1111 1 AN ACT concerning local government.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Illinois Municipal Code is amended by
1515 5 changing Section 5-2-19 as follows:

1717 7 Sec. 5-2-19.
1818 8 (a) In any city which was operating under the alderperson
1919 9 form of government as provided in Article 3 at the time of
2020 10 adoption of this Article 5 which did not also elect to continue
2121 11 to choose alderpersons from wards, the city clerk and city
2222 12 treasurer shall be nominated and elected in the same manner as
2323 13 provided in this Article 5 for the nomination and election of
2424 14 the mayor and councilmen. To achieve this result: wherever the
2525 15 term "mayor or commissioners" appears in Sections 4-3-7
2626 16 through 4-3-18, it shall be construed to include the words "or
2727 17 clerk or treasurer". The names of candidates for nomination
2828 18 shall be placed on the primary election ballot prescribed in
2929 19 Section 5-2-13 and such ballot shall be modified to include
3030 20 the heading "For Clerk--Vote for one" immediately following
3131 21 the names of candidates for councilmen and to include the
3232 22 heading "For Treasurer--Vote for one" immediately following
3333 23 the names of candidates for clerk. The names of the 4

6868 1 candidates receiving the highest number of votes for each of
6969 2 the respective offices shall be placed on the general
7070 3 municipal election ballot prescribed in Section 5-2-13 which
7171 4 ballot shall be modified to include such offices and names in
7272 5 the same manner as is provided in this Section for the primary
7373 6 ballot. If any candidate nominated for the office of clerk or
7474 7 treasurer dies or withdraws before the general municipal
7575 8 election the name of the person receiving the fifth highest
7676 9 number of votes for nomination to that office shall be placed
7777 10 on the ballot for that election.
7878 11 (b) However, in any city not exceeding 100,000 inhabitants
7979 12 which adopts this Article 5 and elects a mayor and
8080 13 alderpersons or councilmen as provided in Section 5-2-12, or
8181 14 Sections 5-2-18 through 5-2-18.8, the council may, in lieu of
8282 15 electing a clerk and treasurer as provided in the above
8383 16 paragraph, provide by ordinance that the clerk or treasurer or
8484 17 both for such city be appointed by the mayor with the approval
8585 18 of the city council. If such officers are appointed their
8686 19 terms of office, duties, compensation and amount of bond
8787 20 required shall be the same as if they were elected.
8888 21 (c) For the 2027 consolidated election, a city that
8989 22 exceeds 100,000 inhabitants according to the most recent
9090 23 federal decennial census and that does not currently elect its
9191 24 clerk and treasurer shall, in the 2027 consolidated election,
9292 25 nominate and elect its clerk and its treasurer in the same
9393 26 manner provided in this Article 5 for the election of the mayor
