11	11	1 AN ACT concerning regulation.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 5. The Illinois Dental Practice Act is amended by
15	15	5 changing Section 17.2 as follows:

18	18	8 Sec. 17.2. Teledentistry.
19	19	9 (a) As used in this Section, "patient of record" means a
20	20	10 patient for whom the patient's most recent Illinois-licensed
21	21	11 dentist has obtained a relevant medical and dental history and
22	22	12 on whom the dentist has (i) performed a physical examination
23	23	13 within the last year; (ii) obtained relevant records that are
24	24	14 appropriate for the type of teledentistry service being
25	25	15 provided from an in-person examination within the previous 12
26	26	16 months, including a review of the patient's most recent
27	27	17 x-rays; or (iii) established a relationship with the patient
28	28	18 through an exchange of protected health information for the
29	29	19 purpose of providing emergency care, treatment, or services in
30	30	20 accordance with subsection (c).
31	31	21 (b) A dentist may only practice or utilize teledentistry
32	32	22 on a patient of record. A dentist practicing dentistry through
33	33	23 teledentistry is subject to the same standard of care and

68	68	1 practice standards that are applicable to dental services
69	69	2 provided in a clinic or office setting. A dentist may provide
70	70	3 and delegate dental services using teledentistry only under
71	71	4 the supervision requirements as specified in this Act for
72	72	5 in-person care. Prior to providing teledentistry services to a
73	73	6 patient, a dentist must obtain informed consent from the
74	74	7 patient as to the treatment proposed to be offered through
75	75	8 teledentistry by the dentist. A dentist providing
76	76	9 teledentistry under this Section shall provide the patient
77	77	10 with the his or her name, direct telephone number, and
78	78	11 physical practice address. It is a violation of this Act for a
79	79	12 provider of dental services rendering care through
80	80	13 teledentistry to require a patient to sign an agreement that
81	81	14 limits in any way the patient's ability to write a review of
82	82	15 services received or file a complaint with the Department or
83	83	16 other regulatory agency. The Department shall adopt rules to
84	84	17 provide for the use of teledentistry in the State of Illinois.
85	85	18 (c) A dentist may treat a patient of record to provide
86	86	19 emergent care or conduct an initial consultation using
87	87	20 teledentistry for the purpose of treating or assessing for
88	88	21 acute pain, infection, injury, or any intraoral or perioral
89	89	22 condition that presents immediate harm or discomfort to the
90	90	23 patient for which treatment cannot be postponed. A provider of
91	91	24 dental services rendering emergent care or conducting an
92	92	25 initial consultation through teledentistry must direct the
93	93	26 patient to receive appropriate in-person care after the
