11	11	1 AN ACT concerning health.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 5. The Vital Records Act is amended by changing
15	15	5 Section 25.4 as follows:
16	16	6 (410 ILCS 535/25.4)
17	17	7 Sec. 25.4. Youth in care birth record request.
18	18	8 (a) For the purposes of this Section, an individual's
19	19	9 status as a youth in care may be verified:
20	20	10 (1) with a copy of the court order placing the youth in
21	21	11 the guardianship or custody of the Department of Children
22	22	12 and Family Services or terminating the Department of
23	23	13 Children and Family Services' guardianship or custody of
24	24	14 the youth; or
25	25	15 (2) by a human services agency, legal services agency,
26	26	16 or other similar agency that has knowledge of the
27	27	17 individual's youth in care status, including, but not
28	28	18 limited to:
29	29	19 (A) a child welfare agency, including the
30	30	20 Department of Children and Family Services; or
31	31	21 (B) the attorney or guardian ad litem who served
32	32	22 as the youth in care's attorney or guardian ad litem
33	33	23 during proceedings under the Juvenile Court Act of

69	69	2 A person described in subsection (b) of this Section must
70	70	3 not be charged for verification under this Section.
71	71	4 A person who knowingly or purposefully falsifies this
72	72	5 verification is subject to a penalty of $100.
73	73	6 (b) The applicable fees under Section 17 for a new
74	74	7 certificate of birth and under Section 25 of this Act for a
75	75	8 search for a birth record or a certified copy of a birth record
76	76	9 shall be waived for all requests made by:
77	77	10 (1) a youth in care, as defined in Section 4d of the
78	78	11 Children and Family Services Act, whose status is verified
79	79	12 under subsection (a) of this Section; or
80	80	13 (2) a person under the age of 27 who was a youth in
81	81	14 care, as defined in Section 4d of the Children and Family
82	82	15 Services Act, on or after his or her 18th birthday and
83	83	16 whose status is verified under subsection (a) of this
84	84	17 Section.
85	85	18 The State Registrar of Vital Records shall establish
86	86	19 standards and procedures consistent with this Section for
87	87	20 waiver of the applicable fees. The State Registrar of Vital
88	88	21 Records, in conjunction with the Department of Children and
89	89	22 Family Services, shall establish standards and procedures for
90	90	23 youth in care, former youth in care, and the legal guardians of
91	91	24 youth in care to request the birth record of the youth in care
92	92	25 when the applicant does not have all of the information
93	93	26 necessary to complete the application for a new certificate of
