11	11	1 AN ACT concerning local government.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 5. The Illinois Municipal Code is amended by
15	15	5 changing Section 5-2-19 as follows:

17	17	7 Sec. 5-2-19.
18	18	8 (a) In any city which was operating under the alderperson
19	19	9 form of government as provided in Article 3 at the time of
20	20	10 adoption of this Article 5 which did not also elect to continue
21	21	11 to choose alderpersons from wards, the city clerk and city
22	22	12 treasurer shall be nominated and elected in the same manner as
23	23	13 provided in this Article 5 for the nomination and election of
24	24	14 the mayor and councilmen. To achieve this result: wherever the
25	25	15 term "mayor or commissioners" appears in Sections 4-3-7
26	26	16 through 4-3-18, it shall be construed to include the words "or
27	27	17 clerk or treasurer". The names of candidates for nomination
28	28	18 shall be placed on the primary election ballot prescribed in
29	29	19 Section 5-2-13 and such ballot shall be modified to include
30	30	20 the heading "For Clerk--Vote for one" immediately following
31	31	21 the names of candidates for councilmen and to include the
32	32	22 heading "For Treasurer--Vote for one" immediately following
33	33	23 the names of candidates for clerk. The names of the 4

68	68	1 candidates receiving the highest number of votes for each of
69	69	2 the respective offices shall be placed on the general
70	70	3 municipal election ballot prescribed in Section 5-2-13 which
71	71	4 ballot shall be modified to include such offices and names in
72	72	5 the same manner as is provided in this Section for the primary
73	73	6 ballot. If any candidate nominated for the office of clerk or
74	74	7 treasurer dies or withdraws before the general municipal
75	75	8 election the name of the person receiving the fifth highest
76	76	9 number of votes for nomination to that office shall be placed
77	77	10 on the ballot for that election.
78	78	11 (b) However, in any city not exceeding 100,000 inhabitants
79	79	12 which adopts this Article 5 and elects a mayor and
80	80	13 alderpersons or councilmen as provided in Section 5-2-12, or
81	81	14 Sections 5-2-18 through 5-2-18.8, the council may, in lieu of
82	82	15 electing a clerk and treasurer as provided in the above
83	83	16 paragraph, provide by ordinance that the clerk or treasurer or
84	84	17 both for such city be appointed by the mayor with the approval
85	85	18 of the city council. If such officers are appointed their
86	86	19 terms of office, duties, compensation and amount of bond
87	87	20 required shall be the same as if they were elected.
88	88	21 (c) For the 2027 consolidated election, a city that
89	89	22 exceeds 100,000 inhabitants according to the most recent
90	90	23 federal decennial census and that does not currently elect its
91	91	24 clerk and treasurer shall, in the 2027 consolidated election,
92	92	25 nominate and elect its clerk and its treasurer in the same
93	93	26 manner provided in this Article 5 for the election of the mayor
