4 | 13 | | 2 Be it enacted by the People of the State of Illinois, |

6 | 15 | | 4 Section 5. The Rivers, Lakes, and Streams Act is amended |

7 | 16 | | 5 by changing Sections 26a and 35 as follows: |

9 | 18 | | 7 Sec. 26a. The Department of Natural Resources may issue |

10 | 19 | | 8 orders requiring all necessary remedial actions to correct |

11 | 20 | | 9 violations of this Act and impose the civil penalties provided |

12 | 21 | | 10 in this Section. All orders entered by the Department of |
---|
13 | 22 | | 11 Natural Resources shall be made only upon giving reasonable |
---|
14 | 23 | | 12 notice to persons to be affected by such orders; or having any |
---|
15 | 24 | | 13 interest in the subject matter of such orders and after a |
---|
16 | 25 | | 14 hearing in relation thereto. Any person who violates any |
---|
17 | 26 | | 15 provision of this Act; any rule or regulation adopted by the |
---|
18 | 27 | | 16 Department; any permit, term, or condition of this Act; or any |
---|
19 | 28 | | 17 order of the Department under this Act, shall be liable for a |
---|
20 | 29 | | 18 civil penalty of up to 2 times the applicable permit fee, but |
---|
21 | 30 | | 19 not to exceed $5,000 for a violation. The penalty fee may, upon |
---|
22 | 31 | | 20 order of the Department of Natural Resources or a court of |
---|
23 | 32 | | 21 competent jurisdiction, be made payable to the Department and |
---|
24 | 33 | | 22 deposited into the Water Resources State Boating Act Fund and |
---|

55 | | - | 22 Boating Act Fund under this Section shall not be subject to |

56 | | - | 23 administrative charges or chargebacks unless otherwise |
