11	11	1 AN ACT concerning transportation.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 5. The Illinois Vehicle Code is amended by
15	15	5 changing Section 11-604 as follows:

17	17	7 Sec. 11-604. Alteration of limits by local authorities.
18	18	8 (a) Subject to the limitations set forth in this Section,
19	19	9 the county board of a county may establish absolute maximum
20	20	10 speed limits on all county highways, township roads and
21	21	11 district roads as defined in the Illinois Highway Code, except
22	22	12 those under the jurisdiction of the Department or of the
23	23	13 Illinois State Toll Highway Authority, as described in
24	24	14 Sections 11-602 and 11-603 of this Chapter; and any park
25	25	15 district, city, village, or incorporated town may establish
26	26	16 absolute maximum speed limits on all streets which are within
27	27	17 its corporate limits and which are not under the jurisdiction
28	28	18 of the Department or of such Authority, and for which the
29	29	19 county or a highway commissioner of such county does not have
30	30	20 maintenance responsibility.
31	31	21 (b) Whenever any such park district, city, village, or
32	32	22 incorporated town determines, upon the basis of an engineering
33	33	23 or traffic investigation concerning a highway or street on

68	68	1 which it is authorized by this Section to establish speed
69	69	2 limits, that a maximum speed limit prescribed in Section
70	70	3 11-601 of this Chapter is greater or less than is reasonable or
71	71	4 safe with respect to the conditions found to exist at any place
72	72	5 or along any part or zone of such highway or street, the local
73	73	6 authority or park district shall determine and declare by
74	74	7 ordinance a reasonable and safe absolute maximum speed limit
75	75	8 at such place or along such part or zone, which:
76	76	9 (1) Decreases the limit within an urban district, but
77	77	10 not to less than 10 20 miles per hour; or
78	78	11 (2) Increases the limit within an urban district, but
79	79	12 not to more than 55 miles per hour; or
80	80	13 (3) Decreases the limit outside of an urban district,
81	81	14 but not to less than 35 miles per hour, except as otherwise
82	82	15 provided in subparagraph 4 of this paragraph; or
83	83	16 (4) Decreases the limit within a residence district,
84	84	17 but not to less than 15 25 miles per hour, except as
85	85	18 otherwise provided in subparagraph 1 of this paragraph.
86	86	19 The park district, city, village, or incorporated town may
87	87	20 make such limit applicable at all times or only during certain
88	88	21 specified times. Not more than 6 such alterations shall be
89	89	22 made per mile along a highway or street; and the difference in
90	90	23 limit between adjacent altered speed zones shall not be more
91	91	24 than 15 10 miles per hour.
92	92	25 A limit so determined and declared by a park district,
93	93	26 city, village, or incorporated town becomes effective, and

104	104	1 suspends the application of the limit prescribed in Section
105	105	2 11-601 of this Chapter, when appropriate signs giving notice
106	106	3 of the limit are erected at the proper place or along the
107	107	4 proper part or zone of the highway or street. Electronic
108	108	5 speed-detecting devices shall not be used within 500 feet
109	109	6 beyond any such sign in the direction of travel; if so used in
110	110	7 violation of this Section evidence obtained thereby shall be
111	111	8 inadmissible in any prosecution for speeding. However, nothing
112	112	9 in this Section prohibits the use of such electronic
113	113	10 speed-detecting devices within 500 feet of a sign within a
114	114	11 special school speed zone indicating such zone, conforming to
115	115	12 the requirements of Section 11-605 of this Act, nor shall
116	116	13 evidence obtained thereby be inadmissible in any prosecution
117	117	14 for speeding provided the use of such device shall apply only
118	118	15 to the enforcement of the speed limit in such special school
119	119	16 speed zone.
120	120	17 (c) A county engineer or superintendent of highways may
121	121	18 submit to the Department for approval, a county policy for
122	122	19 establishing altered speed zones on township and county
123	123	20 highways based upon engineering and traffic investigations.
124	124	21 (d) Whenever the county board of a county determines that
125	125	22 a maximum speed limit is greater or less than is reasonable or
126	126	23 safe with respect to the conditions found to exist at any place
127	127	24 or along any part or zone of the highway or road, the county
128	128	25 board shall determine and declare by ordinance a reasonable
129	129	26 and safe absolute maximum speed limit at that place or along

140	140	1 that part or zone. However, the maximum speed limit shall not
141	141	2 exceed 55 miles per hour. Upon receipt of an engineering study
142	142	3 for the part or zone of highway in question from the county
143	143	4 engineer, and notwithstanding any other provision of law, the
144	144	5 county board of a county may determine and declare by
145	145	6 ordinance a reduction in the maximum speed limit at any place
146	146	7 or along any part or zone of a county highway whenever the
147	147	8 county board, in its sole discretion, determines that the
148	148	9 reduction in the maximum speed limit is reasonable and safe.
149	149	10 The county board may post signs designating the new speed
150	150	11 limit. The limit becomes effective, and suspends the
151	151	12 application of the limit prescribed in Section 11-601 of this
152	152	13 Chapter, when appropriate signs giving notice of the limit are
153	153	14 erected at the proper place or along the proper part of the
154	154	15 zone of the highway. Electronic speed-detecting devices shall
155	155	16 not be used within 500 feet beyond any such sign in the
156	156	17 direction of travel; if so used in violation of this Section,
157	157	18 evidence obtained thereby shall be inadmissible in any
158	158	19 prosecution for speeding. However, nothing in this Section
159	159	20 prohibits the use of such electronic speed-detecting devices
160	160	21 within 500 feet of a sign within a special school speed zone
161	161	22 indicating such zone, conforming to the requirements of
162	162	23 Section 11-605 of this Act, nor shall evidence obtained
163	163	24 thereby be inadmissible in any prosecution for speeding
