316 1 AN ACT concerning health care.
417 2 Be it enacted by the People of the State of Illinois,
518 3 represented in the General Assembly:
619 4 Section 1. Short title. This Act may be cited as the
720 5 Psychiatric Residential Treatment Facilities (PRTF) Act.
821 6 Section 5. Definitions. As used in this Act:
922 7 "Department" means the Department of Healthcare and Family
1023 8 Services.
1124 9 "Emergency safety intervention" means the use of restraint
1225 10 or seclusion as an immediate response to an emergency safety
1326 11 situation.
1427 12 "Medical assistance" means health care benefits provided
1528 13 under the Illinois Medical Assistance Program administered
1629 14 under Article V of the Illinois Public Aid Code.
1730 15 "Psychiatric residential treatment facility" or "PRTF"
1831 16 means a facility that is certified by the Department to
1932 17 provide subacute psychiatric services to individuals under age
2033 18 21, or to individuals until their 22nd birthday if the
2134 19 individual was admitted to the PRTF before the individual's
2235 20 21st birthday as described in 42 CFR 441, Subpart D, or any
2336 21 successor regulation, in an inpatient setting in accordance
2437 22 with a provider agreement with the Department. A PRTF is not:
2538 23 (1) a hospital under the Hospital Licensing Act;

3483 1 (2) a child care institution or child care facility
3584 2 under the Child Care Act of 1969;
3685 3 (3) a nursing home or long-term care facility under
3786 4 the Nursing Home Care Act;
3887 5 (4) a secure residential youth care facility under the
3988 6 Secure Residential Youth Care Facility Licensing Act;
4089 7 (5) a specialized mental health rehabilitation
4190 8 facility under the Specialized Mental Health
4291 9 Rehabilitation Act of 2013; or
4392 10 (6) any facility or institution required to be
4493 11 licensed under the ID/DD Community Care Act or the MC/DD
4594 12 Act.
4695 13 "Serious occurrences" means a serious injury to a resident
4796 14 as defined in 42 CFR 483.352, or any successor regulation, a
4897 15 resident's suicide attempt, or a resident's death.
4998 16 "Subacute psychiatric services" means inpatient
5099 17 psychiatric treatment services provided under the direction of
51100 18 a physician, in a non-acute (non-hospital) setting, for
52101 19 individuals under the age of 21 (or for individuals until
53102 20 their 22nd birthday if admitted to the PRTF before their 21st
54103 21 birthday) that require intensive services that cannot be
55104 22 delivered in a community setting. Subacute psychiatric
56105 23 services are short-term, comprehensive, recovery-oriented
57106 24 treatment delivered 24 hours a day, 7 days a week, with the
58107 25 focus of returning children to a less restrictive community
59108 26 setting as rapidly as possible.

70119 1 Section 10. PRTF services.
71120 2 (a) The Department shall establish an Illinois Psychiatric
72121 3 Residential Treatment Facilities (PRTF) program that is
73122 4 family-driven, youth-guided, and trauma-informed, and includes
74123 5 youth and family involvement in all aspects of care planning.
75124 6 The Illinois PRTF program design shall establish meaningful
76125 7 opportunities for youth and families to be involved in the
77126 8 design, monitoring, and oversight of PRTF services.
78127 9 (b) By January 1, 2026, the Department shall submit a
79128 10 State Plan Amendment to the Centers for Medicare and Medicaid
80129 11 Services to establish coverage of federally authorized,
81130 12 medically necessary inpatient psychiatric services delivered
82131 13 by a certified PRTF to medical assistance beneficiaries under
83132 14 21 years of age.
84133 15 (c) The Department shall adopt rules to implement the
85134 16 Illinois PRTF program. The rules may establish the services,
86135 17 standards, and requirements for participation in the program
87136 18 to comply with all applicable federal statutes, regulations,
88137 19 requirements, and policies. The rules proposed by the
89138 20 Department may take into consideration the recommendations of
90139 21 the PRTF Advisory Committee, as outlined in Section 20. At a
91140 22 minimum, the rules shall include the following:
92141 23 (1) Certification and participation requirements for
93142 24 PRTF providers in compliance with all applicable federal

111160 7 to initiating services and all PRTFs shall have at least
112161 8 one on-site review annually thereafter.
113162 9 (3) Utilization management criteria to ensure that
114163 10 PRTF services are provided as medically necessary and
115164 11 emphasize clinically appropriate patient transitions back
116165 12 to the community, including, but not limited to, service
117166 13 authorization, documentation, and treatment plan
118167 14 requirements for initial stay reviews and continued stay
119168 15 reviews.
120169 16 (4) A limit on allowable beds at any one PRTF, not to
121170 17 exceed 40 total beds, unless waived in writing by the
122171 18 Director of the Department.
123172 19 (5) A limit on the number of new PRTF facilities to be
124173 20 certified in any State fiscal year.
125174 21 (6) A requirement that PRTFs are distinct, standalone
126175 22 non-hospital entities not physically attached or adjacent
127176 23 to any other type of facility engaged in providing
128177 24 congregate care.

151200 11 Healthcare Organizations.
152201 12 (ii) The Commission on Accreditation of
153202 13 Rehabilitation Facilities.
154203 14 (iii) The Council on Accreditation of Services for
155204 15 Families and Children.
156205 16 (iv) Any other accrediting organization with
157206 17 comparable standards recognized by the Department.
158207 18 (9) Requirements for the reporting of emergency safety
159208 19 interventions and serious occurrences to the Department
160209 20 and the State-designated Protection and Advocacy System no
161210 21 later than the close of business the next business day
162211 22 after the intervention or occurrence.
163212 23 Section 15. PRTF capacity analysis.
164213 24 (a) The Department shall establish, and update as needed,

186235 11 (2) Identification of locations across the State with
187236 12 demonstrated need for PRTF services and locations with
188237 13 demonstrated surplus of PRTF service capacity.
189238 14 (3) Consideration of specialized treatment needs based
190239 15 on increased utilization of out-of-state facilities to
191240 16 address specialized treatment needs.
192241 17 (4) Other factors of consideration identified by the
193242 18 Department as necessary to support access to care,
194243 19 compliance with the federal Medicaid program, and all
195244 20 other applicable federal or State laws, regulations,
196245 21 policies, requirements, and programs impacting Illinois'
197246 22 children's behavioral health service delivery system.
198247 23 (5) Recommendations to the Department and the PRTF
199248 24 Advisory Committee on capacity needs within the Illinois
200249 25 PRTF program. The recommendations shall seek to avoid the
201250 26 concentration of PRTF facilities in any particular

214263 3 (b) The Department's methodology, completed analyses, and

218267 7 (c) The Department's PRTF capacity analysis shall be
219268 8 updated at a minimum of every 5 years and shall be performed
220269 9 consistent with the Department's published methodology.
221270 10 Section 20. PRTF Advisory Committee.
222271 11 (a) The Department shall establish a PRTF Advisory
223272 12 Committee responsible for reviewing and providing guidance on
224273 13 the Department's policies and implementations of the Illinois
225274 14 PRTF program. The PRTF Advisory Committee shall be made up of
226275 15 no more than 12 members, including State agency staff familiar
227276 16 with children's behavioral health services, and shall
228277 17 minimally include the following members:
229278 18 (1) the Director of Healthcare and Family Services, or
230279 19 the Director's designee, who shall also be the Chair of
231280 20 the Committee;
232281 21 (2) the Director of Public Health, or the Director's
233282 22 designee;
234283 23 (3) the Secretary of Human Services, or the
235284 24 Secretary's designee;

366415 15 complete act of administration entails removing an individual
367416 16 dose from a container, verifying the dose with the
368417 17 prescriber's orders, giving the individual dose to the
369418 18 consumer, and promptly recording the time and dose given.
370419 19 "Drug dispensing" means the act entailing the following of
371420 20 a prescription order for a drug or biological and proper
372421 21 selection, measuring, packaging, labeling, and issuance of the
373422 22 drug or biological to a consumer.
374423 23 "Emergency" means a situation, physical condition, or one
375424 24 or more practices, methods, or operations which present
376425 25 imminent danger of death or serious physical or mental harm to
377426 26 consumers of a facility.

402451 15 facility is 65 years of age or older;
403452 16 (3) none of the consumers are non-ambulatory;
404453 17 (4) none of the consumers have a primary diagnosis of
405454 18 moderate, severe, or profound intellectual disability; and
406455 19 (5) the facility must have been licensed under the
407456 20 Specialized Mental Health Rehabilitation Act or the
408457 21 Nursing Home Care Act immediately preceding July 22, 2013
409458 22 (the effective date of this Act) and qualifies as an
410459 23 institute for mental disease under the federal definition
411460 24 of the term.
412461 25 "Facility" does not include the following:
413462 26 (1) a home, institution, or place operated by the

545594 14 "Misappropriation of a consumer's property" means the
546595 15 deliberate misplacement, exploitation, or wrongful temporary
547596 16 or permanent use of a consumer's belongings or money without
548597 17 the consent of a consumer or his or her guardian.
549598 18 "Neglect" means a facility's failure to provide, or
550599 19 willful withholding of, adequate medical care, mental health
551600 20 treatment, psychiatric rehabilitation, personal care, or
552601 21 assistance that is necessary to avoid physical harm and mental
553602 22 anguish of a consumer.
554603 23 "Personal care" means assistance with meals, dressing,
555604 24 movement, bathing, or other personal needs, maintenance, or
556605 25 general supervision and oversight of the physical and mental

581630 14 "Restraint" means:
582631 15 (i) a physical restraint that is any manual method or
583632 16 physical or mechanical device, material, or equipment
584633 17 attached or adjacent to a consumer's body that the
585634 18 consumer cannot remove easily and restricts freedom of
586635 19 movement or normal access to one's body; devices used for
587636 20 positioning, including, but not limited to, bed rails,
588637 21 gait belts, and cushions, shall not be considered to be
589638 22 restraints for purposes of this Section; or
590639 23 (ii) a chemical restraint that is any drug used for
591640 24 discipline or convenience and not required to treat
592641 25 medical symptoms; the Department shall, by rule, designate

615664 12 that provides short-term behavioral, emotional, or psychiatric
616665 13 crisis stabilization as an alternative to hospitalization or
617666 14 re-hospitalization for consumers from residential or community
618667 15 placement. The duration of stay in such a setting shall not
619668 16 exceed 21 days for each consumer.
620669 17 "Therapeutic separation" means the removal of a consumer
621670 18 from the milieu to a room or area which is designed to aid in
622671 19 the emotional or psychiatric stabilization of that consumer.
623672 20 "Triage center" means a non-residential 23-hour center
624673 21 that serves as an alternative to emergency room care,
625674 22 hospitalization, or re-hospitalization for consumers in need
626675 23 of short-term crisis stabilization. Consumers may access a
627676 24 triage center from a number of referral sources, including
628677 25 family, emergency rooms, hospitals, community behavioral

762811 17 (F) "Federally designated organ procurement agency" means
763812 18 the organ procurement agency designated by the Secretary of
764813 19 the U.S. Department of Health and Human Services for the
765814 20 service area in which a hospital is located; except that in the
766815 21 case of a hospital located in a county adjacent to Wisconsin
767816 22 which currently contracts with an organ procurement agency
768817 23 located in Wisconsin that is not the organ procurement agency
769818 24 designated by the U.S. Secretary of Health and Human Services
770819 25 for the service area in which the hospital is located, if the
771820 26 hospital applies for a waiver pursuant to 42 U.S.C.

792841 11 human body. "Tissue bank" does not include a licensed blood
793842 12 bank. For the purposes of this Act, "tissue" does not include

795844 14 (H) "Campus", as this term applies to operations, has the
796845 15 same meaning as the term "campus" as set forth in federal
797846 16 Medicare regulations, 42 CFR 413.65.
