1111 1 AN ACT concerning regulation.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Illinois Dental Practice Act is amended by
1515 5 changing Section 17.2 as follows:

1818 8 Sec. 17.2. Teledentistry.
1919 9 (a) As used in this Section, "patient of record" means a
2020 10 patient for whom the patient's most recent Illinois-licensed
2121 11 dentist has obtained a relevant medical and dental history and
2222 12 on whom the dentist has (i) performed a physical examination
2323 13 within the last year; (ii) obtained relevant records that are
2424 14 appropriate for the type of teledentistry service being
2525 15 provided from an in-person examination within the previous 12
2626 16 months, including a review of the patient's most recent
2727 17 x-rays; or (iii) established a relationship with the patient
2828 18 through an exchange of protected health information for the
2929 19 purpose of providing emergency care, treatment, or services in
3030 20 accordance with subsection (c).
3131 21 (b) A dentist may only practice or utilize teledentistry
3232 22 on a patient of record. A dentist practicing dentistry through
3333 23 teledentistry is subject to the same standard of care and

6868 1 practice standards that are applicable to dental services
6969 2 provided in a clinic or office setting. A dentist may provide
7070 3 and delegate dental services using teledentistry only under
7171 4 the supervision requirements as specified in this Act for
7272 5 in-person care. Prior to providing teledentistry services to a
7373 6 patient, a dentist must obtain informed consent from the
7474 7 patient as to the treatment proposed to be offered through
7575 8 teledentistry by the dentist. A dentist providing
7676 9 teledentistry under this Section shall provide the patient
7777 10 with the his or her name, direct telephone number, and
7878 11 physical practice address. It is a violation of this Act for a
7979 12 provider of dental services rendering care through
8080 13 teledentistry to require a patient to sign an agreement that
8181 14 limits in any way the patient's ability to write a review of
8282 15 services received or file a complaint with the Department or
8383 16 other regulatory agency. The Department shall adopt rules to
8484 17 provide for the use of teledentistry in the State of Illinois.
8585 18 (c) A dentist may treat a patient of record to provide
8686 19 emergent care or conduct an initial consultation using
8787 20 teledentistry for the purpose of treating or assessing for
8888 21 acute pain, infection, injury, or any intraoral or perioral
8989 22 condition that presents immediate harm or discomfort to the
9090 23 patient for which treatment cannot be postponed. A provider of
9191 24 dental services rendering emergent care or conducting an
9292 25 initial consultation through teledentistry must direct the
9393 26 patient to receive appropriate in-person care after the
