1515 1 AN ACT concerning liquor.
1616 2 Be it enacted by the People of the State of Illinois,
1717 3 represented in the General Assembly:
1818 4 Section 5. The Liquor Control Act of 1934 is amended by
1919 5 changing Section 5-1, 5-3, 6-9.10, and 6-9.15 and by adding
2020 6 Section 1-3.47 as follows:

115115 1 wine manufacturer's license.
116116 2 (a) A manufacturer's license shall allow the manufacture,
117117 3 importation in bulk, storage, distribution and sale of
118118 4 alcoholic liquor to persons without the State, as may be
119119 5 permitted by law and to licensees in this State as follows:
120120 6 Class 1. A Distiller may make sales and deliveries of
121121 7 alcoholic liquor to distillers, rectifiers, importing
122122 8 distributors, distributors and non-beverage users and to no
123123 9 other licensees.
124124 10 Class 2. A Rectifier, who is not a distiller, as defined
125125 11 herein, may make sales and deliveries of alcoholic liquor to
126126 12 rectifiers, importing distributors, distributors, retailers
127127 13 and non-beverage users and to no other licensees.
128128 14 Class 3. A Brewer may make sales and deliveries of beer to
129129 15 importing distributors and distributors and may make sales as
130130 16 authorized under subsection (e) of Section 6-4 of this Act,
131131 17 including any alcoholic liquor that subsection (e) of Section
132132 18 6-4 authorizes a brewer to sell in its original package only to
133133 19 a non-licensee for pick-up by a non-licensee either within the
134134 20 interior of the brewery premises or at outside of the brewery
135135 21 premises at a curb-side or parking lot adjacent to the brewery
136136 22 premises, subject to any local ordinance.
137137 23 Class 4. A first class wine-manufacturer may make sales
138138 24 and deliveries of up to 50,000 gallons of wine to
139139 25 manufacturers, importing distributors and distributors, and to

154154 4 gallons of beer per year, and shall not be a member of or

156156 6 produces more than 930,000 gallons of beer per year. If the
157157 7 first-class wine-manufacturer manufactures spirits, it shall
158158 8 also obtain and shall only be eligible for, in addition to any
159159 9 current license, a class 1 craft distiller license, shall not
160160 10 manufacture more than 50,000 gallons of spirits per year, and
161161 11 shall not be a member of or affiliated with, directly or
162162 12 indirectly, a manufacturer that produces more than 50,000
163163 13 gallons of spirits per year. A first-class wine-manufacturer
164164 14 shall be permitted to sell wine manufactured at the
165165 15 first-class wine-manufacturer premises to non-licensees.
166166 16 Class 5. A second class Wine manufacturer may make sales
167167 17 and deliveries of more than 50,000 gallons of wine to
168168 18 manufacturers, importing distributors and distributors and to
169169 19 no other licensees.
170170 20 Class 6. A first-class wine-maker's license shall allow
171171 21 the manufacture of up to 50,000 gallons of wine per year, and
172172 22 the storage and sale of such wine to distributors in the State
173173 23 and to persons without the State, as may be permitted by law. A
174174 24 person who, prior to June 1, 2008 (the effective date of Public
175175 25 Act 95-634), is a holder of a first-class wine-maker's license
176176 26 and annually produces more than 25,000 gallons of its own wine

202202 16 first-class wine-maker holding a class 1 brewer license or a
203203 17 class 1 craft distiller license shall not be eligible for a
204204 18 wine-maker's premises license but shall be permitted to sell
205205 19 wine manufactured at the first-class wine-maker premises to
206206 20 non-licensees.
207207 21 Class 7. A second-class wine-maker's license shall allow
208208 22 the manufacture of up to 150,000 gallons of wine per year, and
209209 23 the storage and sale of such wine to distributors in this State
210210 24 and to persons without the State, as may be permitted by law. A
211211 25 person who, prior to June 1, 2008 (the effective date of Public
212212 26 Act 95-634), is a holder of a second-class wine-maker's

223223 1 license and annually produces more than 25,000 gallons of its
224224 2 own wine and who distributes its wine to licensed retailers

233233 11 a second-class wine-maker manufactures spirits, it shall also
234234 12 obtain and shall only be eligible for, in addition to any
235235 13 current license, a class 2 craft distiller license, shall not
236236 14 manufacture more than 100,000 gallons of spirits per year, and
237237 15 shall not be a member of or affiliated with, directly or
238238 16 indirectly, a manufacturer that produces more than 100,000
239239 17 gallons of spirits per year.
240240 18 Class 8. A limited wine-manufacturer may make sales and
241241 19 deliveries not to exceed 40,000 gallons of wine per year to
242242 20 distributors, and to non-licensees in accordance with the
243243 21 provisions of this Act.
244244 22 Class 9. A craft distiller license, which may only be held
245245 23 by a class 1 craft distiller licensee or class 2 craft
246246 24 distiller licensee but not held by both a class 1 craft
247247 25 distiller licensee and a class 2 craft distiller licensee,
248248 26 shall grant all rights conveyed by either: (i) a class 1 craft

263263 5 Class 10. A class 1 craft distiller license, which may
264264 6 only be issued to a licensed craft distiller or licensed
265265 7 non-resident dealer, shall allow the manufacture of up to
266266 8 50,000 gallons of spirits per year provided that the class 1
267267 9 craft distiller licensee does not manufacture more than a
268268 10 combined 50,000 gallons of spirits per year and is not a member
269269 11 of or affiliated with, directly or indirectly, a manufacturer
270270 12 that produces more than 50,000 gallons of spirits per year. If
271271 13 a class 1 craft distiller manufactures beer, it shall also
272272 14 obtain and shall only be eligible for, in addition to any
273273 15 current license, a class 1 brewer license, shall not
274274 16 manufacture more than 930,000 gallons of beer per year, and
275275 17 shall not be a member of or affiliated with, directly or
276276 18 indirectly, a manufacturer that produces more than 930,000
277277 19 gallons of beer per year. If a class 1 craft distiller
278278 20 manufactures wine, it shall also obtain and shall only be
279279 21 eligible for, in addition to any current license, a
280280 22 first-class wine-manufacturer license or a first-class
281281 23 wine-maker's license, shall not manufacture more than 50,000
282282 24 gallons of wine per year, and shall not be a member of or
283283 25 affiliated with, directly or indirectly, a manufacturer that

295295 1 craft distiller licensee may make sales and deliveries to
296296 2 importing distributors and distributors and to retail
297297 3 licensees in accordance with the conditions set forth in
298298 4 paragraph (19) of subsection (a) of Section 3-12 of this Act.
299299 5 However, the aggregate amount of spirits sold to non-licensees
300300 6 and sold or delivered to retail licensees may not exceed 5,000
301301 7 gallons per year.
302302 8 A class 1 craft distiller licensee may sell up to 5,000
303303 9 gallons of such spirits to non-licensees to the extent
304304 10 permitted by any exemption approved by the State Commission
305305 11 pursuant to Section 6-4 of this Act. A class 1 craft distiller
306306 12 license holder may store such spirits at a non-contiguous
307307 13 licensed location, but at no time shall a class 1 craft
308308 14 distiller license holder directly or indirectly produce in the
309309 15 aggregate more than 50,000 gallons of spirits per year.
310310 16 A class 1 craft distiller licensee may hold more than one
311311 17 class 1 craft distiller's license. However, a class 1 craft
312312 18 distiller that holds more than one class 1 craft distiller
313313 19 license shall not manufacture, in the aggregate, more than
314314 20 50,000 gallons of spirits by distillation per year and shall
315315 21 not sell, in the aggregate, more than 5,000 gallons of such
316316 22 spirits to non-licensees in accordance with an exemption
317317 23 approved by the State Commission pursuant to Section 6-4 of
318318 24 this Act.
319319 25 Class 11. A class 2 craft distiller license, which may
320320 26 only be issued to a licensed craft distiller or licensed

346346 16 second-class wine-maker's license, shall not manufacture more
347347 17 than 150,000 gallons of wine per year, and shall not be a
348348 18 member of or affiliated with, directly or indirectly, a
349349 19 manufacturer that produces more than 150,000 gallons of wine
350350 20 per year. A class 2 craft distiller licensee may make sales and
351351 21 deliveries to importing distributors and distributors, but
352352 22 shall not make sales or deliveries to any other licensee. If
353353 23 the State Commission provides prior approval, a class 2 craft
354354 24 distiller licensee may annually transfer up to 100,000 gallons
355355 25 of spirits manufactured by that class 2 craft distiller

373373 7 annual permitted production limit; (iii) all spirits
374374 8 transferred shall be subject to Article VIII of this Act; (iv)
375375 9 a written record shall be maintained by the distiller and
376376 10 distilling pub specifying the amount, date of delivery, and
377377 11 receipt of the product by the distilling pub; and (v) the
378378 12 distilling pub shall be located no farther than 80 miles from
379379 13 the class 2 craft distiller's licensed location.
380380 14 A class 2 craft distiller shall, prior to transferring
381381 15 spirits to a distilling pub wholly owned by the class 2 craft
382382 16 distiller, furnish a written notice to the State Commission of
383383 17 intent to transfer spirits setting forth the name and address
384384 18 of the distilling pub and shall annually submit to the State
385385 19 Commission a verified report identifying the total gallons of
386386 20 spirits transferred to the distilling pub wholly owned by the
387387 21 class 2 craft distiller.
388388 22 A class 2 craft distiller license holder may store such
389389 23 spirits at a non-contiguous licensed location, but at no time
390390 24 shall a class 2 craft distiller license holder directly or
391391 25 indirectly produce in the aggregate more than 100,000 gallons

418418 16 only be eligible for, in addition to any current license, a
419419 17 first-class wine-manufacturer license or a first-class
420420 18 wine-maker's license, shall not manufacture more than 50,000
421421 19 gallons of wine per year, and shall not be a member of or
422422 20 affiliated with, directly or indirectly, a manufacturer that
423423 21 produces more than 50,000 gallons of wine per year. A class 1
424424 22 brewer licensee may make sales and deliveries to importing
425425 23 distributors and distributors and to retail licensees in
426426 24 accordance with the conditions set forth in paragraph (18) of
427427 25 subsection (a) of Section 3-12 of this Act. If the State

484484 10 amount transferred shall reduce the brew pub's annual

486486 12 be subject to Article VIII of this Act; (iv) a written record
487487 13 shall be maintained by the brewer and brew pub specifying the
488488 14 amount, date of delivery, and receipt of the product by the
489489 15 brew pub; and (v) the brew pub shall be located no farther than
490490 16 80 miles from the class 2 brewer's licensed location.
491491 17 A class 2 brewer shall, prior to transferring beer to a
492492 18 brew pub wholly owned by the class 2 brewer, furnish a written
493493 19 notice to the State Commission of intent to transfer beer
494494 20 setting forth the name and address of the brew pub and shall
495495 21 annually submit to the State Commission a verified report
496496 22 identifying the total gallons of beer transferred to the brew
497497 23 pub wholly owned by the class 2 brewer.
498498 24 Class 14. A class 3 brewer license, which may be issued to
499499 25 a brewer or a non-resident dealer, shall allow the manufacture
500500 26 of no more than 465,000 gallons of beer per year and no more

523523 13 paragraph (20) of subsection (a) of Section 3-12. If the State
524524 14 Commission provides prior approval, a class 3 brewer may
525525 15 annually transfer up to 155,000 gallons of beer manufactured
526526 16 by that class 3 brewer to the premises of a licensed class 3
527527 17 brewer wholly owned and operated by the same licensee. A class
528528 18 3 brewer shall manufacture beer at the brewer's class 3
529529 19 designated licensed premises, and may sell beer as otherwise
530530 20 provided in this Act.
531531 21 (a-1) A manufacturer which is licensed in this State to
532532 22 make sales or deliveries of alcoholic liquor to licensed
533533 23 distributors or importing distributors and which enlists
534534 24 agents, representatives, or individuals acting on its behalf
535535 25 who contact licensed retailers on a regular and continual
536536 26 basis in this State must register those agents,

549549 3 Registration of agents, representatives, or persons acting
550550 4 on behalf of a manufacturer is fulfilled by submitting a form
551551 5 to the Commission. The form shall be developed by the
552552 6 Commission and shall include the name and address of the
553553 7 applicant, the name and address of the manufacturer he or she
554554 8 represents, the territory or areas assigned to sell to or
555555 9 discuss pricing terms of alcoholic liquor, and any other
556556 10 questions deemed appropriate and necessary. All statements in
557557 11 the forms required to be made by law or by rule shall be deemed
558558 12 material, and any person who knowingly misstates any material
559559 13 fact under oath in an application is guilty of a Class B
560560 14 misdemeanor. Fraud, misrepresentation, false statements,
561561 15 misleading statements, evasions, or suppression of material
562562 16 facts in the securing of a registration are grounds for
563563 17 suspension or revocation of the registration. The State
564564 18 Commission shall post a list of registered agents on the
565565 19 Commission's website.
566566 20 (b) A distributor's license shall allow (i) the wholesale
567567 21 purchase and storage of alcoholic liquors and sale of
568568 22 alcoholic liquors to licensees in this State and to persons
569569 23 without the State, as may be permitted by law; (ii) the sale of
570570 24 beer, cider, mead, or any combination thereof to brewers,
571571 25 class 1 brewers, and class 2 brewers that, pursuant to
572572 26 subsection (e) of Section 6-4 of this Act, sell beer, cider,

587587 5 vermouth, or both spirits and vermouth to non-licensees at
588588 6 their distilleries; or (iv) as otherwise provided in this Act.
589589 7 No person licensed as a distributor shall be granted a
590590 8 non-resident dealer's license.
591591 9 (c) An importing distributor's license may be issued to
592592 10 and held by those only who are duly licensed distributors,
593593 11 upon the filing of an application by a duly licensed
594594 12 distributor, with the Commission and the Commission shall,
595595 13 without the payment of any fee, immediately issue such
596596 14 importing distributor's license to the applicant, which shall
597597 15 allow the importation of alcoholic liquor by the licensee into
598598 16 this State from any point in the United States outside this
599599 17 State, and the purchase of alcoholic liquor in barrels, casks
600600 18 or other bulk containers and the bottling of such alcoholic
601601 19 liquors before resale thereof, but all bottles or containers
602602 20 so filled shall be sealed, labeled, stamped and otherwise made
603603 21 to comply with all provisions, rules and regulations governing
604604 22 manufacturers in the preparation and bottling of alcoholic
605605 23 liquors. The importing distributor's license shall permit such
606606 24 licensee to purchase alcoholic liquor from Illinois licensed
607607 25 non-resident dealers and foreign importers only. No person
608608 26 licensed as an importing distributor shall be granted a

620620 2 (d) A retailer's license shall allow the licensee to sell
621621 3 and offer for sale at retail, only in the premises specified in
622622 4 the license, alcoholic liquor for use or consumption, but not
623623 5 for resale in any form. Except as provided in Section 6-16,
624624 6 6-29, or 6-29.1, nothing in this Act shall deny, limit,
625625 7 remove, or restrict the ability of a holder of a retailer's
626626 8 license to transfer or ship alcoholic liquor to the purchaser
627627 9 for use or consumption subject to any applicable local law or
628628 10 ordinance. For the purposes of this Section, "shipping" means
629629 11 the movement of alcoholic liquor from a licensed retailer to a
630630 12 consumer via a common carrier. Except as provided in Section
631631 13 6-16, 6-29, or 6-29.1, nothing in this Act shall deny, limit,
632632 14 remove, or restrict the ability of a holder of a retailer's
633633 15 license to deliver alcoholic liquor to the purchaser for use
634634 16 or consumption. The delivery shall be made only within 12
635635 17 hours from the time the alcoholic liquor leaves the licensed
636636 18 premises of the retailer for delivery. For the purposes of
637637 19 this Section, "delivery" means the movement of alcoholic
638638 20 liquor purchased from a licensed retailer to a consumer
639639 21 through the following methods:
640640 22 (1) delivery within licensed retailer's parking lot,
641641 23 including curbside, for pickup by the consumer;
642642 24 (2) delivery by an owner, officer, director,
643643 25 shareholder, or employee of the licensed retailer; or
644644 26 (3) delivery by a third-party contractor, independent

660660 6 permit the manufacturer to sell beer at retail on the premises
661661 7 actually occupied by the manufacturer. For the purpose of
662662 8 further describing the type of business conducted at a retail
663663 9 licensed premises, a retailer's licensee may be designated by
664664 10 the State Commission as (i) an on premise consumption
665665 11 retailer, (ii) an off premise sale retailer, or (iii) a
666666 12 combined on premise consumption and off premise sale retailer.
667667 13 Except for a municipality with a population of more than
668668 14 1,000,000 inhabitants, a home rule unit may not regulate the
669669 15 delivery of alcoholic liquor inconsistent with this
670670 16 subsection. This paragraph is a limitation under subsection
671671 17 (i) of Section 6 of Article VII of the Illinois Constitution on
672672 18 the concurrent exercise by home rule units of powers and
673673 19 functions exercised by the State. A non-home rule municipality
674674 20 may not regulate the delivery of alcoholic liquor inconsistent
675675 21 with this subsection.
676676 22 Notwithstanding any other provision of this subsection
677677 23 (d), a retail licensee may sell alcoholic liquors to a special
678678 24 event retailer licensee for resale to the extent permitted
679679 25 under subsection (e).

704704 14 Act, (B) a current, valid exemption identification number
705705 15 issued under Section 1g of the Retailers' Occupation Tax Act,
706706 16 and a certification to the Commission that the purchase of
707707 17 alcoholic liquors will be a tax-exempt purchase, or (C) a
708708 18 statement that the applicant is not registered under Section
709709 19 2a of the Retailers' Occupation Tax Act, does not hold a resale
710710 20 number under Section 2c of the Retailers' Occupation Tax Act,
711711 21 and does not hold an exemption number under Section 1g of the
712712 22 Retailers' Occupation Tax Act, in which event the Commission
713713 23 shall set forth on the special event retailer's license a
714714 24 statement to that effect; (ii) submit with the application
715715 25 proof satisfactory to the State Commission that the applicant

735735 9 the conclusion of the event specified in the license.
736736 10 (f) A railroad license shall permit the licensee to import
737737 11 alcoholic liquors into this State from any point in the United
738738 12 States outside this State and to store such alcoholic liquors
739739 13 in this State; to make wholesale purchases of alcoholic
740740 14 liquors directly from manufacturers, foreign importers,
741741 15 distributors and importing distributors from within or outside
742742 16 this State; and to store such alcoholic liquors in this State;
743743 17 provided that the above powers may be exercised only in
744744 18 connection with the importation, purchase or storage of
745745 19 alcoholic liquors to be sold or dispensed on a club, buffet,
746746 20 lounge or dining car operated on an electric, gas or steam
747747 21 railway in this State; and provided further, that railroad
748748 22 licensees exercising the above powers shall be subject to all
749749 23 provisions of Article VIII of this Act as applied to importing
750750 24 distributors. A railroad license shall also permit the
751751 25 licensee to sell or dispense alcoholic liquors on any club,
752752 26 buffet, lounge or dining car operated on an electric, gas or

844844 10 alcoholic liquors directly from manufacturers, foreign
845845 11 importers, distributors and importing distributors from within
846846 12 or outside this State; and to store such alcoholic liquors in
847847 13 this State; provided that the above powers may be exercised
848848 14 only in connection with the importation, purchase or storage
849849 15 of alcoholic liquors to be sold or dispensed on an airplane;
850850 16 and provided further, that airplane licensees exercising the
851851 17 above powers shall be subject to all provisions of Article
852852 18 VIII of this Act as applied to importing distributors. An
853853 19 airplane licensee shall also permit the sale or dispensing of
854854 20 alcoholic liquors on any passenger airplane regularly operated
855855 21 by a common carrier in this State, but shall not permit the
856856 22 sale for resale of any alcoholic liquors to any licensee
857857 23 within this State. A single airplane license shall be required
858858 24 of an airline company if liquor service is provided on board
859859 25 aircraft in this State. The annual fee for such license shall
860860 26 be as determined in Section 5-3.

883883 13 (iii) the foreign importer complies with the provisions of
884884 14 Sections 6-5 and 6-6 of this Act to the same extent that these
885885 15 provisions apply to manufacturers.
886886 16 (l) (i) A broker's license shall be required of all
887887 17 persons who solicit orders for, offer to sell or offer to
888888 18 supply alcoholic liquor to retailers in the State of Illinois,
889889 19 or who offer to retailers to ship or cause to be shipped or to
890890 20 make contact with distillers, craft distillers, rectifiers,
891891 21 brewers or manufacturers or any other party within or without
892892 22 the State of Illinois in order that alcoholic liquors be
893893 23 shipped to a distributor, importing distributor or foreign
894894 24 importer, whether such solicitation or offer is consummated
895895 25 within or without the State of Illinois.

907907 1 Liquor Control Commission shall purchase or receive any

909909 3 for sale to such retailer by a broker unless the broker is the

911911 5 The broker shall, upon the acceptance by a retailer of the
912912 6 broker's solicitation of an order or offer to sell or supply or
913913 7 deliver or have delivered alcoholic liquors, promptly forward
914914 8 to the Illinois Liquor Control Commission a notification of
915915 9 said transaction in such form as the Commission may by
916916 10 regulations prescribe.
917917 11 (ii) A broker's license shall be required of a person
918918 12 within this State, other than a retail licensee, who, for a fee
919919 13 or commission, promotes, solicits, or accepts orders for
920920 14 alcoholic liquor, for use or consumption and not for resale,
921921 15 to be shipped from this State and delivered to residents
922922 16 outside of this State by an express company, common carrier,
923923 17 or contract carrier. This Section does not apply to any person
924924 18 who promotes, solicits, or accepts orders for wine as
925925 19 specifically authorized in Section 6-29 of this Act.
926926 20 A broker's license under this subsection (l) shall not
927927 21 entitle the holder to buy or sell any alcoholic liquors for his
928928 22 own account or to take or deliver title to such alcoholic
929929 23 liquors.
930930 24 This subsection (l) shall not apply to distributors,
931931 25 employees of distributors, or employees of a manufacturer who
932932 26 has registered the trademark, brand or name of the alcoholic

953953 11 importing distributors and to no one else in this State;
954954 12 provided that (i) said non-resident dealer shall register with
955955 13 the Illinois Liquor Control Commission each and every brand of
956956 14 alcoholic liquor which it proposes to sell to Illinois
957957 15 licensees during the license period, (ii) it shall comply with
958958 16 all of the provisions of Section 6-9 hereof with respect to
959959 17 registration of such Illinois licensees as may be granted the
960960 18 right to sell such brands at wholesale by duly filing such
961961 19 registration statement, thereby authorizing the non-resident
962962 20 dealer to proceed to sell such brands at wholesale, and (iii)
963963 21 the non-resident dealer shall comply with the provisions of
964964 22 Sections 6-5 and 6-6 of this Act to the same extent that these
965965 23 provisions apply to manufacturers. No person licensed as a
966966 24 non-resident dealer shall be granted a distributor's or
967967 25 importing distributor's license.
968968 26 (n) A brew pub license shall allow the licensee to only (i)

993993 15 Commission, annually transfer no more than 155,000 gallons of
994994 16 beer manufactured on the premises to a licensed brew pub
995995 17 wholly owned and operated by the same licensee, and (vii)
996996 18 notwithstanding item (i) of this subsection, brew pubs wholly
997997 19 owned and operated by the same licensee may combine each
998998 20 location's production limit of 155,000 gallons of beer per
999999 21 year and allocate the aggregate total between the wholly
10001000 22 owned, operated, and licensed locations.
10011001 23 A brew pub licensee shall not under any circumstance sell

10291029 15 1, 2015 may (i) continue to qualify for and hold that brew pub

10701070 20 (o) A caterer retailer license shall allow the holder to
10711071 21 serve alcoholic liquors as an incidental part of a food

11071107 21 retailer premises at the conclusion of an off-site event or
11081108 22 engage a distributor or importing distributor to transfer any

11391139 17 (q) A special use permit license shall allow an Illinois
11401140 18 licensed retailer to transfer a portion of its alcoholic
11411141 19 liquor inventory from its retail licensed premises to the
11421142 20 premises specified in the license hereby created; to purchase
11431143 21 alcoholic liquor from a distributor or importing distributor
11441144 22 to be delivered directly to the location specified in the
11451145 23 license hereby created; and to sell or offer for sale at
11461146 24 retail, only in the premises specified in the license hereby

12111211 17 applicant for the license must provide the Commission with a
12121212 18 true copy of its current license in any state in which it is
12131213 19 licensed as a manufacturer of wine. An applicant for a winery
12141214 20 shipper's license must also complete an application form that
12151215 21 provides any other information the Commission deems necessary.
12161216 22 The application form shall include all addresses from which
12171217 23 the applicant for a winery shipper's license intends to ship
12181218 24 wine, including the name and address of any third party,
12191219 25 except for a common carrier, authorized to ship wine on behalf

12471247 17 with the State Commission as a supplement to the winery
12481248 18 shipper's license application or any renewal thereof. The
12491249 19 winery shipper's license holder shall affirm under penalty of
12501250 20 perjury, as part of the winery shipper's license application
12511251 21 or renewal, that he or she only ships wine, either directly or
12521252 22 indirectly through a third-party provider, from the licensee's
12531253 23 own production.
12541254 24 Except for a common carrier, a third-party provider

13171317 15 carrier, that has been deemed by the State Commission to have
13181318 16 violated the provisions of this Act with regard to any winery
13191319 17 shipper licensee.
13201320 18 A winery shipper licensee must pay to the Department of
13211321 19 Revenue the State liquor gallonage tax under Section 8-1 for
13221322 20 all wine that is sold by the licensee and shipped to a person
13231323 21 in this State. For the purposes of Section 8-1, a winery
13241324 22 shipper licensee shall be taxed in the same manner as a
13251325 23 manufacturer of wine. A licensee who is not otherwise required
13261326 24 to register under the Retailers' Occupation Tax Act must
13271327 25 register under the Use Tax Act to collect and remit use tax to
13281328 26 the Department of Revenue for all gallons of wine that are sold

13421342 4 the winery shipper's license shall be revoked in accordance
13431343 5 with the provisions of Article VII of this Act. If a licensee
13441344 6 fails to properly register and remit tax under the Use Tax Act
13451345 7 or the Retailers' Occupation Tax Act for all wine that is sold
13461346 8 by the winery shipper and shipped to persons in this State, the
13471347 9 winery shipper's license shall be revoked in accordance with
13481348 10 the provisions of Article VII of this Act.
13491349 11 A winery shipper licensee must collect, maintain, and
13501350 12 submit to the Commission on a semi-annual basis the total
13511351 13 number of cases per resident of wine shipped to residents of
13521352 14 this State. A winery shipper licensed under this subsection
13531353 15 (r) must comply with the requirements of Section 6-29 of this
13541354 16 Act.
13551355 17 Pursuant to paragraph (5.1) or (5.3) of subsection (a) of
13561356 18 Section 3-12, the State Commission may receive, respond to,
13571357 19 and investigate any complaint and impose any of the remedies
13581358 20 specified in paragraph (1) of subsection (a) of Section 3-12.
13591359 21 As used in this subsection, "third-party provider" means
13601360 22 any entity that provides fulfillment house services, including
13611361 23 warehousing, packaging, distribution, order processing, or
13621362 24 shipment of wine, but not the sale of wine, on behalf of a
13631363 25 licensed winery shipper.

13881388 14 (t) A brewer warehouse permit may be issued to the holder
13891389 15 of a class 1 brewer license or a class 2 brewer license. If the
13901390 16 holder of the permit is a class 1 brewer licensee, the brewer
13911391 17 warehouse permit shall allow the holder to store or warehouse
13921392 18 up to 930,000 gallons of tax-determined beer manufactured by
13931393 19 the holder of the permit at the premises specified on the
13941394 20 permit. If the holder of the permit is a class 2 brewer
13951395 21 licensee, the brewer warehouse permit shall allow the holder
13961396 22 to store or warehouse up to 3,720,000 gallons of
13971397 23 tax-determined beer manufactured by the holder of the permit
13981398 24 at the premises specified on the permit. Sales to
13991399 25 non-licensees are prohibited at the premises specified in the

14301430 20 A distilling pub licensee shall not under any circumstance
14311431 21 sell or offer for sale spirits manufactured by the distilling
14321432 22 pub licensee to retail licensees.
14331433 23 A person who holds a class 2 craft distiller license may

14621462 16 (w) A beer showcase permit license shall allow an
14631463 17 Illinois-licensed distributor to transfer a portion of its
14641464 18 beer inventory from its licensed premises to the premises
14651465 19 specified in the beer showcase permit license, and, in the
14661466 20 case of a class 3 brewer, transfer only beer the class 3 brewer

17811781 13 Sec. 6-9.10. Cooperative purchasing agreements.
17821782 14 (a) A cooperative purchasing agreement shall only be valid
17831783 15 if the following conditions are met:
17841784 16 (1) the agreement is in writing and signed by all
17851785 17 parties to the agreement;
17861786 18 (2) the agreement contains the complete license
17871787 19 information for all parties to the agreement, including
17881788 20 State and local license numbers and expiration dates as
17891789 21 well as the date on which the retail member joined the
17901790 22 cooperative purchase group;
17911791 23 (3) a retail licensee that is a party to the agreement
17921792 24 must not be a party to any other related cooperative

18041804 1 (4) the agreement identifies and designates the name

18081808 5 (5) a copy of the executed agreement, including any
18091809 6 amendments, deletions, or additions, is kept on the
18101810 7 premises of each party to the agreement for a period of 3

18121812 9 (6) a copy of the executed agreement, including any
18131813 10 amendments, deletions, or additions, is delivered to the
18141814 11 relevant licensee with distribution privileges and to the
18151815 12 State Commission before making any purchases under the
18161816 13 agreement; any amendments, deletions, or additions must be
18171817 14 submitted to the State Commission within 7 business days
18181818 15 after the amendment, deletion, or addition is executed;
18191819 16 and
18201820 17 (7) the agreement must designate whether the
18211821 18 cooperative purchase purchasing group is comprised of
18221822 19 retail licenses engaged in the sale of wine or spirits on
18231823 20 or off the premises.
18241824 21 (b) A retail licensee may, pursuant to a cooperative
18251825 22 purchasing agreement, make purchases as a member of a
18261826 23 cooperative purchase group or independently of any such group.
18271827 24 Nothing in this Section or any other Section of this Act shall
18281828 25 be construed to prohibit commonly or not commonly owned retail
18291829 26 licensees from making purchases separate and apart from any

18401840 1 membership in a cooperative purchase group.
18411841 2 (c) A retailer may only be a member of one cooperative
18421842 3 purchase group at a time. A retail licensee may change to a
18431843 4 different cooperative purchase group no more than twice in a
18441844 5 12-month period. However, if an existing cooperative purchase
18451845 6 group member purchases a retail location from a member of
18461846 7 another cooperative purchase group, the new owner of the
18471847 8 retail location may move the membership of the retail licensee
18481848 9 to a different cooperative purchase purchasing group.
18491849 10 (d) When a retail licensee joins an existing cooperative
18501850 11 purchase purchasing group, the new member must be a member for
18511851 12 a period of 7 days before being able to participate in any
18521852 13 quantity discount programs.
18531853 14 (e) Cooperative purchase purchasing group members must be
18541854 15 either all on-premises retail licensees or all off-premises
18551855 16 retail licensees. A licensee with a combined on-premises and
18561856 17 off-premises license may make purchases for on-premises use
18571857 18 only through an on-premises cooperative purchase group and may
18581858 19 make purchases for off-premises use only through an
18591859 20 off-premises cooperative purchase group.
18601860 21 (f) Any individual retail licensee that is a member of a
18611861 22 cooperative purchase group that fails to comply with the terms
18621862 23 and conditions of this Section may be deemed to be in violation
18631863 24 of Section 6-5. Any distributor or importing distributor that
18641864 25 fails to comply with this Section may be deemed to be in
18651865 26 violation of Section 6-5.

18761876 1 (g) The State Commission shall keep a list of the members
18771877 2 of each cooperative purchase group and shall make that list

18791879 4 (h) A retail licensee that is a member of a cooperative
18801880 5 purchase group shall not have an ownership interest, directly
18811881 6 or indirectly, in any entity licensed by this Act other than a
18821882 7 retailer.
18831883 8 (i) It is unlawful for a distributor or importing
18841884 9 distributor to furnish, give, or lend money or anything of
18851885 10 value to a cooperative agent.
18861886 11 (j) It is the duty of each retail licensee of the
18871887 12 cooperative purchase group to make books and records available
18881888 13 upon reasonable notice for the purpose of investigation and
18891889 14 control by the State Commission or any local liquor control
18901890 15 commission having jurisdiction over the retail licensee of the
18911891 16 cooperative purchase group.
18921892 17 (k) A cooperative agent shall not have an ownership
18931893 18 interest, directly or indirectly, in an entity licensed under
18941894 19 any other license category under this Act.
18951895 20 (l) A retailer, manufacturer, importing distributor,
18961896 21 distributor, cooperative purchase group, or cooperative agent
18971897 22 shall remain in compliance with federal law pursuant to the
18981898 23 prohibitions and exceptions provided in 27 CFR Part 6 and any
18991899 24 promulgated rules thereof. Cooperative purchase groups,
19001900 25 cooperative agents, and the cooperative agents' owners,
19011901 26 officers, principals, employees, and their spouse may not A

19201920 9 provide services to, or have an ownership interest, whether
19211921 10 direct or indirect, in any business or enterprise that
19221922 11 provides marketing services or activities on behalf of
19231923 12 manufacturers, non-resident dealers, foreign importers,
19241924 13 importing distributors, or distributors. Cooperative purchase
19251925 14 groups, cooperative agents, and the cooperative agents'
19261926 15 owners, principals, employees, and their respective spouses
19271927 16 are strictly prohibited from, directly or indirectly,
19281928 17 accepting things of value from, or providing marketing
19291929 18 services or activities on behalf of, manufacturers,
19301930 19 non-resident dealers, foreign importers, importing
19311931 20 distributors, and distributors. Cooperative agents and
19321932 21 cooperative purchase groups, as agents of retail licensees,
19331933 22 are subject to the obligations and restrictions of retail
19341934 23 licensees, including, but not limited to, Section 6-5, Section
19351935 24 6-6, Section 10-3, and 11 Ill. Adm. Code 100.500.
19361936 25 (m) It is the duty of every cooperative agent and

19561956 9 (a) All wine or spirits quantity discount programs offered
19571957 10 to consumption off the premises retailers must be offered to
19581958 11 all consumption off the premises cooperative groups and
19591959 12 cooperative agents, and all quantity discount programs offered
19601960 13 to consumption on the premises retailers shall be offered to
19611961 14 all consumption on the premises cooperative groups and
19621962 15 cooperative agents. Quantity discount programs shall:
19631963 16 (1) be open and available for acceptance for 7
19641964 17 business days;
19651965 18 (2) be designed and implemented to produce product
19661966 19 volume growth with retail licensees;
19671967 20 (3) be based on the volume of product purchased;
19681968 21 however, discounts may include price reductions, cash, and
19691969 22 credits, and no-charge wine or spirits products may be
19701970 23 given instead of a discount;
19711971 24 (4) be documented on related sales invoices or credit

19921992 10 (b) A distributor or importing distributor that makes
19931993 11 quantity discount sales to participating members of a
19941994 12 cooperative purchase group shall issue customary invoices to
19951995 13 each participating retail licensee itemizing the wine or
19961996 14 spirit sold and delivered as part of a quantity discount
19971997 15 program to each participating retail licensee.
19981998 16 (c) If a distributor or importing distributor offers a
19991999 17 quantity discount for wine or spirits, excluding any product
20002000 18 fermented with malt or any substitute for malt, cooperative
20012001 19 purchase groups shall purchase a minimum of 250 cases in each
20022002 20 quantity discount program. Each individual participating
20032003 21 member of a cooperative purchase group purchasing product
20042004 22 through a quantity discount program may be required to
20052005 23 purchase the following minimum amounts:
20062006 24 (1) 2% of cases of any quantity discount program of
20072007 25 500 or fewer cases.

20332033 15 (e) Each distributor or importing distributor shall
20342034 16 separately invoice each participating cooperative purchase
20352035 17 group member for the purchase made on behalf of such

20372037 19 (f) A cooperative purchase purchasing group shall maintain
20382038 20 the records of each cooperative purchase order placed for 90
20392039 21 days. The records shall include:
20402040 22 (1) the date the cooperative purchase purchasing group
20412041 23 order was placed and the date of any amendments to the
20422042 24 order;

20632063 9 (g) A cooperative purchase group is subject to the books

20652065 11 11 Ill. Adm. Code 100.130.
20662066 12 (h) A cooperative purchase purchasing group shall retain a
20672067 13 surety bond in favor of each distributor with which it
20682068 14 conducts business at all times for no less than $250,000. The
20692069 15 bond shall provide a street address at which bond claims may be
20702070 16 submitted. If a cooperative purchase purchasing group member
20712071 17 is delinquent in payment pursuant to Section 6-5 on a purchase
20722072 18 made through a cooperative purchase group or directly between
20732073 19 the cooperative member and a distributor, the surety shall
20742074 20 immediately pay the importing distributor or distributor the
20752075 21 delinquent amount, unless the delinquent member submits a bona
20762076 22 fide dispute to the State Commission within 5 business days.
20772077 23 The surety bond required by this Section may be acquired from a
20782078 24 company, agent, or broker of the cooperative purchase group's
20792079 25 choice. If the surety bond does not cure the indebtedness
