1111 1 AN ACT concerning regulation.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 1. Short title. This Act may be cited as the
1515 5 Illinois Data Center Energy and Water Reporting Act.
1616 6 Section 5. Purpose. The purpose of this Act is to ensure
1717 7 transparency regarding the environmental impacts of data
1818 8 centers operating within the State by requiring the disclosure
1919 9 of energy and water usage data to the Illinois Power Agency.
2020 10 Section 10. Definitions.
2121 11 "Agency" means the Illinois Power Agency.
2222 12 "Data center" means a facility used to house computer
2323 13 systems and associated components, including
2424 14 telecommunications and storage systems, where the primary
2525 15 function is the storage, management, and dissemination of
2626 16 data.
2727 17 "Energy consumption" means the total amount of electricity
2828 18 or other forms of energy consumed by a data center, measured in
2929 19 kilowatt-hours.
3030 20 "Water consumption" means the total amount of water
3131 21 consumed by a data center, including water used for cooling,

6767 1 Section 15. Reporting requirements.
6868 2 (a) Beginning January 1, 2026, all data centers operating
6969 3 within this State shall annually report the data center's
7070 4 energy and water consumption to the Agency for the preceding
7171 5 calendar year.
7272 6 (b) The report shall include:
7373 7 (1) the total energy consumption for the previous
7474 8 calendar year, broken down by month and specifying the
7575 9 energy source;
7676 10 (2) total water consumption for the previous calendar
7777 11 year, broken down by month and specifying whether the
7878 12 consumption was for cooling or another application; and
7979 13 (3) any measures undertaken the previous calendar year
8080 14 to improve energy efficiency or reduce water usage.
8181 15 (c) Reports shall be submitted to the Agency no later than
8282 16 March 31 of each year.
8383 17 Section 20. Data confidentiality and public access.
8484 18 (a) Proprietary information may be exempt from public
8585 19 disclosure. Aggregated and anonymized data shall be made
8686 20 available to the public.
8787 21 (b) The Agency shall publish an annual report summarizing
8888 22 statewide energy and water consumption trends in data centers,
8989 23 including, but not limited to, legislative recommendations to
9090 24 address identified issues.

101101 1 Section 25. Enforcement and penalties.
102102 2 (a) Data centers that fail to comply with the reporting
103103 3 requirements under this Act may be subject to fines of up to
104104 4 $10,000 per violation.
105105 5 (b) All funds collected under this Section shall be
106106 6 deposited into the Energy Efficiency Trust Fund.
107107 7 Section 30. Data center impact study.
108108 8 (a) The Agency shall conduct a comprehensive study on the
109109 9 impact that data centers in this State are having on
110110 10 rate-paying customers.
111111 11 (b) The study shall include, but is not limited to, the
112112 12 following:
113113 13 (1) the energy consumption of data centers and its
114114 14 effects on overall electricity demand in this State;
115115 15 (2) the extent to which data centers contribute to
116116 16 electricity rate changes for residential, commercial, and
117117 17 industrial customers;
118118 18 (3) the environmental impact of data centers in this
119119 19 State; and
120120 20 (4) potential legislation to mitigate any negative
121121 21 impacts of data centers on rate-paying customers.
122122 22 (c) In conducting the study, the Agency shall:
123123 23 (1) consult with stakeholders, including, but not
124124 24 limited to, public utilities, data center operators,

135135 1 consumer advocacy groups, and environmental organizations;
136136 2 (2) analyze data from public utilities and other
137137 3 relevant sources to assess the energy consumption and rate
138138 4 impacts associated with data centers; and
139139 5 (3) consider best practices from other states in
140140 6 managing the energy and rate impacts of data centers.
141141 7 (d) The Agency shall submit a report detailing the
142142 8 findings of the study to the General Assembly and the Governor
143143 9 no later than 12 months after the effective date of this Act.
144144 10 Section 35. Rulemaking authority. The Illinois Power
145145 11 Agency shall have the authority to adopt rules necessary to
146146 12 implement the provisions of this Act.
