12	12	1 AN ACT concerning business.
13	13	2 Be it enacted by the People of the State of Illinois,
14	14	3 represented in the General Assembly:
15	15	4 Section 5. The Recyclable Metal Purchase Registration Law
16	16	5 is amended by changing Sections 4.1 and 4.4 as follows:
17	17	6 (815 ILCS 325/4.1)
18	18	7 Sec. 4.1. Restricted purchases.
19	19	8 (a) It is a violation of this Act for any person to
20	20	9 possess, purchase, attempt to purchase, sell or attempt to
21	21	10 sell, or for any recyclable metal dealer to purchase or
22	22	11 attempt to purchase, any of the following:
23	23	12 (1) materials that are clearly marked as property
24	24	13 belonging to a business or someone else other than the
25	25	14 seller;
26	26	15 (2) property associated with use by governments,
27	27	16 utilities, or railroads including, but not limited to,
28	28	17 guardrails, manhole covers, electric transmission and
29	29	18 distribution equipment, including transformers, grounding
30	30	19 straps, wires or poles, historical markers, street signs,
31	31	20 traffic signs, sewer grates, or any rail, switch
32	32	21 component, spike, angle bar, tie plate, or bolt of the
33	33	22 type used in constructing railroad track;
34	34	23 (3) cemetery plaques or ornaments; or

72	72	2 attached to a motor vehicle at the time of the transaction
73	73	3 unless the seller is licensed as an automotive parts

76	76	6 (c) This Section shall not apply if the seller produces
77	77	7 written documentation reasonably demonstrating that the seller
78	78	8 is the owner of the recyclable metal material or is authorized
79	79	9 to sell the recyclable metal material on behalf of the owner.
80	80	10 The recyclable metal dealer shall copy the documentation
81	81	11 provided by the seller and maintain the copy of the
82	82	12 documentation along with the purchase records required under
83	83	13 Section 3.

86	86	16 Sec. 4.4. Purchase of a catalytic converter or its
87	87	17 contents.
88	88	18 (a) It is unlawful for any person to purchase or otherwise
89	89	19 acquire a used, detached catalytic converter or any nonferrous
90	90	20 part thereof unless all of the following apply:
91	91	21 (1) the person is a licensed recyclable metal dealer;
92	92	22 (2) the sale or purchase occurs at the fixed business
93	93	23 address of the seller or of the a licensed recyclable
94	94	24 metal dealer that is a party to the transaction; and
95	95	25 (3) the purchaser has maintained the information
