311 1 AN ACT concerning business.
412 2 Be it enacted by the People of the State of Illinois,
513 3 represented in the General Assembly:
614 4 Section 1. Short title. This Act may be cited as the
715 5 Micromobility Fire Safety Act.
816 6 Section 5. Findings.
917 7 (a) Micromobility devices, such as electric bicycles,
1018 8 electric scooters, and personal e-mobility devices, like
1119 9 hoverboards and electric unicycles, are increasingly popular,
12-10 battery-powered transportation options for American consumers
20+10 battery powered transportation options for American consumers
1321 11 and workers.
14-12 (b) As battery-powered devices, micromobility devices can

1523 13 be a fire and explosion safety hazard if they do not meet

1725 15 (c) For micromobility devices that do not meet safety
1826 16 standards, there is a heightened risk of the lithium-ion

2028 18 failure where the overwhelming generation of heat triggers the
2129 19 release of toxic gases, explosions, or the spread of flames.
2230 20 (d) In 2021 and 2022, the U.S. Consumer Product Safety
2331 21 Commission received reports from 39 states of at least 208
2432 22 fires or overheating events that were associated with electric
2533 23 bicycles and personal e-mobility devices that caused 19

35-2 (e) There are consensus standards available that mitigate
36-3 the battery and electrical system hazards of electric bicycles
37-4 and personal e-mobility devices that can cause fires.
38-5 (f) In 2022, the U.S. Consumer Product Safety Commission
39-6 issued a letter to the manufacturers, importers, distributors,
40-7 and retailers of electric bicycles and personal e-mobility
41-8 devices urging these products to be "designed, manufactured,
42-9 and certified" to the appropriate UL standard as
43-10 "manufacturing these products in compliance with the
44-11 applicable UL standards significantly reduces the risk of
45-12 injuries and deaths from micromobility device fires."
46-13 (g) In 2023, after 216 micromobility device-related fires
47-14 in 2022 that caused 147 injuries and 6 fatalities, New York
48-15 City enacted legislation requiring micromobility device and
49-16 battery certification to the applicable UL safety standards by
50-17 an ISO-accredited laboratory.
51-18 Section 10. Definitions. As used in this Act:
52-19 "Accredited testing laboratory" means an independent
53-20 third-party organization providing certification and testing
54-21 for micromobility products, including low-speed electric
55-22 bicycles and personal e-mobility devices, that has received
56-23 ISO/IEC 17065 or ISO/IEC 17025 accreditation from an
57-24 independent accreditation body that is a member of the
58-25 International Accreditation Forum.

69-1 "Electric personal assistive mobility device" has the
70-2 meaning set forth in Section 1-117.7 of the Illinois Vehicle
71-3 Code.
72-4 "Lithium-ion battery" or "cell" means a rechargeable
73-5 electrochemical cell or battery in which the positive and
74-6 negative electrodes are both lithium compounds constructed
75-7 with no metallic lithium in either electrode. "Lithium-ion
76-8 battery" or "cell" includes a lithium-ion polymer battery or
77-9 cell that uses lithium-ion chemistries.
78-10 "Low-speed electric scooter" has the meaning set forth in
79-11 Section 1-140.11 of the Illinois Vehicle Code.
80-12 "Moped" has the meaning set forth in Section 1-148.2 of
81-13 the Illinois Vehicle Code.
82-14 "Motor-driven cycle" has the meaning set forth in Section
83-15 1-145.001 of the Illinois Vehicle Code.
84-16 "Off-highway motorcycle" has the meaning set forth in
85-17 Section 1-153.1 of the Illinois Vehicle Code.
86-18 "Personal e-mobility device" means a consumer mobility
87-19 device, other than a low-speed electric bicycle, intended for
88-20 a single rider with a traction battery and electric motor or
89-21 drive train that propels the device, which may be
90-22 self-balancing and may be provided with a handle for grasping
91-23 while riding, a seat for the rider, or operable pedals.
92-24 "Personal e-mobility device" includes an electric personal
93-25 assistive mobility device and low-speed electric scooter.
94-26 "Personal e-mobility device" also includes a skateboard,

106-2 those vehicles are propelled by an electric motor.
107-3 "Recycling" means any process by which materials that
108-4 would otherwise become waste are collected, separated, or
109-5 processed for the purpose of returning the materials to the
110-6 economic mainstream in the form of raw materials for new
111-7 products.
112-8 "Traction battery" means a rechargeable lithium-ion
113-9 battery used to power the electric drive motor of a low-speed
114-10 electric bicycles or personal e-mobility devices.
115-11 Section 15. Manufacture and distribution of low-speed
116-12 electric bicycles, personal e-mobility devices, and traction
117-13 batteries.
118-14 (a) No person shall manufacture, distribute, sell, lease,
119-15 rent, offer for sale, offer for lease, or offer for rent a
120-16 low-speed electric bicycle unless the electrical drive system
121-17 for the low-speed electric bicycle has been tested by an
122-18 accredited testing laboratory and found: (i) before January 1,
123-19 2028, to comply with ANSI/CAN/UL Standard 2849 or EN Standard
124-20 15194; or (ii) on or after January 1, 2028, to comply with
125-21 ANSI/CAN/UL Standard 2849.
126-22 (b) No person shall manufacture, distribute, sell, lease,
127-23 rent, offer for sale, offer for lease, offer for rent, or
128-24 operate in furtherance of a business activity a personal

69+2 (e) There are consensus standards available that mitigate

74+7 (f) In 2022, the U.S. Consumer Product Safety Commission

77+10 devices urging these products be "designed, manufactured, and
78+11 certified" to the appropriate UL standard as "manufacturing

86+19 (h) Studies have demonstrated that without conformity
87+20 assessment performed by a nationally-accredited independent
88+21 third-party certification organization, products are less
89+22 likely to meet product safety standards. Product safety
90+23 certification ensures safety is a level playing field in the
91+24 market.
92+25 Section 10. Definitions. As used in this Act:

140-1 personal e-mobility device has been tested by an accredited
141-2 testing laboratory and found to comply with ANSI/CAN/UL
142-3 Standard 2272.
143-4 (c) No person shall manufacture, distribute, sell, lease,
144-5 rent, offer for sale, offer for lease, or offer for rent a
145-6 traction battery for a low-speed electric bicycle unless the
146-7 traction battery has been tested by an accredited testing
147-8 laboratory and found: (i) before January 1, 2028, to comply
148-9 with ANSI/CAN/UL Standard 2271, ANSI/CAN/UL Standard 2849, or
149-10 EN Standard 15194; or (ii) on or after January 1, 2028, to
150-11 comply with ANSI/CAN/UL Standard 2271 or ANSI/CAN/UL Standard
151-12 2849.
152-13 (d) No person shall manufacture, distribute, sell, lease,
153-14 rent, offer for sale, offer for lease, or offer for rent a
154-15 traction battery for a personal e-mobility device unless the
155-16 traction battery has been tested by an accredited testing
156-17 laboratory and found to comply with ANSI/CAN/UL Standard 2271.
157-18 Section 20. Reconditioned traction batteries.
158-19 (a) It is unlawful for any person to:
159-20 (1) assemble or recondition a traction battery using
160-21 cells removed from used lithium-ion batteries; or
161-22 (2) sell or offer for sale a lithium-ion traction
162-23 battery that uses cells removed from used lithium-ion
163-24 batteries.
164-25 (b) Nothing in this Section shall be construed to prohibit

103+1 "Certification" means the attestation by the certification
104+2 body, indicated by the certification body's certification mark
105+3 on the equipment, device, or product, that the equipment,
106+4 device, or product has been evaluated and tested and found to
107+5 conform to relevant standards.
108+6 "Certification body" means an independent third-party
109+7 organization providing certification for micromobility
110+8 products that:
111+9 (1) is recognized by the U.S. Occupational Safety
112+10 and Health Administration as a nationally-recognized
113+11 testing laboratory; and
114+12 (2) has received ISO/IEC 17065 accreditation from
115+13 an independent accreditation body that is a member of
116+14 the International Accreditation Forum.
117+15 "Certification mark" means a mark of conformity owned by a
118+16 certification body and registered with the United States
119+17 Patent and Trademark Office that is visible and affixed to a
120+18 certified equipment, device, or product.
121+19 "Electric bicycle" means a 2-wheeled or 3-wheeled
122+20 electrical-mechanical device provided with functional pedals
123+21 that includes one or more electric motors to either assist the
124+22 rider when pedaling or provide motive power to the wheels when
125+23 the rider is not pedaling.
126+24 "ICS codes" mean codes published by the International
127+25 Organization for Standardization (ISO) that serve as a system
128+26 for categorizing the types of standards under the

175-1 the recycling of traction batteries or their components.
176-2 Section 25. Enforcement by Attorney General. A violation
177-3 of any of the provisions of this Act is an unlawful practice
178-4 under the Consumer Fraud and Deceptive Business Practices Act.
179-5 All remedies, penalties, and authority granted to the Attorney
180-6 General by that Act shall be available to the Attorney General
181-7 for the enforcement of this Act.
182-8 Section 90. The Consumer Fraud and Deceptive Business
183-9 Practices Act is amended by adding Section 2HHHH as follows:
184-10 (815 ILCS 505/2HHHH new)
185-11 Sec. 2HHHH. Violations of the Micromobility Fire Safety
186-12 Act. A person who violates the Micromobility Fire Safety Act
187-13 commits an unlawful practice within the meaning of this Act.
188-14 Section 99. Effective date. This Act takes effect January

139+1 International Classification for Standards.
140+2 "Micromobility devices" means the term inclusive of
141+3 e-bike, e-scooters, and other types of personal e-mobility
142+4 devices.
143+5 "Nationally-recognized testing laboratory" means an
144+6 organization that meets the qualifications provided in 29 CFR
145+7 1910.7(b) and is recognized as a nationally-recognized testing
146+8 laboratory by the U.S. Department of Labor, Occupational
147+9 Safety and Health Administration's Nationally-Recognized
148+10 Testing Laboratory (NRTL) Program.
149+11 "Personal e-mobility device" means a consumer mobility
150+12 device intended for a single rider with a rechargeable
151+13 electric drive train that propels the rider, and which may be
152+14 provided with a handle for grasping while riding. This device
153+15 may or may not be self-balancing and may or may not be seated.
154+16 "Traction battery" means a rechargeable battery used to
155+17 power the electric motors of the micromobility product.
156+18 "UL standards" means standards published by Underwriters
157+19 Laboratories for testing and manufacturing products to ensure
158+20 their safety, security, and sustainability.
159+21 Section 15. Requirements for manufacturer; distribution,
160+22 sale, lease, and rent of micromobility devices and traction
161+23 batteries. All micromobility devices and traction batteries
162+24 for micromobility devices manufactured, distributed, sold, or
163+25 offered for lease or rent in this State shall meet safety

175+2 (1) electric bicycles shall:
176+3 (A) be evaluated, tested, and certified to UL 2849
177+4 by a nationally-recognized testing laboratory with UL
178+5 2849 included in its scope of recognition under the
179+6 Nationally-Recognized Testing Laboratory (NRTL)
180+7 Program; and
181+8 (B) be affixed with a certification mark from a
182+9 certifying body with ICS 43.150, ICS 43.120, and UL
183+10 2849 included in the scope of accreditation;
184+11 (2) personal e-mobility devices shall:
185+12 (A) be evaluated, tested, and certified to UL 2272
186+13 by a nationally-recognized testing laboratory with UL
187+14 2849 included in its scope of recognition under the
188+15 Nationally-Recognized Testing Laboratory (NRTL)
189+16 Program; and
190+17 (B) be affixed with a certification mark from a
191+18 certifying body with ICS 29.220.99, ICS 43.120, and UL
192+19 2272 included in its scope of accreditation; and
193+20 (3) traction batteries for use in micromobility
194+21 devices shall:
195+22 (A) be evaluated, tested, and certified to UL 2271
196+23 by a nationally-recognized testing laboratory with UL
197+24 2849 included in its scope of recognition under the
198+25 Nationally-Recognized Testing Laboratory (NRTL)
