1616 2 Be it enacted by the People of the State of Illinois,

1818 4 Section 5. The Election Code is amended by changing
1919 5 Sections 2A-1.2 and 25-11 and by adding Section 2A-56 as

240240 17 subject to runoff elections to be held at the consolidated
241241 18 election as may be required by law, and municipal officers
242242 19 shall be nominated in a nonpartisan election in municipalities
243243 20 in which pursuant to law candidates for such office are not
244244 21 permitted to be candidates of political parties.
245245 22 At the consolidated primary election in the appropriate
246246 23 odd-numbered years, municipal officers shall be nominated or
247247 24 elected, or elected subject to a runoff, as may be provided by
248248 25 an ordinance providing a form of government of the
249249 26 municipality pursuant to Section 7 of Article VII of the

262262 3 (f) At any election established in Section 2A-1.1, public
263263 4 questions may be submitted to voters pursuant to this Code and
264264 5 any special election otherwise required or authorized by law
265265 6 or by court order may be conducted pursuant to this Code.
266266 7 Notwithstanding the regular dates for election of officers
267267 8 established in this Article, whenever a referendum is held for
268268 9 the establishment of a political subdivision whose officers
269269 10 are to be elected, the initial officers shall be elected at the
270270 11 election at which such referendum is held if otherwise so
271271 12 provided by law. In such cases, the election of the initial
272272 13 officers shall be subject to the referendum.
273273 14 Notwithstanding the regular dates for election of
274274 15 officials established in this Article, any community college
275275 16 district which becomes effective by operation of law pursuant
276276 17 to Section 6-6.1 of the Public Community College Act, as now or
277277 18 hereafter amended, shall elect the initial district board
278278 19 members at the next regularly scheduled election following the
279279 20 effective date of the new district.
280280 21 (g) At any election established in Section 2A-1.1, if in
281281 22 any precinct there are no offices or public questions required
282282 23 to be on the ballot under this Code then no election shall be
283283 24 held in the precinct on that date.
284284 25 (h) There may be conducted a referendum in accordance with
285285 26 the provisions of Division 6-4 of the Counties Code.

386386 21 shall be a member of the same political party as the person he
387387 22 succeeds was at the time of his election and shall be otherwise
388388 23 eligible to serve. The appointee shall serve the remainder of
389389 24 the unexpired term. However, if more than 28 months remain in
390390 25 the term, the appointment shall be until the next general

402402 1 election for the remainder of the term. In the case of a
403403 2 vacancy in a seat on a county board or board of county
404404 3 commissioners which has been divided into districts under
405405 4 Section 2-3003 or 2-4006.5 of the Counties Code, the appointee
406406 5 must also be a resident of the county board or county
407407 6 commission district. If a county commissioner ceases to reside
408408 7 in the district that he or she represents, a vacancy in that
409409 8 office exists. In the case of a vacancy in the office of
410410 9 veteran assistance commissioner, the vacancy shall be filled
411411 10 within 60 days by appointment of the president of the board of
412412 11 commissioners with the advice and consent of the other
413413 12 commissioners. The appointee shall be eligible to serve as
414414 13 commissioner. The appointee shall serve the remainder of the

418418 17 assistance commissioner shall be filled by election for the

447447 10 families, as hereinbefore provided, before the acts of the
448448 11 commander, quartermaster, or commandant shall be operative in
449449 12 any city or town, shall file with the city clerk of such city
450450 13 or town clerk of such town, or administrator of military
451451 14 veterans assistance of such town or county, a notice that said
452452 15 veteran service organization or Veterans Assistance Commission
453453 16 intends to undertake such assistance as is provided by this
454454 17 Act, and such notice shall contain the names of the assistance
455455 18 committee of the veteran service organization or Veterans
456456 19 Assistance Commission in such city or town, and the commander
457457 20 and other officers of said veteran service organization or
458458 21 Veterans Assistance Commission. And the commander of the
459459 22 veteran service organization or Veterans Assistance Commission

474474 3 preceding year, with the names of all persons to whom such
475475 4 assistance shall have been furnished, together with a brief
476476 5 statement in such case from the assistance committee upon
477477 6 whose recommendation the orders were drawn. Any person who
478478 7 fails or neglects so to do at the time required by this Act
479479 8 shall be guilty of a petty offense and fined $250 to be
480480 9 recovered in the name of the county in the circuit court.
481481 10 (b) After January 1, 2026, the commander of any veteran
482482 11 service organization or any properly created Veterans
483483 12 Assistance Commission, which shall undertake the assistance of
484484 13 military veterans and their families, as hereinbefore
485485 14 provided, before the acts of the commander, quartermaster, or
486486 15 commandant shall be operative in any city or town, shall file
487487 16 with the city clerk of such city or town clerk of such town, or
488488 17 administrator of military veterans assistance of such town or
489489 18 county, a notice that said veteran service organization or
490490 19 Veterans Assistance Commission intends to undertake such
491491 20 assistance as is provided by this Act. After filing such
492492 21 notice with the clerk, candidates for elected commissioner
493493 22 shall file nominating petitions with the clerk in accordance
494494 23 with Section 10-3.1 of the Election Code.

507507 1 Sec. 4.5. Veterans Assistance Commission; commissioner

509509 3 (a) For every Veterans Assistance Commission properly
510510 4 created under subsection (a) of Section 4 prior to January 1,
511511 5 2026 and for every Veterans Assistance Commission properly
512512 6 created under subsection (b) of Section 4 after January 1,
513513 7 2026, the commissioners shall be elected as provided in this
514514 8 Section, beginning with the first consolidated election
515515 9 following January 1, 2026. There shall be 7 elected
516516 10 commissioners, elected from the district at large. Each
517517 11 commissioner must be a resident of the district and a veteran.
518518 12 Candidates for elected commissioner shall file nominating
519519 13 petitions with the clerk in accordance with Section 10-3.1 of
520520 14 the Election Code. The terms of all elected commissioners
521521 15 shall commence on the third Monday of the month following the
522522 16 month of election. No party designation shall appear on the
523523 17 ballot for the election of commissioners. The terms of all
524524 18 officers who hold their position in accordance with the
525525 19 process provided for in subsection (a) of Section 4 shall
526526 20 expire on the third Monday of the month following the month of
527527 21 the first election of commissioners in that city under this
528528 22 Section.
529529 23 (b) The initial elected commissioners shall, no later than
530530 24 45 days after taking office, divide themselves publicly by lot
531531 25 as equally as possible into 2 groups. Commissioners or their
532532 26 successors from one group shall be elected for terms of 4

544544 2 shall serve for terms of 2 years, and their successors shall be
545545 3 elected for terms of 4 years.
546546 4 (c) The commissioners shall elect from among their number
547547 5 a president of the board of commissioners.
548548 6 (d) Whenever a vacancy occurs in the office of
549549 7 commissioner, whether by death, resignation, refusal to
550550 8 qualify, no longer residing in the district, or for any other
551551 9 reason, the board of commissioners shall declare that a
552552 10 vacancy exists. The vacancy shall be filled within 60 days by
553553 11 appointment of the president of the board of commissioners,
554554 12 with the advice and consent of the other commissioners. The
555555 13 appointee shall be eligible to serve as commissioner. The
556556 14 appointee shall serve the remainder of the unexpired term. If,
557557 15 however, more than 28 months remain in the term, the
558558 16 appointment shall be until the next consolidated election, at
559559 17 which time the vacated office of commissioner shall be filled
560560 18 by election for the remainder of the term.
561561 19 If a vacancy occurs in the office of president of the board
562562 20 of commissioners, the remaining commissioners shall elect one
563563 21 of their number to serve as president for the balance of the
564564 22 unexpired term of the president in whose office the vacancy
565565 23 occurred.
566566 24 (e) Except as otherwise provided in this Section, elected
567567 25 commissioners shall have the same powers and duties, and shall
568568 26 be entitled to the same compensation, as enjoyed by
