Cristina Castro SYNOPSIS AS INTRODUCED: New Act Creates the University Construction Management Autonomy Act. Provides that public universities in the State shall be granted autonomy to manage construction projects funded by the State, as long as the total State funding does not exceed $20,000,000. Provides that the autonomy granted to universities shall include the authority to: (1) develop and approve project plans, budgets, and timelines; (2) select contractors, architects, and other necessary personnel for the project; (3) procure materials and equipment necessary for the project in compliance with State statutes, rules, and standards; and (4) monitor and oversee the progress of the project to ensure compliance with State rules and standards. Allows the public universities to have the option to use the services of the Capital Development Board for construction projects. Provides that public universities availing themselves of the autonomy shall provide regular reports to the Board of Higher Education detailing the progress, expenditures, and outcomes of construction projects managed independently. 1111 1 AN ACT concerning education.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 1. Short title. This Act may be cited as the
1515 5 University Construction Management Autonomy Act.
1616 6 Section 5. Purpose. This Act aims to grant public
1717 7 universities in the State the authority to independently
1818 8 manage construction projects funded by the State, up to a
1919 9 maximum of $20,000,000, without the oversight of the Capital
2020 10 Development Board (CDB). Additionally, it provides
2121 11 universities with the option to use the services of the CDB
2222 12 should they determine it to be advantageous to the
2323 13 university's interests.
2424 14 Section 10. Definitions. As used in this Act:
2525 15 "Capital Development Board" or "CDB" means the State
2626 16 agency responsible for overseeing and managing construction
2727 17 projects funded by the State.
2828 18 "Construction projects" means any building, renovation, or
2929 19 infrastructure project undertaken by a public university for
3030 20 the purposes of expanding or maintaining its campus
3131 21 facilities.

6969 3 Section 15. Granting autonomy.
7070 4 (a) Public universities in the State shall be granted
7171 5 autonomy to manage construction projects funded by the State,
7272 6 as long as the total State funding does not exceed
7373 7 $20,000,000.
7474 8 (b) The autonomy granted to universities shall include the
7575 9 authority to:
7676 10 (1) Develop and approve project plans, budgets, and
7777 11 timelines.
7878 12 (2) Select contractors, architects, and other
7979 13 necessary personnel for the project.
8080 14 (3) Procure materials and equipment necessary for the
8181 15 project in compliance with State statutes, rules, and
8282 16 standards.
8383 17 (4) Monitor and oversee the progress of the project to
8484 18 ensure compliance with State rules and standards.
8585 19 (c) Public universities shall be responsible for the
8686 20 proper allocation and use of State funds allocated for
8787 21 construction projects under their management.
8888 22 Section 20. Option to use Capital Development Board.
8989 23 (a) Public universities shall have the option to use the

101101 1 projects, if they determine it to be in the best interests of

103103 3 (b) Universities opting to use the services of the CDB
104104 4 shall enter into agreements outlining the scope of work,
105105 5 responsibilities, and any associated costs.
106106 6 (c) The decision to use the CDB shall be made by the
107107 7 governing body of the respective university, such as the Board
108108 8 of Trustees or equivalent authority.
109109 9 Section 25. Reporting requirements. Public universities
110110 10 availing themselves of the autonomy granted under this Act
111111 11 shall provide regular reports to the Board of Higher Education
112112 12 detailing the progress, expenditures, and outcomes of
113113 13 construction projects managed independently.
114114 14 Section 30. Severability. If any provision of this Act is
115115 15 found to be invalid or unconstitutional, the remaining
116116 16 provisions shall remain in full force and effect.
117117 17 Section 35. Repeal. Any laws or provisions in conflict
118118 18 with this Act are hereby repealed.
