3	11		1 AN ACT concerning regulation.
4	12		2 Be it enacted by the People of the State of Illinois,
5	13		3 represented in the General Assembly:
6	14		4 Section 5. The Regulatory Sunset Act is amended by
7	15		5 changing Section 4.36 and by adding Section 4.41 as follows:
8	16		6 (5 ILCS 80/4.36)
9	17		7 Sec. 4.36. Acts repealed on January 1, 2026. The following
10	18		8 Acts are repealed on January 1, 2026:

44	78		12 Sec. 0.05. Legislative Intent. This Act is enacted for the
45	79		13 purpose of protecting the public health, safety, and welfare,
46	80		14 and for providing for State administrative control,
47	81		15 supervision, licensure, and regulation of the practice of
48	82		16 physical therapy. It is the legislature's intent that only
49	83		17 individuals who meet and maintain prescribed standards of
50	84		18 competence and conduct may engage in the practice of physical
51	85		19 therapy as authorized by this Act. This Act shall be liberally
52	86		20 construed to promote the public interest and to accomplish the
53	87		21 purpose stated herein. This Act does not prohibit a person
54	88		22 licensed under any other Act in this State from engaging in the
55	89		23 practice for which that person he or she is licensed or from
56	90		24 delegating services as provided for under that other Act.

70	104		4 Sec. 1. Definitions. As used in this Act:
71	105		5 (1) "Physical therapy" means all of the following:
72	106		6 (A) Examining, evaluating, and testing individuals who
73	107		7 may have mechanical, physiological, or developmental
74	108		8 impairments, functional limitations, disabilities, or
75	109		9 other health and movement-related conditions, classifying
76	110		10 these disorders, determining a rehabilitation prognosis
77	111		11 and plan of therapeutic intervention, and assessing the
78	112		12 ongoing effects of the interventions.
79	113		13 (B) Alleviating impairments, functional limitations,
80	114		14 or disabilities by designing, implementing, and modifying
81	115		15 therapeutic interventions that may include, but are not
82	116		16 limited to, the evaluation or treatment of a patient
83	117		17 person through the use of the effective properties of
84	118		18 physical measures and heat, cold, light, water, radiant
85	119		19 energy, electricity, sound, and air and use of therapeutic
86	120		20 massage, therapeutic exercise, mobilization, dry needling,
87	121		21 and rehabilitative procedures, with or without assistive
88	122		22 devices and equipment, for the purposes of preventing,
89	123		23 correcting, or alleviating a physical or mental
90	124		24 impairment, functional limitation, or disability.

107	141		6 "Physical therapy" includes, but is not limited to: (a)
108	142		7 performance of specialized tests and measurements, (b)
109	143		8 administration of specialized treatment procedures, (c)
110	144		9 interpretation of referrals from physicians, dentists,
111	145		10 advanced practice registered nurses, physician assistants, and
112	146		11 podiatric physicians, (d) establishment, and modification of
113	147		12 physical therapy treatment programs, (e) administration of
114	148		13 topical medication used in generally accepted physical therapy
115	149		14 procedures when such medication is either prescribed by the
116	150		15 patient's physician, licensed to practice medicine in all its
117	151		16 branches, the patient's physician licensed to practice
118	152		17 podiatric medicine, the patient's advanced practice registered
119	153		18 nurse, the patient's physician assistant, or the patient's
120	154		19 dentist or used following the physician's orders or written
121	155		20 instructions, (f) supervision or teaching of physical therapy,
122	156		21 and (g) dry needling in accordance with Section 1.5. "Physical
123	157		22 therapy" does not include practicing radiology,
124	158		23 electrosurgery, acupuncture, chiropractic technique or
125	159		24 providing a determination of a differential diagnosis;
126	160		25 provided, however, the limitation on determining a

139	173		2 evaluation and establishing a physical therapy treatment plan
140	174		3 pursuant to such license. Nothing in this Section shall limit
141	175		4 a physical therapist from employing appropriate physical
142	176		5 therapy techniques that the physical therapist he or she is
143	177		6 educated and licensed to perform.
144	178		7 (2) "Physical therapist" means a person who practices
145	179		8 physical therapy and who has met all requirements as provided
146	180		9 in this Act.
147	181		10 (3) "Department" means the Department of Financial and
148	182		11 Professional Regulation.
149	183		12 (4) "Director" means the Director of the Division of
150	184		13 Professional Regulation of the Department of Financial and
151	185		14 Professional Regulation with the duties as designated by the
152	186		15 Secretary.
153	187		16 (5) "Board" means the Physical Therapy Licensing and
154	188		17 Disciplinary Board approved by the Secretary Director.
155	189		18 (6) "Referral" means a written or oral authorization for
156	190		19 physical therapy services for a patient by a physician,
157	191		20 dentist, advanced practice registered nurse, physician
158	192		21 assistant, or podiatric physician who maintains medical
159	193		22 supervision of the patient and makes a diagnosis or verifies
160	194		23 that the patient's condition is such that it may be treated by
161	195		24 a physical therapist.

177	211		4 (9) "Physical therapist assistant" means a person licensed
178	212		5 to assist a physical therapist and who has met all
179	213		6 requirements as provided in this Act and who works under the
180	214		7 supervision of a licensed physical therapist to assist in
181	215		8 implementing the physical therapy treatment program as
182	216		9 established by the licensed physical therapist. The patient
183	217		10 care activities provided by the physical therapist assistant
184	218		11 shall not include the interpretation of referrals, evaluation
185	219		12 procedures, or the planning or major modification of patient
186	220		13 programs.
187	221		14 (10) "Physical therapy aide" means a person who has
188	222		15 received on the job training, specific to the facility in
189	223		16 which he is employed.
190	224		17 (11) (Blank). "Advanced practice registered nurse" means a
191	225		18 person licensed as an advanced practice registered nurse under
192	226		19 the Nurse Practice Act.
193	227		20 (12) (Blank). "Physician assistant" means a person
194	228		21 licensed under the Physician Assistant Practice Act of 1987.
195	229		22 (13) "Health care professional" means a physician,
196	230		23 dentist, podiatric physician, advanced practice registered
197	231		24 nurse, or physician assistant.
198	232		25 (14) "Address of record" means a designated address

244	278		1 (a) A physical therapist may provide physical therapy
245	279		2 services to a patient with or without a referral from a health
246	280		3 care professional.
247	281		4 (b) A physical therapist providing services without a
248	282		5 referral from a health care professional must notify the
249	283		6 patient's treating health care professional within 5 business
250	284		7 days after the patient's first visit that the patient is
251	285		8 receiving physical therapy. This does not apply to physical
252	286		9 therapy services related to fitness or wellness, unless the
253	287		10 patient presents with an ailment or injury.
254	288		11 (b-5) A physical therapist providing services to a
255	289		12 patient without a referral who has been diagnosed by a health
256	290		13 care professional as having a chronic disease that may benefit
257	291		14 from physical therapy must communicate at least monthly with
258	292		15 the patient's treating health care professional to provide
259	293		16 updates on the patient's course of therapy.
260	294		17 (b-10) A physical therapist providing services to a
261	295		18 patient with a referral who has been diagnosed by a health care
262	296		19 professional as having a chronic disease must communicate at
263	297		20 least monthly with the patient's referring health care
264	298		21 professional consistent with the plan of care established with
265	299		22 the referring health care professional.
266	300		23 (c) A physical therapist shall refer a patient to the
267	301		24 patient's treating health care professional of record or, in
268	302		25 the case where there is no health care professional of record,

291	325		12 or services, is determined to be beyond the scope of
292	326		13 practice of the physical therapist.
293	327		14 (d) Wound debridement services may only be provided by a
294	328		15 physical therapist with written authorization from a health
295	329		16 care professional.
296	330		17 (e) A physical therapist shall promptly consult and
297	331		18 collaborate with the appropriate health care professional
298	332		19 anytime a patient's condition indicates that it may be related
299	333		20 to temporomandibular disorder so that a diagnosis can be made
300	334		21 by that health care professional for an appropriate treatment
301	335		22 plan.

316	350		2 (a) For the purpose of this Act, "dry needling", also
317	351		3 known as intramuscular manual therapy, means an advanced

320	354		6 filiform needle (without the use of heat, cold, or any other

653	687		20 physical therapy program outside the United States or its
654	688		21 territories shall have the person's his or her degree
655	689		22 validated as equivalent to a physical therapy degree
656	690		23 conferred by a regionally accredited college or university
657	691		24 in the United States. The Department may establish by rule

952	986		2 Any person who delivers a check or other payment to the
953	987		3 Department that is returned to the Department unpaid by the
954	988		4 financial institution upon which it is drawn shall pay to the
955	989		5 Department, in addition to the amount already owed, a fine of
956	990		6 $50. The fines imposed by this Section are in addition to any
957	991		7 other discipline provided under this Act for unlicensed
958	992		8 practice or practice on an nonrenewed license. The Department
959	993		9 shall notify the person that fees and fines shall be paid to
960	994		10 the Department by certified check or money order within 30
961	995		11 calendar days after the notification. If, after the expiration
962	996		12 of 30 days from the date of the notification, the person has
963	997		13 failed to submit the necessary remittance, the Department
964	998		14 shall automatically terminate the license or certificate or
965	999		15 deny the application without a hearing. If, after termination
966	1000		16 or denial, the person seeks a license or certificate, the
967	1001		17 person shall apply to the Department for the restoration or
968	1002		18 issuance of the license or certificate and pay the required
969	1003		19 fees and fines to the Department. The Department may establish
970	1004		20 a fee for the processing of an application for the restoration
971	1005		21 of a license or certificate to recover all expenses of
972	1006		22 processing the application. The Secretary may waive the fines
973	1007		23 due under this Section in individual cases where the Secretary
974	1008		24 finds that the fines would be unreasonable or unnecessarily

1218	1252		18 being licensed under the provisions of this Act, then any
1219	1253		19 licensed physical therapist or physical therapist assistant,
1220	1254		20 any interested party, or any person injured thereby may, in
1221	1255		21 addition to the Secretary Director, petition for relief as
