11	11	1 AN ACT concerning wildlife.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 5. The Wildlife Code is amended by changing
15	15	5 Section 3.1-6 as follows:

17	17	7 Sec. 3.1-6. Landowner or tenant Special deer, turkey, and
18	18	8 combination hunting permits licenses.
19	19	9 (a) For the purpose of this Section:
20	20	10 "Bona fide current income beneficiary" means, an
21	21	11 individual who, at the time of application for a permit, is
22	22	12 entitled, with no condition precedent other than the trustee
23	23	13 distributing the income, to income from the trust that owns
24	24	14 Illinois land the applicant wishes to hunt, regardless of
25	25	15 whether income exists or not, and is listed by name in the
26	26	16 trust documents as an income beneficiary.
27	27	17 "Bona fide equity member" means an individual who:
28	28	18 (1) (i) became a member upon the formation of the
29	29	19 limited liability company or (ii) has purchased a
30	30	20 distributional interest in a limited liability company for
31	31	21 a value equal to the percentage of the appraised value of
32	32	22 the LLC assets represented by the distributional interest
33	33	23 in the LLC and subsequently becomes a member of the

68	68	1 company under Article 30 of the Limited Liability Company
69	69	2 Act; and
70	70	3 (2) intends to retain the membership for at least 5
71	71	4 years.
72	72	5 "Bona fide equity partner" means an individual who:
73	73	6 (1) (i) became a partner, either general or limited,
74	74	7 upon the formation of a partnership or limited
75	75	8 partnership, or (ii) has purchased, acquired, or been
76	76	9 gifted a partnership interest accurately representing his
77	77	10 or her percentage distributional interest in the profits,
78	78	11 losses, and assets of a partnership or limited
79	79	12 partnership;
80	80	13 (2) intends to retain ownership of the partnership
81	81	14 interest for at least 5 years; and
82	82	15 (3) is a resident of this State.
83	83	16 "Bona fide equity shareholder" means an individual who:
84	84	17 (1) purchased, for market price, publicly sold stock
85	85	18 shares in a corporation, purchased shares of a
86	86	19 privately-held corporation for a value equal to the
87	87	20 percentage of the appraised value of the corporate assets
88	88	21 represented by the ownership in the corporation, or is a
89	89	22 member of a closely-held family-owned corporation and has
90	90	23 purchased or been gifted with shares of stock in the
91	91	24 corporation accurately reflecting his or her percentage of
92	92	25 ownership; and
93	93	26 (2) intends to retain the ownership of the shares of

104	104	1 stock for at least 5 years.
105	105	2 "Bona fide landowner" means a person that owns land in
106	106	3 this State and whose name appear on the title to the land and
107	107	4 not as a part of a trust, corporation, limited liability
108	108	5 company, or partnership.
109	109	6 "Tenant" means a person who rents 40 acres or more of land
110	110	7 in this State for commercial agricultural purposes under a
111	111	8 written notarized agreement with the landowner.
112	112	9 (b) Landowner deer Deer, turkey Turkey, and combination
113	113	10 permits shall be issued without charge to an Illinois resident
114	114	11 who owns at least 40 acres of Illinois land and wishes to hunt
115	115	12 only on land that the Illinois resident owns. Land ownership
116	116	13 shall be accepted by the Department only for the following
117	117	14 types of landowners, beneficiaries, and shareholders:
118	118	15 (1) bona fide Illinois landowners residing in this
119	119	16 State who own at least 40 acres of Illinois land and wish
120	120	17 to hunt upon their land only;
121	121	18 (2) bona fide current income beneficiaries of a trust
122	122	19 that owns land in this State resident tenants of at least
123	123	20 40 acres of commercial agricultural land where they will
124	124	21 hunt; and
125	125	22 (3) bona fide equity shareholders of a corporation,
126	126	23 bona fide equity members of a limited liability company,
127	127	24 or bona fide equity partners of a general or limited
128	128	25 partnership which owns at least 40 acres of land in a
129	129	26 county in this State who wish to hunt on the

140	140	1 corporation's, company's, or partnership's land only. One
141	141	2 permit shall be issued without charge to one bona fide
142	142	3 equity shareholder, one bona fide equity member, or one
143	143	4 bona fide equity partner for each 40 acres of land owned by
144	144	5 the corporation, company, or partnership in a county;
145	145	6 however, the number of permits issued without charge to
146	146	7 bona fide equity shareholders of any corporation or bona
147	147	8 fide equity members of a limited liability company in any
148	148	9 county shall not exceed 15, and shall not exceed 3 in the
149	149	10 case of bona fide equity partners of a partnership.
150	150	11 (c) Tenant deer, turkey, or combination permits shall be
151	151	12 issued without charge to Illinois resident tenants of at least
152	152	13 40 acres of commercial agricultural land who wish to hunt only
153	153	14 upon the land upon which they are resident tenants.
154	154	15 (d) The total number of deer, turkey, or combination
155	155	16 hunting permits that may be issued to a person shall be set by
156	156	17 the Department by administrative rule.
157	157	18 (e) Bona fide landowners or tenants who do not wish to hunt
158	158	19 only on the land they own, tenants who do not wish to hunt only
159	159	20 the land they rent, or lease, or bona fide equity
160	160	21 shareholders, bona fide equity members, bona fide current
161	161	22 income beneficiaries of a trust, or bona fide equity partners
162	162	23 who do not wish to hunt only on the land owned by the
163	163	24 corporation, limited liability company, trust, or partnership
164	164	25 shall be charged the same fee as the applicant who is not a
165	165	26 bona fide landowner, Illinois resident tenant, bona fide

176	176	1 equity shareholder, bona fide equity member, bona fide current
177	177	2 income beneficiary of a trust, or bona fide equity partner.
178	178	3 Nonresidents of this State who own at least 40 acres of land as
179	179	4 a bona fide landowner, a bona fide current income beneficiary
180	180	5 of a trust, a bona fide equity shareholder, or a bona fide
181	181	6 equity member and wish to hunt on their land only shall be
182	182	7 charged a fee set by administrative rule. The method for
183	183	8 obtaining these permits shall be prescribed by administrative
184	184	9 rule.
185	185	10 (f) (c) The deer, turkey, or combination hunting permit
186	186	11 issued without fee shall be valid on all Illinois farm lands
187	187	12 which the person to whom it is issued owns, which shall only
188	188	13 include land owned by the individual as a bona fide landowner,
189	189	14 land owned as a bona fide equity shareholder of a corporation,
190	190	15 land owned by the individual as a bona fide equity member of a
191	191	16 limited liability company or land owned by the individual as a
192	192	17 bona fide equity partner of a partnership. , leases or rents,
193	193	18 except that in the case of a permit issued to a bona fide
194	194	19 equity shareholder, bona fide equity member, or bona fide
195	195	20 equity partner, the permit shall be valid on all lands owned by
196	196	21 the corporation, limited liability company, or partnership in
197	197	22 the county.
198	198	23 (g) Any person that is issued a permit under this Section
199	199	24 must have on their person at all times, while hunting pursuant
200	200	25 to that permit, the permit so issued as well as documentation
201	201	26 showing proof of their status for the land upon which they are
