1919 1 AN ACT concerning education.
2020 2 Be it enacted by the People of the State of Illinois,
2121 3 represented in the General Assembly:
2222 4 Section 5. The Underserved Health Care Provider Workforce
2323 5 Act is amended by changing Sections 3.04, 3.07, 3.08, 3.09,
2424 6 3.10, 4.03, and 10 and by adding Section 3.12 as follows:
2525 7 (110 ILCS 935/3.04) (from Ch. 144, par. 1453.04)
2626 8 Sec. 3.04. "Designated Shortage Area" means an area
2727 9 designated as by the Director as a physician shortage area, a
2828 10 medically underserved area, or a health professional shortage
2929 11 area critical health manpower shortage area as defined by the
3030 12 United States Department of Health and Human Services ,
3131 13 Education and Welfare, or as further defined by the Department
3232 14 to enable it to effectively fulfill the purpose stated in
3333 15 Section 2 of this Act. Such areas may include the following:
3434 16 (a) an urban or rural area which is a rational area for
3535 17 the delivery of health services;
3636 18 (b) a population group;
3737 19 (c) a public or nonprofit private medical facility; or
3838 20 (d) a government-owned, privately owned, independent,
3939 21 or provider-based Rural Health Clinic or hospital that
4040 22 accepts Medicaid, Medicare, the State's Children's Health
4141 23 Insurance Program, private insurance, and self-pay.

9494 3 Sec. 3.07. "Eligible medical student" means a person who
9595 4 meets all of the following qualifications:
9696 5 (a) he or she is an Illinois resident at the time of
9797 6 application for a scholarship under the program
9898 7 established by this Act;
9999 8 (b) he or she is studying medicine in a medical school
100100 9 located in Illinois, or studying chiropractic medicine in
101101 10 a chiropractic college or institution in Illinois, or
102102 11 studying optometry in an optometry college or institution
103103 12 located in Illinois;
104104 13 (c) he or she exhibits financial need as determined by
105105 14 the Department; and
106106 15 (d) he or she agrees to practice full-time in a
107107 16 Designated Shortage Area as a primary care physician,
108108 17 general surgeon, emergency medicine physician,
109109 18 obstetrician, optometrist, anesthesiologist, or
110110 19 chiropractic physician one year for each year he or she is
111111 20 a scholarship recipient.

173173 14 Department a sum equal to 3 times the amount of the annual
174174 15 scholarship or loan repayment grant for each year the
175175 16 recipient fails to fulfill such obligation. A scholarship or
176176 17 loan repayment recipient who fails to fulfill the obligation
177177 18 described in subsection (d) of Section 3.07 or Section 4.10
178178 19 shall have 30 days from the date on which that failure begins
179179 20 in which to enter into a contract with the Department that sets
180180 21 forth the manner in which that sum is required to be paid. If
181181 22 the contract is not entered into within that 30 day period or

193193 1 not made in the amounts and at the times provided in the
194194 2 contract, the scholarship or loan payment recipient also shall
195195 3 be required to pay to the Department interest at the rate of 9%
196196 4 per annum on the amount of that sum remaining due and unpaid.
197197 5 The amounts paid to the Department under this Section shall be
198198 6 deposited into the fund where the payment originated Community
199199 7 Health Center Care Fund and shall be used by the Department to
200200 8 improve access to primary health care services as authorized
201201 9 by subsection (a) of Section 2310-200 of the Department of
202202 10 Public Health Powers and Duties Law (20 ILCS 2310/2310-200).
203203 11 The Department may transfer to the Illinois Finance
204204 12 Authority, into an account outside the State treasury, moneys
205205 13 in the Community Health Center Care Fund as needed, but not to
206206 14 exceed an amount established, by rule, by the Department to
207207 15 establish a reserve or credit enhancement escrow account to
208208 16 support a financing program or a loan or equipment leasing
209209 17 program to provide moneys to support the purposes of
210210 18 subsection (a) of Section 2310-200 of the Department of Public
211211 19 Health Powers and Duties Law (20 ILCS 2310/2310-200). The
212212 20 disposition of moneys at the conclusion of any financing
213213 21 program under this Section shall be determined by an
214214 22 interagency agreement.
