1313 1 AN ACT concerning criminal law.
1414 2 Be it enacted by the People of the State of Illinois,
1515 3 represented in the General Assembly:
1616 4 Section 5. The Arsonist Registry Act is amended by
1717 5 changing Section 10 as follows:

1919 7 Sec. 10. Statewide Arsonist Database.
2020 8 (a) The Illinois State Police shall establish and maintain
2121 9 a Statewide Arsonist Database for the purpose of identifying
2222 10 arsonists and making that information available to law
2323 11 enforcement and the general public. For every person convicted
2424 12 of a violation of an arson offense on or after the effective
2525 13 date of this amendatory Act of the 103rd General Assembly, the
2626 14 Statewide Arsonist Database shall contain information relating
2727 15 to each arsonist for a period of 10 years after conviction for
2828 16 an arson offense. The information may include the arsonist's
2929 17 name, date of birth, offense or offenses requiring inclusion
3030 18 in the Statewide Arsonist Database, the conviction date and
3131 19 county of each such offense, and such other identifying
3232 20 information as the Illinois State Police deems necessary to
3333 21 identify the arsonist, but shall not include the social
3434 22 security number of the arsonist. The registry may include a
3535 23 photograph of the arsonist.

7474 1 (b) The Illinois State Police may adopt rules in
7575 2 accordance with the Illinois Administrative Procedure Act to
7676 3 implement this Section and those rules must include procedures
7777 4 to ensure that the information in the database is accurate,
7878 5 and that the information in the database reflects any changes
7979 6 based on the reversal of a conviction for an offense requiring
8080 7 inclusion in the Statewide Arsonist Database, or a court order
8181 8 requiring the sealing or expungement of records relating to
8282 9 the offense. A certified copy of such an order shall be deemed
8383 10 prima facie true and correct and shall be sufficient to
8484 11 require the immediate amendment or removal of any person's
8585 12 information from the Statewide Arsonist Database by the
8686 13 Illinois State Police.
8787 14 (c) The Illinois State Police, or any other law
8888 15 enforcement or registering agency, shall not impose a fee for
8989 16 registration on any person subject to this Act.
9090 17 (d) The Illinois State Police must have the Statewide
9191 18 Arsonist Database created and ready to comply with the
9292 19 requirements of this Section no later than July 1, 2025.

108108 1 (a) A sex offender, as defined in Section 2 of this Act, or
109109 2 sexual predator shall, within the time period prescribed in
110110 3 subsections (b) and (c), register in person and provide
111111 4 accurate information as required by the Illinois State Police.
112112 5 Such information shall include a current photograph, current
113113 6 address, current place of employment, the sex offender's or
114114 7 sexual predator's telephone number, including cellular
115115 8 telephone number, the employer's telephone number, school
116116 9 attended, all e-mail addresses, instant messaging identities,
117117 10 chat room identities, and other Internet communications
118118 11 identities that the sex offender uses or plans to use, all
119119 12 Uniform Resource Locators (URLs) registered or used by the sex
120120 13 offender, all blogs and other Internet sites maintained by the
121121 14 sex offender or to which the sex offender has uploaded any
122122 15 content or posted any messages or information, extensions of
123123 16 the time period for registering as provided in this Article
124124 17 and, if an extension was granted, the reason why the extension
125125 18 was granted and the date the sex offender was notified of the
126126 19 extension. The information shall also include a copy of the
127127 20 terms and conditions of parole or release signed by the sex
128128 21 offender and given to the sex offender by his or her
129129 22 supervising officer or aftercare specialist, the county of
130130 23 conviction, license plate numbers for every vehicle registered
131131 24 in the name of the sex offender, the age of the sex offender at
132132 25 the time of the commission of the offense, the age of the
133133 26 victim at the time of the commission of the offense, and any

144144 1 distinguishing marks located on the body of the sex offender.
145145 2 A sex offender convicted under Section 11-6, 11-20.1,
146146 3 11-20.1B, 11-20.3, or 11-21 of the Criminal Code of 1961 or the
147147 4 Criminal Code of 2012 shall provide all Internet protocol (IP)
148148 5 addresses in his or her residence, registered in his or her
149149 6 name, accessible at his or her place of employment, or
150150 7 otherwise under his or her control or custody. If the sex
151151 8 offender is a child sex offender as defined in Section 11-9.3
152152 9 or 11-9.4 of the Criminal Code of 1961 or the Criminal Code of
153153 10 2012, the sex offender shall report to the registering agency
154154 11 whether he or she is living in a household with a child under
155155 12 18 years of age who is not his or her own child, provided that
156156 13 his or her own child is not the victim of the sex offense. The
157157 14 sex offender or sexual predator shall register:
158158 15 (1) with the chief of police in the municipality in
159159 16 which he or she resides or is temporarily domiciled for a
160160 17 period of time of 3 or more days, unless the municipality
161161 18 is the City of Chicago, in which case he or she shall
162162 19 register at a fixed location designated by the
163163 20 Superintendent of the Chicago Police Department; or
164164 21 (2) with the sheriff in the county in which he or she
165165 22 resides or is temporarily domiciled for a period of time
166166 23 of 3 or more days in an unincorporated area or, if
167167 24 incorporated, no police chief exists.
168168 25 If the sex offender or sexual predator is employed at or
169169 26 attends an institution of higher education, he or she shall

182182 3 (A) the chief of police in the municipality in
183183 4 which he or she is employed at or attends an
184184 5 institution of higher education, unless the
185185 6 municipality is the City of Chicago, in which case he

187187 8 by the Superintendent of the Chicago Police
188188 9 Department; or
189189 10 (B) the sheriff in the county in which he or she is
190190 11 employed or attends an institution of higher education

199199 20 For purposes of this Article, the place of residence or
200200 21 temporary domicile is defined as any and all places where the
201201 22 sex offender resides for an aggregate period of time of 3 or
202202 23 more days during any calendar year. Any person required to
203203 24 register under this Article who lacks a fixed address or
204204 25 temporary domicile must notify, in person, the agency of
205205 26 jurisdiction of his or her last known address within 3 days

217217 2 A sex offender or sexual predator who is temporarily
218218 3 absent from his or her current address of registration for 3 or
219219 4 more days shall notify the law enforcement agency having
220220 5 jurisdiction of his or her current registration, including the
221221 6 itinerary for travel, in the manner provided in Section 6 of
222222 7 this Act for notification to the law enforcement agency having
223223 8 jurisdiction of change of address.
224224 9 Any person who lacks a fixed residence must report weekly,
225225 10 in person, with the sheriff's office of the county in which he
226226 11 or she is located in an unincorporated area, or with the chief
227227 12 of police in the municipality in which he or she is located.
228228 13 The agency of jurisdiction will document each weekly
229229 14 registration to include all the locations where the person has
230230 15 stayed during the past 7 days.
231231 16 The sex offender or sexual predator shall provide accurate
232232 17 information as required by the Illinois State Police. That
233233 18 information shall include the sex offender's or sexual
234234 19 predator's current place of employment.
235235 20 (a-5) An out-of-state student or out-of-state employee
236236 21 shall, within 3 days after beginning school or employment in
237237 22 this State, register in person and provide accurate
238238 23 information as required by the Illinois State Police. Such
239239 24 information will include current place of employment, school
240240 25 attended, and address in state of residence. A sex offender

299299 12 General a copy of sex offender registration forms from persons
300300 13 convicted under Section 11-6, 11-20.1, 11-20.1B, 11-20.3, or
301301 14 11-21 of the Criminal Code of 1961 or the Criminal Code of
302302 15 2012, including periodic and annual registrations under
303303 16 Section 6 of this Act.
304304 17 (b) Any sex offender, as defined in Section 2 of this Act,
305305 18 or sexual predator, regardless of any initial, prior, or other
306306 19 registration, shall, within 3 days of beginning school, or
307307 20 establishing a residence, place of employment, or temporary
308308 21 domicile in any county, register in person as set forth in
309309 22 subsection (a) or (a-5).
310310 23 (c) The registration for any person required to register
311311 24 under this Article shall be as follows:
312312 25 (1) Any person registered under the Habitual Child Sex
313313 26 Offender Registration Act or the Child Sex Offender

324324 1 Registration Act prior to January 1, 1996, shall be deemed
325325 2 initially registered as of January 1, 1996; however, this
326326 3 shall not be construed to extend the duration of
327327 4 registration set forth in Section 7.
328328 5 (2) Except as provided in subsection (c)(2.1) or
329329 6 (c)(4), any person convicted or adjudicated prior to
330330 7 January 1, 1996, whose liability for registration under
331331 8 Section 7 has not expired, shall register in person prior
332332 9 to January 31, 1996.
333333 10 (2.1) A sex offender or sexual predator, who has never
334334 11 previously been required to register under this Act, has a
335335 12 duty to register if the person has been convicted of any
336336 13 felony offense after July 1, 2011. A person who previously
337337 14 was required to register under this Act for a period of 10
338338 15 years and successfully completed that registration period
339339 16 has a duty to register if: (i) the person has been
340340 17 convicted of any felony offense after July 1, 2011, and
341341 18 (ii) the offense for which the 10 year registration was
342342 19 served currently requires a registration period of more
343343 20 than 10 years. Notification of an offender's duty to
344344 21 register under this subsection shall be pursuant to
345345 22 Section 5-7 of this Act.
346346 23 (2.5) Except as provided in subsection (c)(4), any
347347 24 person who has not been notified of his or her
348348 25 responsibility to register shall be notified by a criminal
349349 26 justice entity of his or her responsibility to register.

360360 1 Upon notification the person must then register within 3
361361 2 days of notification of his or her requirement to
362362 3 register. Except as provided in subsection (c)(2.1), if
363363 4 notification is not made within the offender's 10 year
364364 5 registration requirement, and the Illinois State Police
365365 6 determines no evidence exists or indicates the offender
366366 7 attempted to avoid registration, the offender will no
367367 8 longer be required to register under this Act.
368368 9 (3) Except as provided in subsection (c)(4), any
369369 10 person convicted on or after January 1, 1996, shall
370370 11 register in person within 3 days after the entry of the
371371 12 sentencing order based upon his or her conviction.
372372 13 (4) Any person unable to comply with the registration
373373 14 requirements of this Article because he or she is
374374 15 confined, institutionalized, or imprisoned in Illinois on
375375 16 or after January 1, 1996, shall register in person within
376376 17 3 days of discharge, parole or release.
377377 18 (5) The person shall provide positive identification
378378 19 and documentation that substantiates proof of residence at
379379 20 the registering address.
380380 21 (6) No law enforcement agency shall impose a fee for
381381 22 registration on any person required to register under this
382382 23 Act. The person shall pay a $100 initial registration fee
383383 24 and a $100 annual renewal fee to the registering law
384384 25 enforcement agency having jurisdiction. The registering
385385 26 agency may waive the registration fee if it determines

396396 1 that the person is indigent and unable to pay the
397397 2 registration fee. Thirty-five dollars for the initial
398398 3 registration fee and $35 of the annual renewal fee shall
399399 4 be retained and used by the registering agency for
400400 5 official purposes. Having retained $35 of the initial
401401 6 registration fee and $35 of the annual renewal fee, the
402402 7 registering agency shall remit the remainder of the fee to
403403 8 State agencies within 30 days of receipt for deposit into
404404 9 the State funds as follows:
405405 10 (A) Five dollars of the initial registration fee
406406 11 and $5 of the annual fee shall be remitted to the State
407407 12 Treasurer who shall deposit the moneys into the Sex
408408 13 Offender Management Board Fund under Section 19 of the
409409 14 Sex Offender Management Board Act. Money deposited
410410 15 into the Sex Offender Management Board Fund shall be
411411 16 administered by the Sex Offender Management Board and
412412 17 shall be used by the Board to comply with the
413413 18 provisions of the Sex Offender Management Board Act.
414414 19 (B) Thirty dollars of the initial registration fee
415415 20 and $30 of the annual renewal fee shall be remitted to
416416 21 the Illinois State Police which shall deposit the
417417 22 moneys into the Offender Registration Fund.
418418 23 (C) Thirty dollars of the initial registration fee
419419 24 and $30 of the annual renewal fee shall be remitted to
420420 25 the Attorney General who shall deposit the moneys into
421421 26 the Attorney General Sex Offender Awareness, Training,

432432 1 and Education Fund. Moneys deposited into the Fund
433433 2 shall be used by the Attorney General to administer
434434 3 the I-SORT program and to alert and educate the
435435 4 public, victims, and witnesses of their rights under
436436 5 various victim notification laws and for training law
437437 6 enforcement agencies, State's Attorneys, and medical
438438 7 providers of their legal duties concerning the
439439 8 prosecution and investigation of sex offenses.
440440 9 The registering agency shall establish procedures to
441441 10 document the receipt and remittance of the $100 initial
442442 11 registration fee and $100 annual renewal fee.
443443 12 (d) Within 3 days after obtaining or changing employment
444444 13 and, if employed on January 1, 2000, within 5 days after that
445445 14 date, a person required to register under this Section must
446446 15 report, in person to the law enforcement agency having
447447 16 jurisdiction, the business name and address where he or she is
448448 17 employed. If the person has multiple businesses or work
449449 18 locations, every business and work location must be reported
450450 19 to the law enforcement agency having jurisdiction.

466466 1 Sec. 10. Duty to register.
467467 2 (a) A violent offender against youth shall, within the
468468 3 time period prescribed in subsections (b) and (c), register in
469469 4 person and provide accurate information as required by the
470470 5 Illinois State Police. Such information shall include a
471471 6 current photograph, current address, current place of
472472 7 employment, the employer's telephone number, school attended,
473473 8 extensions of the time period for registering as provided in
474474 9 this Act and, if an extension was granted, the reason why the
475475 10 extension was granted and the date the violent offender
476476 11 against youth was notified of the extension. A person who has
477477 12 been adjudicated a juvenile delinquent for an act which, if
478478 13 committed by an adult, would be a violent offense against
479479 14 youth shall register as an adult violent offender against
480480 15 youth within 10 days after attaining 17 years of age. The
481481 16 violent offender against youth shall register:
482482 17 (1) with the chief of police in the municipality in
483483 18 which he or she resides or is temporarily domiciled for a
484484 19 period of time of 5 or more days, unless the municipality
485485 20 is the City of Chicago, in which case he or she shall
486486 21 register at a fixed location designated by the
487487 22 Superintendent of the Chicago Police Department; or

502502 1 If the violent offender against youth is employed at or
503503 2 attends an institution of higher education, he or she shall

505505 4 (i) with the chief of police in the municipality in
506506 5 which he or she is employed at or attends an institution of
507507 6 higher education, unless the municipality is the City of
508508 7 Chicago, in which case he or she shall register at a fixed
509509 8 location designated by the Superintendent of the Chicago
510510 9 Police Department; or
511511 10 (ii) with the sheriff in the county in which he or she
512512 11 is employed or attends an institution of higher education
513513 12 located in an unincorporated area, or if incorporated, no
514514 13 police chief exists.
515515 14 For purposes of this Act, the place of residence or
516516 15 temporary domicile is defined as any and all places where the
517517 16 violent offender against youth resides for an aggregate period
518518 17 of time of 5 or more days during any calendar year. Any person
519519 18 required to register under this Act who lacks a fixed address
520520 19 or temporary domicile must notify, in person, the agency of
521521 20 jurisdiction of his or her last known address within 5 days
522522 21 after ceasing to have a fixed residence.
523523 22 Any person who lacks a fixed residence must report weekly,
524524 23 in person, with the sheriff's office of the county in which he
525525 24 or she is located in an unincorporated area, or with the chief
526526 25 of police in the municipality in which he or she is located.
527527 26 The agency of jurisdiction will document each weekly

539539 2 stayed during the past 7 days.
540540 3 The violent offender against youth shall provide accurate
541541 4 information as required by the Illinois State Police. That
542542 5 information shall include the current place of employment of
543543 6 the violent offender against youth.
544544 7 (a-5) An out-of-state student or out-of-state employee
545545 8 shall, within 5 days after beginning school or employment in
546546 9 this State, register in person and provide accurate
547547 10 information as required by the Illinois State Police. Such
548548 11 information will include current place of employment, school
549549 12 attended, and address in state of residence. The out-of-state
550550 13 student or out-of-state employee shall register:
551551 14 (1) with the chief of police in the municipality in
552552 15 which he or she attends school or is employed for a period
553553 16 of time of 5 or more days or for an aggregate period of
554554 17 time of more than 30 days during any calendar year, unless
555555 18 the municipality is the City of Chicago, in which case he
556556 19 or she shall register at a fixed location designated by
557557 20 the Superintendent of the Chicago Police Department; or
558558 21 (2) with the sheriff in the county in which he or she
559559 22 attends school or is employed for a period of time of 5 or
560560 23 more days or for an aggregate period of time of more than
561561 24 30 days during any calendar year in an unincorporated area
562562 25 or, if incorporated, no police chief exists.
563563 26 The out-of-state student or out-of-state employee shall

574574 1 provide accurate information as required by the Illinois State
575575 2 Police. That information shall include the out-of-state
576576 3 student's current place of school attendance or the
577577 4 out-of-state employee's current place of employment.
578578 5 (b) Any violent offender against youth regardless of any
579579 6 initial, prior, or other registration, shall, within 5 days of
580580 7 beginning school, or establishing a residence, place of
581581 8 employment, or temporary domicile in any county, register in
582582 9 person as set forth in subsection (a) or (a-5).
583583 10 (c) The registration for any person required to register
584584 11 under this Act shall be as follows:
585585 12 (1) Except as provided in paragraph (3) of this
586586 13 subsection (c), any person who has not been notified of
587587 14 his or her responsibility to register shall be notified by
588588 15 a criminal justice entity of his or her responsibility to
589589 16 register. Upon notification the person must then register
590590 17 within 5 days of notification of his or her requirement to
591591 18 register. If notification is not made within the
592592 19 offender's 10 year registration requirement, and the
593593 20 Illinois State Police determines no evidence exists or
594594 21 indicates the offender attempted to avoid registration,
595595 22 the offender will no longer be required to register under
596596 23 this Act.
597597 24 (2) Except as provided in paragraph (3) of this
598598 25 subsection (c), any person convicted on or after the
599599 26 effective date of this Act shall register in person within

610610 1 5 days after the entry of the sentencing order based upon
611611 2 his or her conviction.
612612 3 (3) Any person unable to comply with the registration
613613 4 requirements of this Act because he or she is confined,
614614 5 institutionalized, or imprisoned in Illinois on or after
615615 6 the effective date of this Act shall register in person
616616 7 within 5 days of discharge, parole or release.
617617 8 (4) The person shall provide positive identification
618618 9 and documentation that substantiates proof of residence at
619619 10 the registering address.
620620 11 (5) No law enforcement agency shall impose a fee for
621621 12 registration on any person required to register under this
622622 13 Act The person shall pay a $20 initial registration fee
623623 14 and a $10 annual renewal fee. The fees shall be deposited
624624 15 into the Offender Registration Fund. The fees shall be
625625 16 used by the registering agency for official purposes. The
626626 17 agency shall establish procedures to document receipt and
627627 18 use of the funds. The law enforcement agency having
628628 19 jurisdiction may waive the registration fee if it
629629 20 determines that the person is indigent and unable to pay
630630 21 the registration fee.
631631 22 (d) Within 5 days after obtaining or changing employment,
632632 23 a person required to register under this Section must report,
633633 24 in person to the law enforcement agency having jurisdiction,
634634 25 the business name and address where he or she is employed. If
635635 26 the person has multiple businesses or work locations, every
