	10 or a court order.
263	263	11 (b-5) Files, documents, and other data or databases
264	264	12 maintained by one or more law enforcement agencies and
265	265	13 specifically designed to provide information to one or
266	266	14 more law enforcement agencies regarding the physical or
267	267	15 mental status of one or more individual subjects.
268	268	16 (c) Personal information contained within public
269	269	17 records, the disclosure of which would constitute a
270	270	18 clearly unwarranted invasion of personal privacy, unless
271	271	19 the disclosure is consented to in writing by the
272	272	20 individual subjects of the information. "Unwarranted
273	273	21 invasion of personal privacy" means the disclosure of
274	274	22 information that is highly personal or objectionable to a
275	275	23 reasonable person and in which the subject's right to
276	276	24 privacy outweighs any legitimate public interest in
277	277	25 obtaining the information. The disclosure of information

292	292	4 created in the course of administrative enforcement
293	293	5 proceedings, and any law enforcement or correctional
294	294	6 agency for law enforcement purposes, but only to the
295	295	7 extent that disclosure would:
296	296	8 (i) interfere with pending or actually and
297	297	9 reasonably contemplated law enforcement proceedings
298	298	10 conducted by any law enforcement or correctional
299	299	11 agency that is the recipient of the request;
300	300	12 (ii) interfere with active administrative
301	301	13 enforcement proceedings conducted by the public body
302	302	14 that is the recipient of the request;
303	303	15 (iii) create a substantial likelihood that a
304	304	16 person will be deprived of a fair trial or an impartial
305	305	17 hearing;
306	306	18 (iv) unavoidably disclose the identity of a
307	307	19 confidential source, confidential information
308	308	20 furnished only by the confidential source, or persons
309	309	21 who file complaints with or provide information to
310	310	22 administrative, investigative, law enforcement, or
311	311	23 penal agencies; except that the identities of
312	312	24 witnesses to traffic crashes, traffic crash reports,
313	313	25 and rescue reports shall be provided by agencies of

341	341	17 enforcement purposes and contained in a shared electronic
342	342	18 record management system if the law enforcement agency
343	343	19 that is the recipient of the request did not create the
344	344	20 record, did not participate in or have a role in any of the
345	345	21 events which are the subject of the record, and only has
346	346	22 access to the record through the shared electronic record

446	446	14 trade secrets or commercial or financial information would
447	447	15 cause competitive harm to the person or business, and only

831	831	3 (1) When a request is made to inspect or copy a public

834	834	6 that is not exempt from disclosure, the public body may elect
835	835	7 to redact the information that is exempt. The public body
836	836	8 shall make the remaining information available for inspection
837	837	9 and copying. Subject to this requirement, the following shall
838	838	10 be exempt from inspection and copying:
839	839	11 (a) Information specifically prohibited from
840	840	12 disclosure by federal or State law or rules and
841	841	13 regulations implementing federal or State law.
842	842	14 (b) Private information, unless disclosure is required
843	843	15 by another provision of this Act, a State or federal law,
844	844	16 or a court order.

879	879	16 reasonably contemplated law enforcement proceedings
880	880	17 conducted by any law enforcement or correctional

882	882	19 (ii) interfere with active administrative

1443	1443	5 (b) A person whose request to inspect or copy a public
1444	1444	6 record is made for a commercial purpose as defined in
1445	1445	7 subsection (c-10) of Section 2 of this Act may not file a
1446	1446	8 request for review with the Public Access Counselor. A person
1447	1447	9 whose request to inspect or copy a public record was treated by
1448	1448	10 the public body as a request for a commercial purpose under
1449	1449	11 Section 3.1 of this Act may file a request for review with the
1450	1450	12 Public Access Counselor for the limited purpose of reviewing
1451	1451	13 whether the public body properly determined that the request
1452	1452	14 was made for a commercial purpose.
1453	1453	15 (b-5) A person whose request to inspect or copy a public
1454	1454	16 record was treated by a public body, except the General
1455	1455	17 Assembly and committees, commissions, and agencies thereof and
1456	1456	18 the judicial body and its components, as a voluminous request
1457	1457	19 under Section 3.6 of this Act may file a request for review
1458	1458	20 with the Public Access Counselor for the purpose of reviewing
1459	1459	21 whether the public body properly determined that the request
1460	1460	22 was a voluminous request.
1461	1461	23 (c) Upon receipt of a request for review, the Public
1462	1462	24 Access Counselor shall determine whether further action is
1463	1463	25 warranted. If the Public Access Counselor determines that the
1464	1464	26 alleged violation is unfounded, he or she shall so advise the

1476	1476	2 undertaken. In all other cases, the Public Access Counselor
1477	1477	3 shall forward a copy of the request for review to the public
1478	1478	4 body within 7 business days after receipt and shall specify
1479	1479	5 the records or other documents that the public body shall
1480	1480	6 furnish to facilitate the review. Within 7 business days after
1481	1481	7 receipt of the request for review, the public body shall
1482	1482	8 provide copies of records requested and shall otherwise fully
1483	1483	9 cooperate with the Public Access Counselor. If a public body
1484	1484	10 fails to furnish specified records pursuant to this Section,
1485	1485	11 or if otherwise necessary, the Attorney General may issue a
1486	1486	12 subpoena to any person or public body having knowledge of or
1487	1487	13 records pertaining to a request for review of a denial of
1488	1488	14 access to records under the Act. Records or documents obtained
1489	1489	15 by the Public Access Counselor from a public body for the
1490	1490	16 purpose of addressing a request for review under this Section
1491	1491	17 may not be disclosed to the public, including the requester,
1492	1492	18 by the Public Access Counselor. These records, while in the
1493	1493	19 possession of the Public Access Counselor, are exempt under
1494	1494	20 this Act from disclosure by the Public Access Counselor.
1495	1495	21 (d) Within 7 business days after it receives a copy of a
1496	1496	22 request for review and request for production of records from
1497	1497	23 the Public Access Counselor, the public body may, but is not
1498	1498	24 required to, answer the allegations of the request for review.
1499	1499	25 The answer may take the form of a letter, brief, or memorandum.

1512	1512	2 alleged confidential information to which the request pertains
1513	1513	3 redacted from the copy. The requester may, but is not required
1514	1514	4 to, respond in writing to the answer within 7 business days and
1515	1515	5 shall provide a copy of the response to the public body.
1516	1516	6 (e) In addition to the request for review, and the answer
1517	1517	7 and the response thereto, if any, a requester or a public body
1518	1518	8 may furnish affidavits or records concerning any matter
1519	1519	9 germane to the review.
1520	1520	10 (f) Unless the Public Access Counselor extends the time by
1521	1521	11 no more than 30 business days by sending written notice to the
1522	1522	12 requester and the public body that includes a statement of the
1523	1523	13 reasons for the extension in the notice, or decides to address
1524	1524	14 the matter without the issuance of a binding opinion, the
1525	1525	15 Attorney General shall examine the issues and the records,
1526	1526	16 shall make findings of fact and conclusions of law, and shall
1527	1527	17 issue to the requester and the public body an opinion in
1528	1528	18 response to the request for review within 60 days after its
1529	1529	19 receipt. The opinion shall be binding upon both the requester
1530	1530	20 and the public body, subject to administrative review under
1531	1531	21 Section 11.5.
1532	1532	22 In responding to any request under this Section 9.5, the
1533	1533	23 Attorney General may exercise his or her discretion and choose
1534	1534	24 to resolve a request for review by mediation or by a means
1535	1535	25 other than the issuance of a binding opinion. The decision not
1536	1536	26 to issue a binding opinion shall not be reviewable.

1547	1547	1 Upon receipt of a binding opinion concluding that a
1548	1548	2 violation of this Act has occurred, the public body shall
1549	1549	3 either take necessary action immediately to comply with the
1550	1550	4 directive of the opinion or shall initiate administrative
1551	1551	5 review under Section 11.5. If the opinion concludes that no
1552	1552	6 violation of the Act has occurred, the requester may initiate
1553	1553	7 administrative review under Section 11.5.
1554	1554	8 A public body that discloses records in accordance with an
1555	1555	9 opinion of the Attorney General is immune from all liabilities
1556	1556	10 by reason thereof and shall not be liable for penalties under
1557	1557	11 this Act.
1558	1558	12 (g) If the requester files suit under Section 11 with
1559	1559	13 respect to the same denial that is the subject of a pending
1560	1560	14 request for review, the requester shall notify the Public
1561	1561	15 Access Counselor, and the Public Access Counselor shall take
1562	1562	16 no further action with respect to the request for review and
1563	1563	17 shall so notify the public body.
1564	1564	18 (h) The Attorney General may also issue advisory opinions
1565	1565	19 to public bodies regarding compliance with this Act. A review
1566	1566	20 may be initiated upon receipt of a written request from the
1567	1567	21 head of the public body or its attorney, which shall contain
1568	1568	22 sufficient accurate facts from which a determination can be
1569	1569	23 made. The Public Access Counselor may request additional
1570	1570	24 information from the public body in order to assist in the
1571	1571	25 review. A public body that relies in good faith on an advisory
1572	1572	26 opinion of the Attorney General in responding to a request is
