Chris Balkema SYNOPSIS AS INTRODUCED: 815 ILCS 325/4.1815 ILCS 325/4.4 Amends the Recyclable Metal Purchase Registration Law. Provides that provisions prohibiting the sale of certain recyclable metal materials shall not apply if the seller produces written documentation reasonably demonstrating that the seller is the owner of the recyclable metal material or is authorized to sell the recyclable metal material on behalf of the owner. Provides that the recyclable metal dealer shall copy the documentation provided by the seller and maintain the copy of the documentation along with the purchase records. Provides that the sale of a detached catalytic converter may occur at the fixed business address of the seller or of the recyclable metal dealer (rather than at the fixed business address of the licensed recyclable metal dealer). 1212 1 AN ACT concerning business.
1313 2 Be it enacted by the People of the State of Illinois,
1414 3 represented in the General Assembly:
1515 4 Section 5. The Recyclable Metal Purchase Registration Law
1616 5 is amended by changing Sections 4.1 and 4.4 as follows:
1717 6 (815 ILCS 325/4.1)
1818 7 Sec. 4.1. Restricted purchases.
1919 8 (a) It is a violation of this Act for any person to
2020 9 possess, purchase, attempt to purchase, sell or attempt to
2121 10 sell, or for any recyclable metal dealer to purchase or
2222 11 attempt to purchase, any of the following:
2323 12 (1) materials that are clearly marked as property
2424 13 belonging to a business or someone else other than the
2525 14 seller;
2626 15 (2) property associated with use by governments,
2727 16 utilities, or railroads including, but not limited to,
2828 17 guardrails, manhole covers, electric transmission and
2929 18 distribution equipment, including transformers, grounding
3030 19 straps, wires or poles, historical markers, street signs,
3131 20 traffic signs, sewer grates, or any rail, switch
3232 21 component, spike, angle bar, tie plate, or bolt of the
3333 22 type used in constructing railroad track;
3434 23 (3) cemetery plaques or ornaments; or

7171 1 (4) any catalytic converter or its contents not
7272 2 attached to a motor vehicle at the time of the transaction
7373 3 unless the seller is licensed as an automotive parts
7474 4 recycler or scrap processor.

7676 6 (c) This Section shall not apply if the seller produces
7777 7 written documentation reasonably demonstrating that the seller
7878 8 is the owner of the recyclable metal material or is authorized
7979 9 to sell the recyclable metal material on behalf of the owner.
8080 10 The recyclable metal dealer shall copy the documentation
8181 11 provided by the seller and maintain the copy of the
8282 12 documentation along with the purchase records required under
8383 13 Section 3.

8686 16 Sec. 4.4. Purchase of a catalytic converter or its
8787 17 contents.
8888 18 (a) It is unlawful for any person to purchase or otherwise
8989 19 acquire a used, detached catalytic converter or any nonferrous
9090 20 part thereof unless all of the following apply:
9191 21 (1) the person is a licensed recyclable metal dealer;
9292 22 (2) the sale or purchase occurs at the fixed business
9393 23 address of the seller or of the a licensed recyclable
9494 24 metal dealer that is a party to the transaction; and
9595 25 (3) the purchaser has maintained the information
