11	11	1 AN ACT concerning finance.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 5. The Illinois Procurement Code is amended by
15	15	5 changing Section 1-10 as follows:
16	16	6 (30 ILCS 500/1-10)
17	17	7 Sec. 1-10. Application.
18	18	8 (a) This Code applies only to procurements for which
19	19	9 bidders, offerors, potential contractors, or contractors were
20	20	10 first solicited on or after July 1, 1998. This Code shall not
21	21	11 be construed to affect or impair any contract, or any
22	22	12 provision of a contract, entered into based on a solicitation
23	23	13 prior to the implementation date of this Code as described in
24	24	14 Article 99, including, but not limited to, any covenant
25	25	15 entered into with respect to any revenue bonds or similar
26	26	16 instruments. All procurements for which contracts are
27	27	17 solicited between the effective date of Articles 50 and 99 and
28	28	18 July 1, 1998 shall be substantially in accordance with this
29	29	19 Code and its intent.
30	30	20 (b) This Code shall apply regardless of the source of the
31	31	21 funds with which the contracts are paid, including federal
32	32	22 assistance moneys. This Code shall not apply to:

71	71	4 (2) Grants, except for the filing requirements of
72	72	5 Section 20-80.
73	73	6 (3) Purchase of care, except as provided in Section
74	74	7 5-30.6 of the Illinois Public Aid Code and this Section.
75	75	8 (4) Hiring of an individual as an employee and not as
76	76	9 an independent contractor, whether pursuant to an
77	77	10 employment code or policy or by contract directly with
78	78	11 that individual.
79	79	12 (5) Collective bargaining contracts.
80	80	13 (6) Purchase of real estate, except that notice of
81	81	14 this type of contract with a value of more than $25,000
82	82	15 must be published in the Procurement Bulletin within 10
83	83	16 calendar days after the deed is recorded in the county of
84	84	17 jurisdiction. The notice shall identify the real estate
85	85	18 purchased, the names of all parties to the contract, the
86	86	19 value of the contract, and the effective date of the
87	87	20 contract.
88	88	21 (7) Contracts necessary to prepare for anticipated
89	89	22 litigation, enforcement actions, or investigations,
90	90	23 provided that the chief legal counsel to the Governor
91	91	24 shall give his or her prior approval when the procuring
92	92	25 agency is one subject to the jurisdiction of the Governor,
93	93	26 and provided that the chief legal counsel of any other

112	112	9 to the procurement requirements of Section 20 of the
113	113	10 Public-Private Partnerships for Transportation Act and
114	114	11 design-build agreements entered into according to the
115	115	12 procurement requirements of Section 25 of the
116	116	13 Public-Private Partnerships for Transportation Act.
117	117	14 (12) (A) Contracts for legal, financial, and other
118	118	15 professional and artistic services entered into by the
119	119	16 Illinois Finance Authority in which the State of Illinois
120	120	17 is not obligated. Such contracts shall be awarded through
121	121	18 a competitive process authorized by the members of the
122	122	19 Illinois Finance Authority and are subject to Sections
123	123	20 5-30, 20-160, 50-13, 50-20, 50-35, and 50-37 of this Code,
124	124	21 as well as the final approval by the members of the
125	125	22 Illinois Finance Authority of the terms of the contract.
126	126	23 (B) Contracts for legal and financial services entered
127	127	24 into by the Illinois Housing Development Authority in
128	128	25 connection with the issuance of bonds in which the State
129	129	26 of Illinois is not obligated. Such contracts shall be

141	141	2 members of the Illinois Housing Development Authority and
142	142	3 are subject to Sections 5-30, 20-160, 50-13, 50-20, 50-35,
143	143	4 and 50-37 of this Code, as well as the final approval by
144	144	5 the members of the Illinois Housing Development Authority
145	145	6 of the terms of the contract.
146	146	7 (13) Contracts for services, commodities, and
147	147	8 equipment to support the delivery of timely forensic
148	148	9 science services in consultation with and subject to the
149	149	10 approval of the Chief Procurement Officer as provided in
150	150	11 subsection (d) of Section 5-4-3a of the Unified Code of
151	151	12 Corrections, except for the requirements of Sections
152	152	13 20-60, 20-65, 20-70, and 20-160 and Article 50 of this
153	153	14 Code; however, the Chief Procurement Officer may, in
154	154	15 writing with justification, waive any certification
155	155	16 required under Article 50 of this Code. For any contracts
156	156	17 for services which are currently provided by members of a
157	157	18 collective bargaining agreement, the applicable terms of
158	158	19 the collective bargaining agreement concerning
159	159	20 subcontracting shall be followed.
160	160	21 On and after January 1, 2019, this paragraph (13),
161	161	22 except for this sentence, is inoperative.
162	162	23 (14) Contracts for participation expenditures required
163	163	24 by a domestic or international trade show or exhibition of
164	164	25 an exhibitor, member, or sponsor.

176	176	1 requires the State to reimburse the railroad or utilities
177	177	2 for the relocation of utilities for construction or other
178	178	3 public purpose. Contracts included within this paragraph
179	179	4 (15) shall include, but not be limited to, those
180	180	5 associated with: relocations, crossings, installations,
181	181	6 and maintenance. For the purposes of this paragraph (15),
182	182	7 "railroad" means any form of non-highway ground
183	183	8 transportation that runs on rails or electromagnetic
184	184	9 guideways and "utility" means: (1) public utilities as
185	185	10 defined in Section 3-105 of the Public Utilities Act, (2)
186	186	11 telecommunications carriers as defined in Section 13-202
187	187	12 of the Public Utilities Act, (3) electric cooperatives as
188	188	13 defined in Section 3.4 of the Electric Supplier Act, (4)
189	189	14 telephone or telecommunications cooperatives as defined in
190	190	15 Section 13-212 of the Public Utilities Act, (5) rural
191	191	16 water or waste water systems with 10,000 connections or
192	192	17 less, (6) a holder as defined in Section 21-201 of the
193	193	18 Public Utilities Act, and (7) municipalities owning or
194	194	19 operating utility systems consisting of public utilities
195	195	20 as that term is defined in Section 11-117-2 of the
196	196	21 Illinois Municipal Code.
197	197	22 (16) Procurement expenditures necessary for the
198	198	23 Department of Public Health to provide the delivery of
199	199	24 timely newborn screening services in accordance with the
200	200	25 Newborn Metabolic Screening Act.
201	201	26 (17) Procurement expenditures necessary for the

213	213	2 Professional Regulation, the Department of Human Services,
214	214	3 and the Department of Public Health to implement the
215	215	4 Compassionate Use of Medical Cannabis Program and Opioid
216	216	5 Alternative Pilot Program requirements and ensure access
217	217	6 to medical cannabis for patients with debilitating medical
218	218	7 conditions in accordance with the Compassionate Use of
219	219	8 Medical Cannabis Program Act.
220	220	9 (18) This Code does not apply to any procurements
221	221	10 necessary for the Department of Agriculture, the
222	222	11 Department of Financial and Professional Regulation, the
223	223	12 Department of Human Services, the Department of Commerce
224	224	13 and Economic Opportunity, and the Department of Public
225	225	14 Health to implement the Cannabis Regulation and Tax Act if
226	226	15 the applicable agency has made a good faith determination
227	227	16 that it is necessary and appropriate for the expenditure
228	228	17 to fall within this exemption and if the process is
229	229	18 conducted in a manner substantially in accordance with the
230	230	19 requirements of Sections 20-160, 25-60, 30-22, 50-5,
231	231	20 50-10, 50-10.5, 50-12, 50-13, 50-15, 50-20, 50-21, 50-35,
232	232	21 50-36, 50-37, 50-38, and 50-50 of this Code; however, for
233	233	22 Section 50-35, compliance applies only to contracts or
234	234	23 subcontracts over $100,000. Notice of each contract
235	235	24 entered into under this paragraph (18) that is related to
236	236	25 the procurement of goods and services identified in
237	237	26 paragraph (1) through (9) of this subsection shall be

248	248	1 published in the Procurement Bulletin within 14 calendar
249	249	2 days after contract execution. The Chief Procurement
250	250	3 Officer shall prescribe the form and content of the
251	251	4 notice. Each agency shall provide the Chief Procurement
252	252	5 Officer, on a monthly basis, in the form and content
253	253	6 prescribed by the Chief Procurement Officer, a report of
254	254	7 contracts that are related to the procurement of goods and
255	255	8 services identified in this subsection. At a minimum, this
256	256	9 report shall include the name of the contractor, a
257	257	10 description of the supply or service provided, the total
258	258	11 amount of the contract, the term of the contract, and the
259	259	12 exception to this Code utilized. A copy of any or all of
260	260	13 these contracts shall be made available to the Chief
261	261	14 Procurement Officer immediately upon request. The Chief
262	262	15 Procurement Officer shall submit a report to the Governor
263	263	16 and General Assembly no later than November 1 of each year
264	264	17 that includes, at a minimum, an annual summary of the
265	265	18 monthly information reported to the Chief Procurement
266	266	19 Officer. This exemption becomes inoperative 5 years after
267	267	20 June 25, 2019 (the effective date of Public Act 101-27).
268	268	21 (19) Acquisition of modifications or adjustments,
269	269	22 limited to assistive technology devices and assistive
270	270	23 technology services, adaptive equipment, repairs, and
271	271	24 replacement parts to provide reasonable accommodations (i)
272	272	25 that enable a qualified applicant with a disability to
273	273	26 complete the job application process and be considered for

288	288	5 employee, (iii) to enable a qualified current employee
289	289	6 with a disability to enjoy equal benefits and privileges
290	290	7 of employment as are enjoyed by other similarly situated
291	291	8 employees without disabilities, and (iv) that allow a
292	292	9 customer, client, claimant, or member of the public
293	293	10 seeking State services full use and enjoyment of and
294	294	11 access to its programs, services, or benefits.
295	295	12 For purposes of this paragraph (19):
296	296	13 "Assistive technology devices" means any item, piece
297	297	14 of equipment, or product system, whether acquired
298	298	15 commercially off the shelf, modified, or customized, that
299	299	16 is used to increase, maintain, or improve functional
300	300	17 capabilities of individuals with disabilities.
301	301	18 "Assistive technology services" means any service that
302	302	19 directly assists an individual with a disability in
303	303	20 selection, acquisition, or use of an assistive technology
304	304	21 device.
305	305	22 "Qualified" has the same meaning and use as provided
306	306	23 under the federal Americans with Disabilities Act when
307	307	24 describing an individual with a disability.
308	308	25 (20) Procurement expenditures necessary for the
309	309	26 Illinois Commerce Commission to hire third-party

332	332	13 Order Act, the Firearm Dealer License Certification Act,
333	333	14 the Law Enforcement Agencies Data System (LEADS), the
334	334	15 Uniform Crime Reporting Act, the Criminal Identification
335	335	16 Act, the Illinois Uniform Conviction Information Act, and
336	336	17 the Gun Trafficking Information Act, or establish or
337	337	18 maintain record management systems necessary to conduct
338	338	19 human trafficking investigations or gun trafficking or
339	339	20 other stolen firearm investigations. This paragraph (21)
340	340	21 applies to contracts entered into on or after January 10,
341	341	22 2023 (the effective date of Public Act 102-1116) and the
342	342	23 renewal of contracts that are in effect on January 10,
343	343	24 2023 (the effective date of Public Act 102-1116).
344	344	25 (22) Contracts for project management services and
345	345	26 system integration services required for the completion of

357	357	2 exemption becomes inoperative 5 years after June 7, 2023

359	359	4 Public Act 103-8). This paragraph (22) applies to
360	360	5 contracts entered into on or after June 7, 2023 (the
361	361	6 effective date of the changes made to this Section by
362	362	7 Public Act 103-8) and the renewal of contracts that are in
363	363	8 effect on June 7, 2023 (the effective date of the changes
364	364	9 made to this Section by Public Act 103-8).
365	365	10 (23) Procurements necessary for the Department of
366	366	11 Insurance to implement the Illinois Health Benefits
367	367	12 Exchange Law if the Department of Insurance has made a
368	368	13 good faith determination that it is necessary and
369	369	14 appropriate for the expenditure to fall within this
370	370	15 exemption. The procurement process shall be conducted in a
371	371	16 manner substantially in accordance with the requirements
372	372	17 of Sections 20-160 and 25-60 and Article 50 of this Code. A
373	373	18 copy of these contracts shall be made available to the
374	374	19 Chief Procurement Officer immediately upon request. This
375	375	20 paragraph is inoperative 5 years after June 27, 2023 (the
376	376	21 effective date of Public Act 103-103).
377	377	22 (24) Contracts for public education programming,
378	378	23 noncommercial sustaining announcements, public service
379	379	24 announcements, and public awareness and education
380	380	25 messaging with the nonprofit trade associations of the
381	381	26 providers of those services that inform the public on

393	393	2 (25) Procurements necessary for the Department of
394	394	3 Early Childhood to implement the Department of Early
395	395	4 Childhood Act if the Department has made a good faith
396	396	5 determination that it is necessary and appropriate for the
397	397	6 expenditure to fall within this exemption. This exemption
398	398	7 shall only be used for products and services procured
399	399	8 solely for use by the Department of Early Childhood. The
400	400	9 procurements may include those necessary to design and
401	401	10 build integrated, operational systems of programs and
402	402	11 services. The procurements may include, but are not
403	403	12 limited to, those necessary to align and update program
404	404	13 standards, integrate funding systems, design and establish
405	405	14 data and reporting systems, align and update models for
406	406	15 technical assistance and professional development, design
407	407	16 systems to manage grants and ensure compliance, design and
408	408	17 implement management and operational structures, and
409	409	18 establish new means of engaging with families, educators,
410	410	19 providers, and stakeholders. The procurement processes
411	411	20 shall be conducted in a manner substantially in accordance
412	412	21 with the requirements of Article 50 (ethics) and Sections
413	413	22 5-5 (Procurement Policy Board), 5-7 (Commission on Equity
414	414	23 and Inclusion), 20-80 (contract files), 20-120
415	415	24 (subcontractors), 20-155 (paperwork), 20-160
416	416	25 (ethics/campaign contribution prohibitions), 25-60
417	417	26 (prevailing wage), and 25-90 (prohibited and authorized

429	429	2 the Department of Early Childhood shall provide a
430	430	3 quarterly report to the General Assembly detailing a list
431	431	4 of expenditures and contracts for which the Department
432	432	5 uses this exemption. This paragraph is inoperative on and
433	433	6 after July 1, 2027.
434	434	7 (26) (25) Procurements that are necessary for
435	435	8 increasing the recruitment and retention of State
436	436	9 employees, particularly minority candidates for
437	437	10 employment, including:
438	438	11 (A) procurements related to registration fees for
439	439	12 job fairs and other outreach and recruitment events;
440	440	13 (B) production of recruitment materials; and
441	441	14 (C) other services related to recruitment and
442	442	15 retention of State employees.
443	443	16 The exemption under this paragraph (26) (25) applies
444	444	17 only if the State agency has made a good faith
445	445	18 determination that it is necessary and appropriate for the
446	446	19 expenditure to fall within this paragraph (26) (25). The
447	447	20 procurement process under this paragraph (26) (25) shall
448	448	21 be conducted in a manner substantially in accordance with
449	449	22 the requirements of Sections 20-160 and 25-60 and Article
450	450	23 50 of this Code. A copy of these contracts shall be made
451	451	24 available to the Chief Procurement Officer immediately
452	452	25 upon request. Nothing in this paragraph (26) (25)
453	453	26 authorizes the replacement or diminishment of State

469	469	6 Notwithstanding any other provision of law, for contracts
470	470	7 with an annual value of more than $100,000 entered into on or

473	473	10 or (5), each State agency shall post to the appropriate
474	474	11 procurement bulletin the name of the contractor, a description
475	475	12 of the supply or service provided, the total amount of the
476	476	13 contract, the term of the contract, and the exception to the
477	477	14 Code utilized. The chief procurement officer shall submit a
478	478	15 report to the Governor and General Assembly no later than
479	479	16 November 1 of each year that shall include, at a minimum, an
480	480	17 annual summary of the monthly information reported to the
481	481	18 chief procurement officer.
482	482	19 (c) This Code does not apply to the electric power
483	483	20 procurement process provided for under Section 1-75 of the
484	484	21 Illinois Power Agency Act and Section 16-111.5 of the Public
485	485	22 Utilities Act. This Code does not apply to the procurement of

520	520	21 necessary to review whether a contract, purchase, or other
521	521	22 expenditure is or is not subject to the provisions of this
522	522	23 Code, unless such records would be subject to attorney-client
523	523	24 privilege.
524	524	25 (j) This Code does not apply to the process used by the
525	525	26 Capital Development Board to retain an artist or work or works

542	542	7 (l) This Code does not apply to the processes used by the
543	543	8 Illinois Student Assistance Commission to procure supplies and
544	544	9 services paid for from the private funds of the Illinois
545	545	10 Prepaid Tuition Fund. As used in this subsection (l), "private
546	546	11 funds" means funds derived from deposits paid into the
547	547	12 Illinois Prepaid Tuition Trust Fund and the earnings thereon.
548	548	13 (m) This Code shall apply regardless of the source of
549	549	14 funds with which contracts are paid, including federal
550	550	15 assistance moneys. Except as specifically provided in this
551	551	16 Code, this Code shall not apply to procurement expenditures
552	552	17 necessary for the Department of Public Health to conduct the
553	553	18 Healthy Illinois Survey in accordance with Section 2310-431 of
554	554	19 the Department of Public Health Powers and Duties Law of the
555	555	20 Civil Administrative Code of Illinois.
