11 104TH GENERAL ASSEMBLY State of Illinois 2025 and 2026 SB2227 Introduced 2/7/2025, by Sen. Andrew S. Chesney SYNOPSIS AS INTRODUCED: New Act Creates the Universal Basic Income Prohibition Act. Defines "universal basic income" as a government program that provides a base income to persons residing in Illinois by disbursing direct, recurring cash payments to persons to be used for any purpose without qualification or restriction. Provides that the General Assembly, a state agency, or a unit of local government may not pass a law, rule, resolution, or ordinance establishing a universal basic income program or any similar program. Provides that nothing in the Act shall be construed to (i) diminish, negate, or interfere with a State public aid or social welfare program established by law, rule, resolution, or ordinance before the effective date of the Act that does not meet the criteria of a universal basic income program, including, but not limited to, township general assistance programs, or (ii) prohibit the passage of a law, rule, resolution, or ordinance that establishes or implements a public aid or social welfare program that does not meet the criteria of a universal basic income program or any similar guaranteed income program. Limits home rule powers by providing that regulation of universal basic income is an exclusive power and function of the State. Effective immediately. 1111 1 AN ACT concerning government.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 1. Short title. This Act may be cited as the
1515 5 Universal Basic Income Prohibition Act.
1616 6 Section 5. Definitions. As used in this Act:
1717 7 "State agency" means all boards, commissions, agencies,
1818 8 institutions, authorities, and bodies politic and corporate of
1919 9 the State, created by or in accordance with the constitution
2020 10 or statute, of the executive branch of State government.
2121 11 "State agency" includes colleges, universities, and
2222 12 institutions under the jurisdiction of the governing boards of
2323 13 the University of Illinois, Southern Illinois University,
2424 14 Illinois State University, Eastern Illinois University,
2525 15 Northern Illinois University, Western Illinois University,
2626 16 Chicago State University, Governors State University,
2727 17 Northeastern Illinois University, and the Board of Higher
2828 18 Education. "State agency" does not include public employee
2929 19 retirement systems or investment boards that are subject to
3030 20 fiduciary duties imposed by the Illinois Pension Code or to
3131 21 the University of Illinois Foundation, units of local
3232 22 government, school districts, community colleges under the
3333 23 Public Community College Act, or the Illinois Comprehensive

6969 2 "Universal basic income" means a government program that
7070 3 provides a base income to persons residing in Illinois by
7171 4 disbursing direct, recurring cash payments to persons to be
7272 5 used for any purpose without qualification or restriction.
7373 6 Section 10. Prohibition on universal basic income
7474 7 programs. The General Assembly, a State agency, or a unit of
7575 8 local government may not pass a law, rule, resolution, or
7676 9 ordinance establishing a universal basic income program or any
7777 10 similar program.
7878 11 Section 15. Exceptions. Nothing in this Act shall be
7979 12 construed to (i) diminish, negate, or interfere with a State
8080 13 public aid or social welfare program established by law, rule,
8181 14 resolution, or ordinance before the effective date of this Act
8282 15 that does not meet the criteria of a universal basic income
8383 16 program, including, but not limited to, township general
8484 17 assistance programs established under the Township Code, or
8585 18 (ii) prohibit the passage of a law, rule, resolution, or
8686 19 ordinance that establishes or implements a public aid or
8787 20 social welfare program that does not meet the criteria of a
8888 21 universal basic income program or any similar guaranteed
8989 22 income program.
