4478 12 Sec. 0.05. Legislative Intent. This Act is enacted for the
4579 13 purpose of protecting the public health, safety, and welfare,

4882 16 physical therapy. It is the legislature's intent that only
4983 17 individuals who meet and maintain prescribed standards of
5084 18 competence and conduct may engage in the practice of physical
5185 19 therapy as authorized by this Act. This Act shall be liberally
5286 20 construed to promote the public interest and to accomplish the
5387 21 purpose stated herein. This Act does not prohibit a person
5488 22 licensed under any other Act in this State from engaging in the
5589 23 practice for which that person he or she is licensed or from
5690 24 delegating services as provided for under that other Act.

70104 4 Sec. 1. Definitions. As used in this Act:
71105 5 (1) "Physical therapy" means all of the following:
72106 6 (A) Examining, evaluating, and testing individuals who

74108 8 impairments, functional limitations, disabilities, or
75109 9 other health and movement-related conditions, classifying
76110 10 these disorders, determining a rehabilitation prognosis
77111 11 and plan of therapeutic intervention, and assessing the
78112 12 ongoing effects of the interventions.
79113 13 (B) Alleviating impairments, functional limitations,
80114 14 or disabilities by designing, implementing, and modifying
81115 15 therapeutic interventions that may include, but are not
82116 16 limited to, the evaluation or treatment of a patient
83117 17 person through the use of the effective properties of
84118 18 physical measures and heat, cold, light, water, radiant
85119 19 energy, electricity, sound, and air and use of therapeutic
86120 20 massage, therapeutic exercise, mobilization, dry needling,
87121 21 and rehabilitative procedures, with or without assistive
88122 22 devices and equipment, for the purposes of preventing,
89123 23 correcting, or alleviating a physical or mental
90124 24 impairment, functional limitation, or disability.

109143 8 administration of specialized treatment procedures, (c)
110144 9 interpretation of referrals from physicians, dentists,
111145 10 advanced practice registered nurses, physician assistants, and
112146 11 podiatric physicians, (d) establishment, and modification of
113147 12 physical therapy treatment programs, (e) administration of
114148 13 topical medication used in generally accepted physical therapy
115149 14 procedures when such medication is either prescribed by the
116150 15 patient's physician, licensed to practice medicine in all its
117151 16 branches, the patient's physician licensed to practice
118152 17 podiatric medicine, the patient's advanced practice registered
119153 18 nurse, the patient's physician assistant, or the patient's
120154 19 dentist or used following the physician's orders or written
121155 20 instructions, (f) supervision or teaching of physical therapy,
122156 21 and (g) dry needling in accordance with Section 1.5. "Physical
123157 22 therapy" does not include practicing radiology,
124158 23 electrosurgery, acupuncture, chiropractic technique or
125159 24 providing a determination of a differential diagnosis;
126160 25 provided, however, the limitation on determining a
127161 26 differential diagnosis shall not in any manner limit a

138172 1 physical therapist licensed under this Act from performing an
139173 2 evaluation and establishing a physical therapy treatment plan
140174 3 pursuant to such license. Nothing in this Section shall limit
141175 4 a physical therapist from employing appropriate physical
142176 5 therapy techniques that the physical therapist he or she is
143177 6 educated and licensed to perform.
144178 7 (2) "Physical therapist" means a person who practices
145179 8 physical therapy and who has met all requirements as provided
146180 9 in this Act.
147181 10 (3) "Department" means the Department of Financial and
148182 11 Professional Regulation.
149183 12 (4) "Director" means the Director of the Division of
150184 13 Professional Regulation of the Department of Financial and
151185 14 Professional Regulation with the duties as designated by the
152186 15 Secretary.
153187 16 (5) "Board" means the Physical Therapy Licensing and
154188 17 Disciplinary Board approved by the Secretary Director.
155189 18 (6) "Referral" means a written or oral authorization for
156190 19 physical therapy services for a patient by a physician,
157191 20 dentist, advanced practice registered nurse, physician
158192 21 assistant, or podiatric physician who maintains medical
159193 22 supervision of the patient and makes a diagnosis or verifies
160194 23 that the patient's condition is such that it may be treated by
161195 24 a physical therapist.

177211 4 (9) "Physical therapist assistant" means a person licensed
178212 5 to assist a physical therapist and who has met all

181215 8 implementing the physical therapy treatment program as
182216 9 established by the licensed physical therapist. The patient
183217 10 care activities provided by the physical therapist assistant
184218 11 shall not include the interpretation of referrals, evaluation
185219 12 procedures, or the planning or major modification of patient
186220 13 programs.
187221 14 (10) "Physical therapy aide" means a person who has
188222 15 received on the job training, specific to the facility in
189223 16 which he is employed.
190224 17 (11) (Blank). "Advanced practice registered nurse" means a
191225 18 person licensed as an advanced practice registered nurse under
192226 19 the Nurse Practice Act.
193227 20 (12) (Blank). "Physician assistant" means a person
194228 21 licensed under the Physician Assistant Practice Act of 1987.
195229 22 (13) "Health care professional" means a physician,
196230 23 dentist, podiatric physician, advanced practice registered
197231 24 nurse, or physician assistant.
198232 25 (14) "Address of record" means a designated address

244278 1 (a) A physical therapist may provide physical therapy
245279 2 services to a patient with or without a referral from a health
246280 3 care professional.
247281 4 (b) A physical therapist providing services without a
248282 5 referral from a health care professional must notify the
249283 6 patient's treating health care professional within 5 business
250284 7 days after the patient's first visit that the patient is
251285 8 receiving physical therapy. This does not apply to physical
252286 9 therapy services related to fitness or wellness, unless the
253287 10 patient presents with an ailment or injury.
254288 11 (b-5) A physical therapist providing services to a
255289 12 patient without a referral who has been diagnosed by a health
256290 13 care professional as having a chronic disease that may benefit
257291 14 from physical therapy must communicate at least monthly with
258292 15 the patient's treating health care professional to provide
259293 16 updates on the patient's course of therapy.
260294 17 (b-10) A physical therapist providing services to a
261295 18 patient with a referral who has been diagnosed by a health care
262296 19 professional as having a chronic disease must communicate at
263297 20 least monthly with the patient's referring health care
264298 21 professional consistent with the plan of care established with
265299 22 the referring health care professional.
266300 23 (c) A physical therapist shall refer a patient to the
267301 24 patient's treating health care professional of record or, in
268302 25 the case where there is no health care professional of record,

280314 1 (1) the patient does not demonstrate measurable or
281315 2 functional improvement after 10 visits or 15 business
282316 3 days, whichever occurs first, and continued improvement

285319 6 therapist without a diagnosis established by a health care
286320 7 professional of a chronic disease that may benefit from
287321 8 physical therapy and returns for services for the same or
288322 9 similar condition after 30 calendar days of being

290324 11 (3) the patient's condition, at the time of evaluation
291325 12 or services, is determined to be beyond the scope of
292326 13 practice of the physical therapist.
293327 14 (d) Wound debridement services may only be provided by a
294328 15 physical therapist with written authorization from a health
295329 16 care professional.
296330 17 (e) A physical therapist shall promptly consult and
297331 18 collaborate with the appropriate health care professional
298332 19 anytime a patient's condition indicates that it may be related
299333 20 to temporomandibular disorder so that a diagnosis can be made
300334 21 by that health care professional for an appropriate treatment
301335 22 plan.

315349 1 Sec. 1.5. Dry needling.
316350 2 (a) For the purpose of this Act, "dry needling", also
317351 3 known as intramuscular manual therapy, means an advanced
318352 4 needling skill or technique limited to the treatment of
319353 5 myofascial pain, using a single use, single insertion, sterile
320354 6 filiform needle (without the use of heat, cold, or any other
321355 7 added modality or medication), that is inserted into the skin
322356 8 or underlying tissues to stimulate trigger points. Dry
323357 9 needling may apply theory based only upon Western medical
324358 10 concepts, requires an examination and diagnosis, and treats
325359 11 specific anatomic entities selected according to physical
326360 12 signs. Dry needling does not include the teaching or
327361 13 application of acupuncture described by the stimulation of
328362 14 auricular points, utilization of distal points or non-local
329363 15 points, needle retention, application of retained electric
330364 16 stimulation leads, or other acupuncture theory.
331365 17 (b) A physical therapist or physical therapist assistant
332366 18 licensed under this Act may only perform dry needling after
333367 19 completion of requirements, as determined by the Department by
334368 20 rule, that meet or exceed the following: (1) 50 hours of
335369 21 instructional courses that include, but are not limited to,
336370 22 studies in the musculoskeletal and neuromuscular system, the
337371 23 anatomical basis of pain mechanisms, chronic and referred

620654 22 recommendation of the Board, the Director shall promptly

829863 20 Act within 3 years after filing an his application, the
830864 21 application shall be denied. However, such applicant may make
831865 22 a new application for examination accompanied by the required
832866 23 fee, and must furnish proof of meeting qualifications for

951985 1 The fees shall be nonrefundable.
952986 2 Any person who delivers a check or other payment to the
953987 3 Department that is returned to the Department unpaid by the
954988 4 financial institution upon which it is drawn shall pay to the
955989 5 Department, in addition to the amount already owed, a fine of
956990 6 $50. The fines imposed by this Section are in addition to any
957991 7 other discipline provided under this Act for unlicensed
958992 8 practice or practice on an nonrenewed license. The Department
959993 9 shall notify the person that fees and fines shall be paid to
960994 10 the Department by certified check or money order within 30
961995 11 calendar days after the notification. If, after the expiration
962996 12 of 30 days from the date of the notification, the person has
963997 13 failed to submit the necessary remittance, the Department
964998 14 shall automatically terminate the license or certificate or
965999 15 deny the application without a hearing. If, after termination
9661000 16 or denial, the person seeks a license or certificate, the
9671001 17 person shall apply to the Department for the restoration or
9681002 18 issuance of the license or certificate and pay the required
9691003 19 fees and fines to the Department. The Department may establish
9701004 20 a fee for the processing of an application for the restoration
9711005 21 of a license or certificate to recover all expenses of
9721006 22 processing the application. The Secretary may waive the fines
9731007 23 due under this Section in individual cases where the Secretary
9741008 24 finds that the fines would be unreasonable or unnecessarily
