1212 1 AN ACT concerning criminal law.
1313 2 Be it enacted by the People of the State of Illinois,
1414 3 represented in the General Assembly:
1515 4 Section 5. The Criminal Code of 2012 is amended by
1616 5 changing Sections 33-1 and 33-8 as follows:
1717 6 (720 ILCS 5/33-1) (from Ch. 38, par. 33-1)
1818 7 Sec. 33-1. Bribery. A person commits bribery when:
1919 8 (a) With intent to influence or for the performance of
2020 9 any act related to the employment or function of any
2121 10 public officer, public employee, juror or witness, he or
2222 11 she promises or tenders or promised or tendered to that
2323 12 person any property or personal advantage which he or she
2424 13 is not authorized by law to accept; or
2525 14 (b) With intent to influence or for the performance of
2626 15 any act related to the employment or function of any
2727 16 public officer, public employee, juror or witness, he or
2828 17 she promises or tenders or promised or tendered to one
2929 18 whom he or she believes to be a public officer, public
3030 19 employee, juror or witness, any property or personal
3131 20 advantage which a public officer, public employee, juror
3232 21 or witness would not be authorized by law to accept; or
3333 22 (c) With intent to cause any person to influence or

7171 1 employment or function of any public officer, public
7272 2 employee, juror or witness, he or she promises or tenders
7373 3 or promised or tendered to that person any property or
7474 4 personal advantage which he or she is not authorized by
7575 5 law to accept; or
7676 6 (d) He or she receives, retains or agrees to accept
7777 7 any property or personal advantage which he or she is not
7878 8 authorized by law to accept knowing that the property or
7979 9 personal advantage was promised or tendered with intent to
8080 10 cause him or her to influence or for the performance of any
8181 11 act related to the employment or function of any public
8282 12 officer, public employee, juror or witness; or
8383 13 (e) He or she solicits, receives, retains, or agrees
8484 14 to accept any property or personal advantage pursuant to
8585 15 an understanding that he or she shall improperly influence
8686 16 or attempt to influence or for improperly influencing or
8787 17 attempting to influence the performance of any act related
8888 18 to the employment or function of any public officer,
8989 19 public employee, juror or witness.
9090 20 As used in this Section, "tenders" means any delivery or
9191 21 proffer made with the requisite intent.
9292 22 This Section does not apply to the promise, tender,
9393 23 acceptance, or receipt of any campaign contributions that are
9494 24 permissible under the Election Code.
9595 25 Sentence. Bribery is a Class 2 felony.
