11	11	1 AN ACT concerning education.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 1. Short title. This Act may be cited as the
15	15	5 University Construction Management Autonomy Act.
16	16	6 Section 5. Purpose. This Act aims to grant public
17	17	7 universities in the State the authority to independently
18	18	8 manage construction projects funded by the State, up to a
19	19	9 maximum of $20,000,000, without the oversight of the Capital
20	20	10 Development Board (CDB). Additionally, it provides
21	21	11 universities with the option to use the services of the CDB
22	22	12 should they determine it to be advantageous to the
23	23	13 university's interests.
24	24	14 Section 10. Definitions. As used in this Act:
25	25	15 "Capital Development Board" or "CDB" means the State
26	26	16 agency responsible for overseeing and managing construction
27	27	17 projects funded by the State.
28	28	18 "Construction projects" means any building, renovation, or
29	29	19 infrastructure project undertaken by a public university for
30	30	20 the purposes of expanding or maintaining its campus
31	31	21 facilities.

69	69	3 Section 15. Granting autonomy.
70	70	4 (a) Public universities in the State shall be granted
71	71	5 autonomy to manage construction projects funded by the State,
72	72	6 as long as the total State funding does not exceed
73	73	7 $20,000,000.
74	74	8 (b) The autonomy granted to universities shall include the
75	75	9 authority to:
76	76	10 (1) Develop and approve project plans, budgets, and
77	77	11 timelines.
78	78	12 (2) Select contractors, architects, and other
79	79	13 necessary personnel for the project.
80	80	14 (3) Procure materials and equipment necessary for the
81	81	15 project in compliance with State statutes, rules, and
82	82	16 standards.
83	83	17 (4) Monitor and oversee the progress of the project to
84	84	18 ensure compliance with State rules and standards.
85	85	19 (c) Public universities shall be responsible for the
86	86	20 proper allocation and use of State funds allocated for
87	87	21 construction projects under their management.
88	88	22 Section 20. Option to use Capital Development Board.
89	89	23 (a) Public universities shall have the option to use the
90	90	24 services of the Capital Development Board for construction

101	101	1 projects, if they determine it to be in the best interests of
102	102	2 the university.
103	103	3 (b) Universities opting to use the services of the CDB
104	104	4 shall enter into agreements outlining the scope of work,
105	105	5 responsibilities, and any associated costs.
106	106	6 (c) The decision to use the CDB shall be made by the
107	107	7 governing body of the respective university, such as the Board
108	108	8 of Trustees or equivalent authority.
109	109	9 Section 25. Reporting requirements. Public universities
110	110	10 availing themselves of the autonomy granted under this Act
111	111	11 shall provide regular reports to the Board of Higher Education
112	112	12 detailing the progress, expenditures, and outcomes of
113	113	13 construction projects managed independently.
114	114	14 Section 30. Severability. If any provision of this Act is
115	115	15 found to be invalid or unconstitutional, the remaining
116	116	16 provisions shall remain in full force and effect.
117	117	17 Section 35. Repeal. Any laws or provisions in conflict
118	118	18 with this Act are hereby repealed.
