1212 1 AN ACT concerning safety.
1313 2 Be it enacted by the People of the State of Illinois,
1414 3 represented in the General Assembly:
1515 4 Section 5. The Illinois Solid Waste Management Act is
1616 5 amended by changing Sections 2 and 2.1 as follows:

1818 7 Sec. 2. Public Policy. (a) The General Assembly finds:
1919 8 (1) that current solid waste disposal practices are not
2020 9 adequate to address the needs of many metropolitan areas in
2121 10 Illinois;
2222 11 (2) that the generation of solid waste is increasing while
2323 12 landfill capacity is decreasing;
2424 13 (3) that siting of new landfills, transfer stations,
2525 14 incinerators, recycling facilities, or other solid waste
2626 15 management facilities and the expansion of existing facilities
2727 16 is very difficult due to the public concern and competition
2828 17 with other land uses for suitable sites;
2929 18 (4) that more effective and efficient management of solid
3030 19 waste is needed in a manner that promotes economic
3131 20 development, protects the environment and public health and
3232 21 safety, and allows the most practical and beneficial use of
3333 22 the material and energy values of solid waste;

7171 1 developed to assist local governments and private industry in
7272 2 seeking solutions to solid waste management problems;
7373 3 (6) that the purchase of products or supplies made from
7474 4 recycled materials by public agencies in the State will divert
7575 5 significant quantities of waste from landfills, reduce
7676 6 disposal costs and stimulate recycling markets, thereby
7777 7 encouraging the further use of recycled materials and
7878 8 educating the public about the utility and availability of
7979 9 such materials;
8080 10 (7) that there are wastes for which combustion would not
8181 11 provide practical energy recovery or practical volume
8282 12 reduction, which cannot be reasonably recycled or reused and
8383 13 which have reduced environmental threat because they are
8484 14 non-putrescible, homogeneous and do not contain free liquids.
8585 15 Such wastes bear a real and substantial difference under the
8686 16 purposes of the Illinois Solid Waste Management Act from solid
8787 17 wastes for which combustion would provide practical energy
8888 18 recovery or practical volume reduction, which can be
8989 19 reasonably recycled or reused, or which are putrescible,
9090 20 non-homogeneous or contain free liquids;
9191 21 (8) since it is the policy of the State as set forth in the
9292 22 Environmental Protection Act to assure that contaminants
9393 23 discharged into the atmosphere or waters of the State are
9494 24 given the degree of treatment or control necessary to prevent
9595 25 pollution, that wastes generated as a result of removing
9696 26 contaminants from the air, water or land bear a real and

107107 1 substantial difference from other wastes in that the
108108 2 generation of wastes containing pollution treatment residuals
109109 3 can improve the environment in Illinois and should be
110110 4 encouraged;
111111 5 (9) since it is the policy of the State as set forth in the
112112 6 Environmental Protection Act to promote conservation of
113113 7 natural resources and minimize environmental damage by
114114 8 encouraging and effecting recycling and reuse of waste
115115 9 materials, that wastes from recycling, reclamation or reuse
116116 10 processes designed to remove contaminants so as to render such
117117 11 wastes reusable or wastes received at a landfill and recycled
118118 12 through an Agency permitted process bear a real and
119119 13 substantial difference from wastes not resulting from or
120120 14 subject to such recycling, reclamation, or reuse and that
121121 15 encouraging such recycling, reclamation or reuse furthers the
122122 16 purposes of the Illinois Solid Waste Management Act;
123123 17 (10) that there are over 300 landfills in Illinois which
124124 18 are permitted to accept only demolition or construction debris
125125 19 or landscape waste, the vast majority of which accept less
126126 20 than 10,000 cubic yards per year. By themselves these wastes
127127 21 pose only a minimal hazard to the environment when landfilled
128128 22 in compliance with regulatory requirements in an
129129 23 Agency-permitted site without commingling with other wastes
130130 24 and, as such, landfills receiving only such wastes bear a real
131131 25 and substantial difference from landfills receiving wastes

143143 1 permitted for municipal wastes uses up increasingly scarce
144144 2 capacity for garbage, general household and commercial waste.
145145 3 It is the policy of the State to encourage disposal of these
146146 4 wastes in separate landfills.
147147 5 (b) It is the purpose of this Act to reduce reliance on
148148 6 land disposal of solid waste, to encourage and promote
149149 7 alternative means of managing solid waste, and to assist local
150150 8 governments with solid waste planning and management, and to
151151 9 promote conversion into environmentally safe products. In
152152 10 furtherance of those aims, while recognizing that landfills
153153 11 will continue to be necessary, this Act establishes the
154154 12 following waste management hierarchy, in descending order of
155155 13 preference, as State policy:
156156 14 (1) volume reduction at the source;
157157 15 (2) recycling and reuse;
158158 16 (3) thermal conversion;
159159 17 (4) (3) combustion with energy recovery;
160160 18 (5) (4) combustion for volume reduction;
161161 19 (6) (5) disposal in landfill facilities.

164164 22 Sec. 2.1. Definitions. When used in this Act, unless the
165165 23 context otherwise requires, the following terms have the
166166 24 meanings ascribed to them in this Section:
167167 25 "Agency" means the Environmental Protection Agency.

178178 1 "Department", when a particular entity is not specified,
179179 2 means (i) in the case of a function to be performed on or after
180180 3 July 1, 1995 (the effective date of the Department of Natural
181181 4 Resources Act) and until the effective date of this amendatory
182182 5 Act of the 102nd General Assembly, the Department of Commerce
183183 6 and Community Affairs (now Department of Commerce and Economic
184184 7 Opportunity), as successor to the former Department of Energy
185185 8 and Natural Resources under the Department of Natural
186186 9 Resources Act; or (ii) in the case of a function required to be
187187 10 performed before July 1, 1995, the former Illinois Department
188188 11 of Energy and Natural Resources.
189189 12 "Deinked stock" means paper that has been processed to
190190 13 remove inks, clays, coatings, binders and other contaminants.
191191 14 "End product" means only those items that are designed to
192192 15 be used until disposal; items designed to be used in
193193 16 production of a subsequent item are excluded.
194194 17 "High grade printing and writing papers" includes offset
195195 18 printing paper, duplicator paper, writing paper (stationery),
196196 19 office paper, note pads, xerographic paper, envelopes, form
197197 20 bond including computer paper and carbonless forms, book
198198 21 papers, bond papers, ledger paper, book stock and cotton fiber
199199 22 papers.
200200 23 "Paper and paper products" means high grade printing and
201201 24 writing papers, tissue products, newsprint, unbleached
202202 25 packaging and recycled paperboard.
203203 26 "Postconsumer material" means only those products

215215 2 intended end uses, and which have been separated or diverted
216216 3 from solid waste; wastes generated during production of an end
217217 4 product are excluded.
218218 5 "Recovered paper material" means paper waste generated
219219 6 after the completion of the papermaking process, such as
220220 7 postconsumer materials, envelope cuttings, bindery trimmings,
221221 8 printing waste, cutting and other converting waste, butt
222222 9 rolls, and mill wrappers, obsolete inventories, and rejected
223223 10 unused stock. "Recovered paper material", however, does not
224224 11 include fibrous waste generated during the manufacturing
225225 12 process such as fibers recovered from waste water or trimmings
226226 13 of paper machine rolls (mill broke), or fibrous byproducts of
227227 14 harvesting, extraction or woodcutting processes, or forest
228228 15 residues such as bark.
229229 16 "Recycled paperboard" includes recycled paperboard
230230 17 products, folding cartons and pad backing.
231231 18 "Recycling" means the process by which solid waste is
232232 19 collected, separated and processed for reuse as either a raw
233233 20 material or a product which itself is subject to recycling,
234234 21 but does not include the combustion of waste for energy
235235 22 recovery or volume reduction.
236236 23 "Thermal conversion" means the process by which a solid
237237 24 feedstock can be converted to produce environmentally safe
238238 25 products, including, but not limited to, liquid fuels,
239239 26 chemicals, hydrogen, and other products.
