1111 1 AN ACT concerning transportation.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Illinois Vehicle Code is amended by
1515 5 changing Section 11-604 as follows:

1717 7 Sec. 11-604. Alteration of limits by local authorities.
1818 8 (a) Subject to the limitations set forth in this Section,
1919 9 the county board of a county may establish absolute maximum
2020 10 speed limits on all county highways, township roads and
2121 11 district roads as defined in the Illinois Highway Code, except
2222 12 those under the jurisdiction of the Department or of the
2323 13 Illinois State Toll Highway Authority, as described in
2424 14 Sections 11-602 and 11-603 of this Chapter; and any park
2525 15 district, city, village, or incorporated town may establish
2626 16 absolute maximum speed limits on all streets which are within
2727 17 its corporate limits and which are not under the jurisdiction
2828 18 of the Department or of such Authority, and for which the
2929 19 county or a highway commissioner of such county does not have
3030 20 maintenance responsibility.
3131 21 (b) Whenever any such park district, city, village, or
3232 22 incorporated town determines, upon the basis of an engineering
3333 23 or traffic investigation concerning a highway or street on

6868 1 which it is authorized by this Section to establish speed
6969 2 limits, that a maximum speed limit prescribed in Section
7070 3 11-601 of this Chapter is greater or less than is reasonable or
7171 4 safe with respect to the conditions found to exist at any place
7272 5 or along any part or zone of such highway or street, the local
7373 6 authority or park district shall determine and declare by
7474 7 ordinance a reasonable and safe absolute maximum speed limit
7575 8 at such place or along such part or zone, which:
7676 9 (1) Decreases the limit within an urban district, but
7777 10 not to less than 10 20 miles per hour; or
7878 11 (2) Increases the limit within an urban district, but
7979 12 not to more than 55 miles per hour; or
8080 13 (3) Decreases the limit outside of an urban district,
8181 14 but not to less than 35 miles per hour, except as otherwise
8282 15 provided in subparagraph 4 of this paragraph; or
8383 16 (4) Decreases the limit within a residence district,
8484 17 but not to less than 15 25 miles per hour, except as
8585 18 otherwise provided in subparagraph 1 of this paragraph.
8686 19 The park district, city, village, or incorporated town may
8787 20 make such limit applicable at all times or only during certain
8888 21 specified times. Not more than 6 such alterations shall be
8989 22 made per mile along a highway or street; and the difference in
9090 23 limit between adjacent altered speed zones shall not be more
9191 24 than 15 10 miles per hour.
9292 25 A limit so determined and declared by a park district,
9393 26 city, village, or incorporated town becomes effective, and

104104 1 suspends the application of the limit prescribed in Section
105105 2 11-601 of this Chapter, when appropriate signs giving notice
106106 3 of the limit are erected at the proper place or along the
107107 4 proper part or zone of the highway or street. Electronic
108108 5 speed-detecting devices shall not be used within 500 feet
109109 6 beyond any such sign in the direction of travel; if so used in
110110 7 violation of this Section evidence obtained thereby shall be
111111 8 inadmissible in any prosecution for speeding. However, nothing
112112 9 in this Section prohibits the use of such electronic
113113 10 speed-detecting devices within 500 feet of a sign within a
114114 11 special school speed zone indicating such zone, conforming to
115115 12 the requirements of Section 11-605 of this Act, nor shall
116116 13 evidence obtained thereby be inadmissible in any prosecution
117117 14 for speeding provided the use of such device shall apply only
118118 15 to the enforcement of the speed limit in such special school
119119 16 speed zone.
120120 17 (c) A county engineer or superintendent of highways may
121121 18 submit to the Department for approval, a county policy for
122122 19 establishing altered speed zones on township and county
123123 20 highways based upon engineering and traffic investigations.
124124 21 (d) Whenever the county board of a county determines that
125125 22 a maximum speed limit is greater or less than is reasonable or
126126 23 safe with respect to the conditions found to exist at any place
127127 24 or along any part or zone of the highway or road, the county
128128 25 board shall determine and declare by ordinance a reasonable
129129 26 and safe absolute maximum speed limit at that place or along

140140 1 that part or zone. However, the maximum speed limit shall not
141141 2 exceed 55 miles per hour. Upon receipt of an engineering study
142142 3 for the part or zone of highway in question from the county
143143 4 engineer, and notwithstanding any other provision of law, the
144144 5 county board of a county may determine and declare by
145145 6 ordinance a reduction in the maximum speed limit at any place
146146 7 or along any part or zone of a county highway whenever the
147147 8 county board, in its sole discretion, determines that the
148148 9 reduction in the maximum speed limit is reasonable and safe.
149149 10 The county board may post signs designating the new speed
150150 11 limit. The limit becomes effective, and suspends the
151151 12 application of the limit prescribed in Section 11-601 of this
152152 13 Chapter, when appropriate signs giving notice of the limit are
153153 14 erected at the proper place or along the proper part of the
154154 15 zone of the highway. Electronic speed-detecting devices shall
155155 16 not be used within 500 feet beyond any such sign in the
156156 17 direction of travel; if so used in violation of this Section,
157157 18 evidence obtained thereby shall be inadmissible in any
158158 19 prosecution for speeding. However, nothing in this Section
159159 20 prohibits the use of such electronic speed-detecting devices
160160 21 within 500 feet of a sign within a special school speed zone
161161 22 indicating such zone, conforming to the requirements of
162162 23 Section 11-605 of this Act, nor shall evidence obtained
163163 24 thereby be inadmissible in any prosecution for speeding
164164 25 provided the use of such device shall apply only to the
165165 26 enforcement of the speed limit in such special school speed
