1111 1 AN ACT concerning transportation.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Illinois Vehicle Code is amended by
1515 5 changing Section 6-115 as follows:

1717 7 Sec. 6-115. Expiration of driver's license.
1818 8 (a) Except as provided elsewhere in this Section, every
1919 9 driver's license issued under the provisions of this Code
2020 10 shall expire 4 years from the date of its issuance, or at such
2121 11 later date, as the Secretary of State may by proper rule and
2222 12 regulation designate, not to exceed 12 calendar months; in the
2323 13 event that an applicant for renewal of a driver's license
2424 14 fails to apply prior to the expiration date of the previous
2525 15 driver's license, the renewal driver's license shall expire 4
2626 16 years from the expiration date of the previous driver's
2727 17 license, or at such later date as the Secretary of State may by
2828 18 proper rule and regulation designate, not to exceed 12
2929 19 calendar months.
3030 20 The Secretary of State may, however, issue to a person not
3131 21 previously licensed as a driver in Illinois a driver's license
3232 22 which will expire not less than 4 years nor more than 5 years
3333 23 from date of issuance, except as provided elsewhere in this

6868 1 Section.
6969 2 (a-3) Beginning no later than July 1, 2027, the Secretary
7070 3 shall offer to qualified applicants the option to be issued an
7171 4 8-year driver's license. The Secretary shall submit proposed
7272 5 rules to implement this subsection to the Joint Committee on
7373 6 Administrative Rules no later than January 1, 2027.
7474 7 (a-5) Every driver's license issued under this Code to an
7575 8 applicant who is not a United States citizen or permanent
7676 9 resident, or an individual who has an approved application for
7777 10 asylum in the United States or has entered the United States in
7878 11 refugee status, shall expire on whichever is the earlier date
7979 12 of the following:
8080 13 (1) as provided under subsection (a), (f), (g), or (i)
8181 14 of this Section;
8282 15 (2) on the date the applicant's authorized stay in the
8383 16 United States terminates; or
8484 17 (3) if the applicant's authorized stay is indefinite
8585 18 and the applicant is applying for a Limited Term REAL ID
8686 19 compliant driver's license, one year from the date of
8787 20 issuance of the license.
8888 21 (a-10) Every REAL ID compliant driver's license issued
8989 22 under this Code to an applicant who is not a United States
9090 23 citizen or permanent resident, or an individual who has an
9191 24 approved application for asylum in the United States or has
9292 25 entered the United States in refugee status, shall be marked
9393 26 "Limited Term".

104104 1 (b) Before the expiration of a driver's license, except
105105 2 those licenses expiring on the individual's 21st birthday, or
106106 3 3 months after the individual's 21st birthday, the holder
107107 4 thereof may apply for a renewal thereof, subject to all the
108108 5 provisions of Section 6-103, and the Secretary of State may
109109 6 require an examination of the applicant. A licensee whose
110110 7 driver's license expires on his 21st birthday, or 3 months
111111 8 after his 21st birthday, may not apply for a renewal of his
112112 9 driving privileges until he reaches the age of 21.
113113 10 (c) The Secretary of State shall, 30 days prior to the
114114 11 expiration of a driver's license, forward to each person whose
115115 12 license is to expire a notification of the expiration of said
116116 13 license which may be presented at the time of renewal of said
117117 14 license.
118118 15 There may be included with such notification information
119119 16 explaining the anatomical gift and Emergency Medical
120120 17 Information Card provisions of Section 6-110. The format and
121121 18 text of such information shall be prescribed by the Secretary.
122122 19 There shall be included with such notification, for a
123123 20 period of 4 years beginning January 1, 2000 information
124124 21 regarding the Illinois Adoption Registry and Medical
125125 22 Information Exchange established in Section 18.1 of the
126126 23 Adoption Act.
127127 24 (d) The Secretary may defer the expiration of the driver's
128128 25 license of a licensee, or of a spouse or , and dependent

140140 1 duty, serving in the Armed Forces of the United States outside
141141 2 of the State of Illinois for any length of time, in the
142142 3 Secretary's discretion, that does not exceed 6 months
143143 4 following the discharge of the licensee from the Armed Forces
144144 5 of the United States or within 90 days after reestablishing
145145 6 residence within the State, whichever is sooner , and 120 days
146146 7 thereafter, upon such terms and conditions as the Secretary
147147 8 may prescribe.
148148 9 (d-5) The Secretary may defer the expiration of the
149149 10 driver's license of a licensee, or of a spouse or dependent
150150 11 children living with the licensee, serving as a civilian
151151 12 employee of the United States Armed Forces or the United
152152 13 States Department of Defense, outside of the State of
153153 14 Illinois, and 120 days thereafter, upon such terms and
154154 15 conditions as the Secretary may prescribe.
155155 16 (e) The Secretary of State may decline to process a
156156 17 renewal of a driver's license of any person who has not paid
157157 18 any fee or tax due under this Code and is not paid upon
158158 19 reasonable notice and demand.
159159 20 (f) The Secretary shall provide that each original or
160160 21 renewal driver's license issued to a licensee under 21 years
161161 22 of age shall expire 3 months after the licensee's 21st
162162 23 birthday. Persons whose current driver's licenses expire on
163163 24 their 21st birthday on or after January 1, 1986 shall not renew
164164 25 their driver's license before their 21st birthday, and their
165165 26 current driver's license will be extended for an additional
