11	11	1 AN ACT concerning employment.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 5. The Unemployment Insurance Act is amended by
15	15	5 adding Section 401.1 as follows:
16	16	6 (820 ILCS 405/401.1 new)
17	17	7 Sec. 401.1. Formula for the duration of benefits.
18	18	8 (a) The Department of Employment Security shall make
19	19	9 payments to beneficiaries under this Act as follows:
20	20	10 (1) payments for 12 weeks if this State's average
21	21	11 unemployment rate is below 5%; and
22	22	12 (2) an additional week in addition to the 12 weeks for
23	23	13 each 0.5% increment in this State's average unemployment
24	24	14 rate above 5%, not to exceed 23 weeks if this State's
25	25	15 average equals or exceeds 10.5%.
26	26	16 (b) The Department shall calculate the State's average
27	27	17 unemployment rate and publish the rate on the Department's
28	28	18 publicly available website.
29	29	19 (c) This Section shall only apply to beneficiaries who
30	30	20 begin receiving benefits on or after the effective date of
31	31	21 this amendatory Act of the 104th General Assembly.
32	32	22 (d) The Department shall adopt rules to implement this
33	33	23 Section.
