1313 1 AN ACT concerning regulation.
1414 2 Be it enacted by the People of the State of Illinois,
1515 3 represented in the General Assembly:
1616 4 Section 5. The Nurse Practice Act is amended by changing
1717 5 Sections 50-10, 50-75, and 60-35 as follows:

2020 8 Sec. 50-10. Definitions. Each of the following terms, when
2121 9 used in this Act, shall have the meaning ascribed to it in this
2222 10 Section, except where the context clearly indicates otherwise:
2323 11 "Academic year" means the customary annual schedule of
2424 12 courses at a college, university, or approved school,
2525 13 customarily regarded as the school year as distinguished from
2626 14 the calendar year.
2727 15 "Address of record" means the designated address recorded
2828 16 by the Department in the applicant's or licensee's application
2929 17 file or license file as maintained by the Department's
3030 18 licensure maintenance unit.
3131 19 "Advanced practice registered nurse" or "APRN" means a
3232 20 person who has met the qualifications for a (i) certified
3333 21 nurse midwife (CNM); (ii) certified nurse practitioner (CNP);
3434 22 (iii) certified registered nurse anesthetist (CRNA); or (iv)
3535 23 clinical nurse specialist (CNS) and has been licensed by the

7474 1 Department. All advanced practice registered nurses licensed
7575 2 and practicing in the State of Illinois shall use the title
7676 3 APRN and may use specialty credentials CNM, CNP, CRNA, or CNS
7777 4 after their name. All advanced practice registered nurses may
7878 5 only practice in accordance with national certification and
7979 6 this Act.
8080 7 "Advisory Board" means the Illinois Nursing Workforce
8181 8 Center Advisory Board.
8282 9 "Approved program of professional nursing education" and
8383 10 "approved program of practical nursing education" are programs
8484 11 of professional or practical nursing, respectively, approved
8585 12 by the Department under the provisions of this Act.
8686 13 "Board" means the Board of Nursing appointed by the
8787 14 Secretary.
8888 15 "Center" means the Illinois Nursing Workforce Center.
8989 16 "Collaboration" means a process involving 2 or more health
9090 17 care professionals working together, each contributing one's
9191 18 respective area of expertise to provide more comprehensive
9292 19 patient care.
9393 20 "Competence" means an expected and measurable level of
9494 21 performance that integrates knowledge, skills, abilities, and
9595 22 judgment based on established scientific knowledge and
9696 23 expectations for nursing practice.
9797 24 "Comprehensive nursing assessment" means the gathering of
9898 25 information about the patient's physiological, psychological,
9999 26 sociological, and spiritual status on an ongoing basis by a

111111 2 implementing and guiding the nursing plan of care.
112112 3 "Consultation" means the process whereby an advanced
113113 4 practice registered nurse seeks the advice or opinion of
114114 5 another health care professional.
115115 6 "Credentialed" means the process of assessing and
116116 7 validating the qualifications of a health care professional.
117117 8 "Dentist" means a person licensed to practice dentistry
118118 9 under the Illinois Dental Practice Act.
119119 10 "Department" means the Department of Financial and
120120 11 Professional Regulation.
121121 12 "Email address of record" means the designated email
122122 13 address recorded by the Department in the applicant's
123123 14 application file or the licensee's license file, as maintained
124124 15 by the Department's licensure maintenance unit.
125125 16 "Focused nursing assessment" means an appraisal of an
126126 17 individual's status and current situation, contributing to the
127127 18 comprehensive nursing assessment performed by the registered
128128 19 professional nurse or advanced practice registered nurse or
129129 20 the assessment by the physician assistant, physician, dentist,
130130 21 podiatric physician, or other licensed health care
131131 22 professional, as determined by the Department, supporting
132132 23 ongoing data collection, and deciding who needs to be informed
133133 24 of the information and when to inform.
134134 25 "Full practice authority" means the authority of an
135135 26 advanced practice registered nurse licensed in Illinois and

146146 1 certified as a nurse practitioner, clinical nurse specialist,
147147 2 or nurse midwife to practice without a written collaborative
148148 3 agreement and:
149149 4 (1) to be fully accountable to patients for the
150150 5 quality of advanced nursing care rendered;
151151 6 (2) to be fully accountable for recognizing limits of
152152 7 knowledge and experience and for planning for the
153153 8 management of situations beyond the advanced practice
154154 9 registered nurse's expertise; the full practice authority
155155 10 for advanced practice registered nurses includes accepting
156156 11 referrals from, consulting with, collaborating with, or
157157 12 referring to other health care professionals as warranted
158158 13 by the needs of the patient; and
159159 14 (3) to possess the authority to prescribe medications,
160160 15 including Schedule II through V controlled substances, as
161161 16 provided in Section 65-43.
162162 17 "Full practice authority-pending advanced practice
163163 18 registered nurse" means an advanced practice registered nurse
164164 19 licensed in Illinois and certified as a nurse practitioner,
165165 20 clinical nurse specialist, or nurse midwife who has provided a
166166 21 notarized attestation of completion of at least 250 hours of
167167 22 continuing education or training in the advanced practice
168168 23 registered nurse's area of certification and at least 4,000
169169 24 hours of clinical experience after first attaining national
170170 25 certification and who has submitted an application to the
171171 26 Department to be granted full practice authority.

182182 1 "Hospital affiliate" means a corporation, partnership,
183183 2 joint venture, limited liability company, or similar
184184 3 organization, other than a hospital, that is devoted primarily
185185 4 to the provision, management, or support of health care
186186 5 services and that directly or indirectly controls, is
187187 6 controlled by, or is under common control of the hospital. For
188188 7 the purposes of this definition, "control" means having at
189189 8 least an equal or a majority ownership or membership interest.
190190 9 A hospital affiliate shall be 100% owned or controlled by any
191191 10 combination of hospitals, their parent corporations, or
192192 11 physicians licensed to practice medicine in all its branches
193193 12 in Illinois. "Hospital affiliate" does not include a health
194194 13 maintenance organization regulated under the Health
195195 14 Maintenance Organization Act.
196196 15 "Impaired nurse" means a nurse licensed under this Act who
197197 16 is unable to practice with reasonable skill and safety because
198198 17 of a physical or mental disability as evidenced by a written
199199 18 determination or written consent based on clinical evidence,
200200 19 including loss of motor skills, abuse of drugs or alcohol, or a
201201 20 psychiatric disorder, of sufficient degree to diminish his or
202202 21 her ability to deliver competent patient care.
203203 22 "License-pending advanced practice registered nurse" means
204204 23 a registered professional nurse who has completed all
205205 24 requirements for licensure as an advanced practice registered
206206 25 nurse except the certification examination and has applied to

218218 1 temporary permit from the Department.
219219 2 "License-pending registered nurse" means a person who has
220220 3 passed the Department-approved registered nurse licensure exam
221221 4 and has applied for a license from the Department. A
222222 5 license-pending registered nurse shall use the title "RN lic
223223 6 pend" on all documentation related to nursing practice.
224224 7 "Nursing intervention" means any treatment based on
225225 8 clinical nursing judgment or knowledge that a nurse performs.
226226 9 An individual or entity shall not mandate that a registered
227227 10 professional nurse delegate nursing interventions if the
228228 11 registered professional nurse determines it is inappropriate
229229 12 to do so. A nurse shall not be subject to disciplinary or any
230230 13 other adverse action for refusing to delegate a nursing
231231 14 intervention based on patient safety.
232232 15 "Physician" means a person licensed to practice medicine
233233 16 in all its branches under the Medical Practice Act of 1987.
234234 17 "Podiatric physician" means a person licensed to practice
235235 18 podiatry under the Podiatric Medical Practice Act of 1987.
236236 19 "Practical nurse" or "licensed practical nurse" means a
237237 20 person who is licensed as a practical nurse under this Act and
238238 21 practices practical nursing as defined in this Act. Only a
239239 22 practical nurse licensed under this Act is entitled to use the
240240 23 title "licensed practical nurse" and the abbreviation
241241 24 "L.P.N.".
242242 25 "Practical nursing" means the performance of nursing

255255 2 nursing education program. Practical nursing includes
256256 3 assisting in the nursing process under the guidance of a

258258 5 registered nurse. The practical nurse may work under the
259259 6 direction of a licensed physician, dentist, podiatric
260260 7 physician, or other health care professional determined by the
261261 8 Department.
262262 9 "Privileged" means the authorization granted by the
263263 10 governing body of a healthcare facility, agency, or
264264 11 organization to provide specific patient care services within
265265 12 well-defined limits, based on qualifications reviewed in the
266266 13 credentialing process.
267267 14 "Registered Nurse" or "Registered Professional Nurse"
268268 15 means a person who is licensed as a professional nurse under
269269 16 this Act and practices nursing as defined in this Act. Only a
270270 17 registered nurse licensed under this Act is entitled to use
271271 18 the titles "registered nurse" and "registered professional
272272 19 nurse" and the abbreviation, "R.N.".
273273 20 "Registered professional nursing practice" means a
274274 21 scientific process founded on a professional body of knowledge
275275 22 that includes, but is not limited to, the protection,
276276 23 promotion, and optimization of health and abilities,
277277 24 prevention of illness and injury, development and
278278 25 implementation of the nursing plan of care, facilitation of
279279 26 nursing interventions to alleviate suffering, care

302302 13 program. A registered professional nurse provides holistic
303303 14 nursing care through the nursing process to individuals,
304304 15 groups, families, or communities, that includes, but is not
305305 16 limited to: (i) the assessment of healthcare needs, nursing
306306 17 diagnosis, planning, implementation, and nursing evaluation;
307307 18 (ii) the promotion, maintenance, and restoration of health;
308308 19 (iii) counseling, patient education, health education, and
309309 20 patient advocacy; (iv) the administration of medications and
310310 21 treatments as prescribed by a physician licensed to practice
311311 22 medicine in all of its branches, a licensed dentist, a
312312 23 licensed podiatric physician, or a licensed optometrist or as
313313 24 prescribed by a physician assistant or by an advanced practice
314314 25 nurse; (v) the coordination and management of the nursing plan
315315 26 of care; (vi) the delegation to and supervision of individuals

328328 3 "Professional assistance program for nurses" means a
329329 4 professional assistance program that meets criteria
330330 5 established by the Board of Nursing and approved by the
331331 6 Secretary, which provides a non-disciplinary treatment
332332 7 approach for nurses licensed under this Act whose ability to
333333 8 practice is compromised by alcohol or chemical substance
334334 9 addiction.
335335 10 "Secretary" means the Secretary of Financial and
336336 11 Professional Regulation.
337337 12 "Unencumbered license" means a license issued in good
338338 13 standing.
339339 14 "Written collaborative agreement" means a written
340340 15 agreement between an advanced practice registered nurse and a
341341 16 collaborating physician, dentist, or podiatric physician
342342 17 pursuant to Section 65-35.

362362 2 "Predictability of outcomes" means that a registered
363363 3 professional nurse or advanced practice registered nurse has
364364 4 determined that the patient's or individual's clinical status
365365 5 is stable and expected to improve or the patient's or
366366 6 individual's deteriorating condition is expected to follow a
367367 7 known or expected course.
368368 8 "Stability" means a registered professional nurse or
369369 9 advanced practice registered nurse has determined that the
370370 10 individual's clinical status and nursing care needs are
371371 11 consistent.
372372 12 "Task" means work not requiring nursing knowledge,
373373 13 judgment, or decision making, as defined by the Department by
374374 14 rule.
375375 15 (b) This Section authorizes a registered professional
376376 16 nurse to:
377377 17 (1) delegate nursing interventions and tasks to other
378378 18 registered professional nurses and , licensed practical
379379 19 nurses based on the comprehensive nursing assessment that
380380 20 includes, but is not limited to:
381381 21 (A) the stability and condition of the patient;
382382 22 (B) the potential for harm;
383383 23 (C) the complexity of the nursing intervention or
384384 24 task to be delegated;
385385 25 (D) the predictability of outcomes; and
386386 26 (E) the competency of the individual to whom the

398398 2 (2) delegate tasks to , and other unlicensed personnel
399399 3 based on the comprehensive nursing assessment that
400400 4 includes, but is not limited to:
401401 5 (A) the stability and condition of the patient;
402402 6 (B) the potential for harm;
403403 7 (C) the complexity of the task nursing
404404 8 intervention to be delegated;
405405 9 (D) the predictability of outcomes; and
406406 10 (E) competency of the individual to whom the task
407407 11 nursing intervention is delegated;
408408 12 (3) (2) delegate medication administration to other
409409 13 licensed nurses; or
410410 14 (3) in community-based or in-home care settings,
411411 15 delegate the administration of medication (limited to oral
412412 16 or subcutaneous dosage and topical or transdermal
413413 17 application) to unlicensed personnel, if all the
414414 18 conditions for delegation set forth in this Section are
415415 19 met;
416416 20 (4) refuse to delegate, stop, or rescind a previously
417417 21 authorized delegation. ; or
418418 22 (5) in community-based or in-home care settings,
419419 23 delegate, guide, and evaluate the implementation of
420420 24 nursing interventions as a component of patient care
421421 25 coordination after completion of the comprehensive patient

436436 4 (c) This Section prohibits the following:
437437 5 (1) An individual or entity from mandating that a
438438 6 registered professional nurse delegate nursing
439439 7 interventions if the registered professional nurse
440440 8 determines it is inappropriate to do so. Nurses shall not
441441 9 be subject to disciplinary or any other adverse action for
442442 10 refusing to delegate a nursing intervention based on
443443 11 patient safety.
444444 12 (2) The delegation of medication administration to
445445 13 unlicensed personnel in any institutional or long-term
446446 14 facility, including, but not limited to, those facilities
447447 15 licensed by the Hospital Licensing Act, the University of
448448 16 Illinois Hospital Act, State-operated mental health
449449 17 hospitals, or State-operated developmental centers, except
450450 18 as authorized under Article 80 of this Act or otherwise
451451 19 specifically authorized by law.
452452 20 (2.5) A registered professional nurse from delegating
453453 21 work requiring nursing knowledge, assessment, judgment,
454454 22 inference, decision making (including medication
455455 23 administration), the development of a plan of care, and
456456 24 evaluation of a plan of care to unlicensed non-nurse
457457 25 personnel.
458458 26 (3) A registered professional nurse from delegating
