12	12	1 AN ACT concerning criminal law.
13	13	2 Be it enacted by the People of the State of Illinois,
14	14	3 represented in the General Assembly:
15	15	4 Section 5. The Criminal Code of 2012 is amended by
16	16	5 changing Sections 33-1 and 33-8 as follows:
17	17	6 (720 ILCS 5/33-1) (from Ch. 38, par. 33-1)
18	18	7 Sec. 33-1. Bribery. A person commits bribery when:
19	19	8 (a) With intent to influence or for the performance of
20	20	9 any act related to the employment or function of any
21	21	10 public officer, public employee, juror or witness, he or
22	22	11 she promises or tenders or promised or tendered to that
23	23	12 person any property or personal advantage which he or she
24	24	13 is not authorized by law to accept; or
25	25	14 (b) With intent to influence or for the performance of
26	26	15 any act related to the employment or function of any
27	27	16 public officer, public employee, juror or witness, he or
28	28	17 she promises or tenders or promised or tendered to one
29	29	18 whom he or she believes to be a public officer, public
30	30	19 employee, juror or witness, any property or personal
31	31	20 advantage which a public officer, public employee, juror
32	32	21 or witness would not be authorized by law to accept; or
33	33	22 (c) With intent to cause any person to influence or

74	74	4 personal advantage which he or she is not authorized by
75	75	5 law to accept; or
76	76	6 (d) He or she receives, retains or agrees to accept
77	77	7 any property or personal advantage which he or she is not
78	78	8 authorized by law to accept knowing that the property or
79	79	9 personal advantage was promised or tendered with intent to
80	80	10 cause him or her to influence or for the performance of any
81	81	11 act related to the employment or function of any public
82	82	12 officer, public employee, juror or witness; or
83	83	13 (e) He or she solicits, receives, retains, or agrees
84	84	14 to accept any property or personal advantage pursuant to
85	85	15 an understanding that he or she shall improperly influence
86	86	16 or attempt to influence or for improperly influencing or
87	87	17 attempting to influence the performance of any act related
88	88	18 to the employment or function of any public officer,
89	89	19 public employee, juror or witness.
90	90	20 As used in this Section, "tenders" means any delivery or
91	91	21 proffer made with the requisite intent.
92	92	22 This Section does not apply to the promise, tender,
93	93	23 acceptance, or receipt of any campaign contributions that are
94	94	24 permissible under the Election Code.
95	95	25 Sentence. Bribery is a Class 2 felony.
