1212 1 AN ACT concerning criminal law.
1313 2 Be it enacted by the People of the State of Illinois,
1414 3 represented in the General Assembly:
1515 4 Section 5. The Criminal Code of 2012 is amended by
1616 5 changing Sections 29D-10 and 29D-15.1 as follows:
1717 6 (720 ILCS 5/29D-10)
1818 7 Sec. 29D-10. Definitions. As used in this Article, where
1919 8 not otherwise distinctly expressed or manifestly incompatible
2020 9 with the intent of this Article:
2121 10 (a) "Computer network" means a set of related, remotely
2222 11 connected devices and any communications facilities including
2323 12 more than one computer with the capability to transmit data
2424 13 among them through communication facilities.
2525 14 (b) "Computer" means a device that accepts, processes,
2626 15 stores, retrieves, or outputs data, and includes, but is not
2727 16 limited to, auxiliary storage and telecommunications devices.
2828 17 (c) "Computer program" means a series of coded instruction
2929 18 or statements in a form acceptable to a computer which causes
3030 19 the computer to process data and supply the results of data
3131 20 processing.
3232 21 (d) "Data" means representations of information,
3333 22 knowledge, facts, concepts or instructions, including program
3434 23 documentation, that are prepared in a formalized manner and

7171 1 are stored or processed in or transmitted by a computer. Data
7272 2 may be in any form, including but not limited to magnetic or
7373 3 optical storage media, punch cards, or data stored internally
7474 4 in the memory of a computer.
7575 5 (e) "Biological products used in or in connection with
7676 6 agricultural production" includes, but is not limited to,
7777 7 seeds, plants, and DNA of plants or animals altered for use in
7878 8 crop or livestock breeding or production or which are sold,
7979 9 intended, designed, or produced for use in crop production or
8080 10 livestock breeding or production.
8181 11 (f) "Agricultural products" means crops and livestock.
8282 12 (g) "Agricultural production" means the breeding and
8383 13 growing of livestock and crops.
8484 14 (g-5) "Animal feed" means an article that is intended for
8585 15 use for food for animals other than humans and that is intended
8686 16 for use as a substantial source of nutrients in the diet of the
8787 17 animal, and is not limited to a mixture intended to be the sole
8888 18 ration of the animal.
8989 19 (g-10) "Contagious or infectious disease" means a specific
9090 20 disease designated by the Illinois Department of Agriculture
9191 21 as contagious or infectious under rules pertaining to the
9292 22 Illinois Diseased Animals Act.
9393 23 (g-15) "Processed food" means any food other than a raw
9494 24 agricultural commodity and includes any raw agricultural
9595 25 commodity that has been subject to processing, such as
9696 26 canning, cooking, freezing, dehydration, or milling.

107107 1 (g-20) "Raw agricultural commodity" means any food in its
108108 2 raw or natural state, including all fruits that are washed,
109109 3 colored, or otherwise treated in their unpeeled natural form
110110 4 prior to marketing and honey that is in the comb or that is
111111 5 removed from the comb and in an unadulterated condition.
112112 6 (g-25) "Endangering the food supply" means to knowingly:
113113 7 (1) bring into this State any domestic animal that is
114114 8 affected with any contagious or infectious disease or any
115115 9 animal that has been exposed to any contagious or
116116 10 infectious disease;
117117 11 (2) expose any animal in this State to any contagious
118118 12 or infectious disease;
119119 13 (3) deliver any poultry that is infected with any
120120 14 contagious or infectious disease to any poultry producer
121121 15 pursuant to a production contract;
122122 16 (4) except as permitted under the Insect Pest and
123123 17 Plant Disease Act, bring or release into this State any
124124 18 insect pest or expose any plant to an insect pest; or
125125 19 (5) expose any raw agricultural commodity, animal
126126 20 feed, or processed food to any contaminant or contagious
127127 21 or infectious disease.
128128 22 "Endangering the food supply" does not include bona fide
129129 23 experiments and actions related to those experiments carried
130130 24 on by commonly recognized research facilities or actions by
131131 25 agricultural producers and animal health professionals who may
132132 26 inadvertently contribute to the spread of detrimental

145145 3 (g-30) "Endangering the water supply" means to knowingly
146146 4 contaminate a public or private water well or water reservoir
147147 5 or any water supply of a public utility or tamper with the
148148 6 production of bottled or packaged water or tamper with bottled
149149 7 or packaged water at a retail or wholesale mercantile
150150 8 establishment. "Endangering the water supply" does not include
151151 9 contamination of a public or private well or water reservoir
152152 10 or any water supply of a public utility that may occur
153153 11 inadvertently as part of the operation of a public utility or
154154 12 electrical generating station.
155155 13 (h) "Livestock" means animals bred or raised for human
156156 14 consumption.
157157 15 (i) "Crops" means plants raised for: (1) human
158158 16 consumption, (2) fruits that are intended for human
159159 17 consumption, (3) consumption by livestock, and (4) fruits that
160160 18 are intended for consumption by livestock.
161161 19 (j) "Communications systems" means any works, property, or
162162 20 material of any radio, telegraph, telephone, microwave, or
163163 21 cable line, station, or system.
164164 22 (k) "Substantial damage" means monetary damage greater
165165 23 than $100,000.
166166 24 (l) "Terrorist act" or "act of terrorism" means: (1) any
167167 25 act that is intended to cause or create a risk and does cause
168168 26 or create a risk of death or great bodily harm to one or more

179179 1 persons; (2) any act that disables or destroys the usefulness
180180 2 or operation of any communications system; (3) any act or any
181181 3 series of 2 or more acts committed in furtherance of a single
182182 4 intention, scheme, or design that disables or destroys the
183183 5 usefulness or operation of a computer network, computers,
184184 6 computer programs, or data used by any industry, by any class
185185 7 of business, or by 5 or more businesses or by the federal
186186 8 government, State government, any unit of local government, a
187187 9 public utility, a manufacturer of pharmaceuticals, a national
188188 10 defense contractor, or a manufacturer of chemical or
189189 11 biological products used in or in connection with agricultural
190190 12 production; (4) any act that disables or causes substantial
191191 13 damage to or destruction of any structure or facility used in
192192 14 or used in connection with ground, air, or water
193193 15 transportation; the production or distribution of electricity,
194194 16 gas, oil, or other fuel (except for acts that occur
195195 17 inadvertently and as the result of operation of the facility
196196 18 that produces or distributes electricity, gas, oil, or other
197197 19 fuel); the treatment of sewage or the treatment or
198198 20 distribution of water; or controlling the flow of any body of
199199 21 water; (5) any act that causes substantial damage to or
200200 22 destruction of livestock or to crops or a series of 2 or more
201201 23 acts committed in furtherance of a single intention, scheme,
202202 24 or design which, in the aggregate, causes substantial damage
203203 25 to or destruction of livestock or crops; (6) any act that
204204 26 causes substantial damage to or destruction of any hospital or

215215 1 any building or facility used by the federal government, State
216216 2 government, any unit of local government or by a national
217217 3 defense contractor or by a public utility, a manufacturer of
218218 4 pharmaceuticals, a manufacturer of chemical or biological
219219 5 products used in or in connection with agricultural production
220220 6 or the storage or processing of agricultural products or the
221221 7 preparation of agricultural products for food or food products
222222 8 intended for resale or for feed for livestock; (7) any act that
223223 9 causes substantial damage to any building containing 5 or more
224224 10 businesses of any type or to any building in which 10 or more
225225 11 people reside; (8) endangering the food supply; or (9)
226226 12 endangering the water supply; or (10) any act that is intended
227227 13 to cause or create and does cause or create substantial damage
228228 14 to or destruction of any building or facility containing an
229229 15 entity providing reproductive health care as the term is
230230 16 defined in Section 1-10 of the Reproductive Health Act.
231231 17 (m) "Terrorist" and "terrorist organization" means any
232232 18 person who engages or is about to engage in a terrorist act
233233 19 with the intent to intimidate or coerce a significant portion
234234 20 of a civilian population.
235235 21 (n) "Material support or resources" means currency or
236236 22 other financial securities, financial services, lodging,
237237 23 training, safe houses, false documentation or identification,
238238 24 communications equipment, facilities, weapons, lethal
239239 25 substances, explosives, personnel, transportation, any other
240240 26 kind of physical assets or intangible property, and expert

251251 1 services or expert assistance.
252252 2 (o) "Person" has the meaning given in Section 2-15 of this
253253 3 Code and, in addition to that meaning, includes, without
254254 4 limitation, any charitable organization, whether incorporated
255255 5 or unincorporated, any professional fund raiser, professional
256256 6 solicitor, limited liability company, association, joint stock
257257 7 company, association, trust, trustee, or any group of people
258258 8 formally or informally affiliated or associated for a common
259259 9 purpose, and any officer, director, partner, member, or agent
260260 10 of any person.
261261 11 (p) "Render criminal assistance" means to do any of the
262262 12 following with the intent to prevent, hinder, or delay the
263263 13 discovery or apprehension of, or the lodging of a criminal
264264 14 charge against, a person who he or she knows or believes has
265265 15 committed an offense under this Article or is being sought by
266266 16 law enforcement officials for the commission of an offense
267267 17 under this Article, or with the intent to assist a person in
268268 18 profiting or benefiting from the commission of an offense
269269 19 under this Article:
270270 20 (1) harbor or conceal the person;
271271 21 (2) warn the person of impending discovery or
272272 22 apprehension;
273273 23 (3) provide the person with money, transportation, a
274274 24 weapon, a disguise, false identification documents, or any
275275 25 other means of avoiding discovery or apprehension;
276276 26 (4) prevent or obstruct, by means of force,

287287 1 intimidation, or deception, anyone from performing an act
288288 2 that might aid in the discovery or apprehension of the
289289 3 person or in the lodging of a criminal charge against the
290290 4 person;
291291 5 (5) suppress, by any act of concealment, alteration,
292292 6 or destruction, any physical evidence that might aid in
293293 7 the discovery or apprehension of the person or in the
294294 8 lodging of a criminal charge against the person;
295295 9 (6) aid the person to protect or expeditiously profit
296296 10 from an advantage derived from the crime; or
297297 11 (7) provide expert services or expert assistance to
298298 12 the person. Providing expert services or expert assistance
299299 13 shall not be construed to apply to: (1) a licensed
300300 14 attorney who discusses with a client the legal
301301 15 consequences of a proposed course of conduct or advises a
302302 16 client of legal or constitutional rights and (2) a
303303 17 licensed medical doctor who provides emergency medical
304304 18 treatment to a person whom he or she believes has
305305 19 committed an offense under this Article if, as soon as
306306 20 reasonably practicable either before or after providing
307307 21 such treatment, he or she notifies a law enforcement
308308 22 agency.

322322 1 (a) A person commits the offense of causing a catastrophe
323323 2 if he or she knowingly causes a catastrophe by explosion,
324324 3 fire, flood, collapse of a building, or release of poison,
325325 4 radioactive material, bacteria, virus, or other dangerous and
326326 5 difficult to confine force or substance.
327327 6 (b) As used in this Section, "catastrophe" means serious
328328 7 physical injury to 5 or more persons, substantial damage to 5
329329 8 or more buildings or inhabitable structures, or substantial
330330 9 damage to a vital public facility that seriously impairs its
331331 10 usefulness or operation; and "vital public facility" means a
332332 11 facility that is necessary to ensure or protect the public
333333 12 health, safety, or welfare, including, but not limited to, a
334334 13 hospital, a law enforcement agency, a fire department, a
335335 14 private or public utility company, a national defense
336336 15 contractor, a facility of the armed forces, or an emergency
337337 16 services agency, or an entity providing reproductive health
338338 17 care as the term is defined in Section 1-10 of the Reproductive
339339 18 Health Act.
340340 19 (c) Sentence. Causing a catastrophe is a Class X felony.
