1616 1 AN ACT concerning transportation.
1717 2 Be it enacted by the People of the State of Illinois,
1818 3 represented in the General Assembly:
1919 4 Section 5. The Illinois Vehicle Code is amended by
2020 5 changing Sections 6-104, 6-106, 6-110, and 6-110.2 and by
2121 6 adding Sections 1-104.7 and 1-131.7 as follows:

2323 8 Sec. 1-104.7. Autism spectrum disorder. Any pervasive
2424 9 developmental disorder or autism spectrum disorder, as defined
2525 10 in the most recent edition or the most recent edition at the

2727 12 Mental Disorders of the American Psychiatric Association.

3131 16 concurrently by (i) significant subaverage intellectual

3434 19 conformity with accepted professional practice, that is at
3535 20 least 2 standard deviations below the mean and (ii)
3636 21 significant limitations in adaptive behavior as expressed in

8686 5 (a) A driver's license issued under the authority of this
8787 6 Act shall indicate the classification for which the applicant
8888 7 therefor has qualified by examination or by such other means
8989 8 that the Secretary of State shall prescribe. Driver's license
9090 9 classifications shall be prescribed by rule or regulation
9191 10 promulgated by the Secretary of State and such may specify
9292 11 classifications as to operation of motor vehicles of the first
9393 12 division, or of those of the second division, whether operated
9494 13 singly or in lawful combination, and whether for-hire or
9595 14 not-for-hire, and may specify such other classifications as
9696 15 the Secretary deems necessary.
9797 16 No person shall operate a motor vehicle unless such person
9898 17 has a valid license with a proper classification to permit the
9999 18 operation of such vehicle, except that any person may operate
100100 19 a moped if such person has a valid current Illinois driver's
101101 20 license, regardless of classification.
102102 21 (a-5) If a person submits an application for a driver's
103103 22 license with documents under subsection (b-2) of Section
104104 23 6-106, the Secretary of State shall indicate that the person

117117 1 (b) No person who is under the age of 21 years or has had
118118 2 less than 1 year of driving experience shall drive: (1) in
119119 3 connection with the operation of any school, day camp, summer
120120 4 camp, or nursery school, any public or private motor vehicle
121121 5 for transporting children to or from any school, day camp,
122122 6 summer camp, or nursery school, or (2) any motor vehicle of the
123123 7 second division when in use for the transportation of persons
124124 8 for compensation.
125125 9 (c) No person who is under the age of 18 years shall be
126126 10 issued a license for the purpose of transporting property for
127127 11 hire, or for the purpose of transporting persons for
128128 12 compensation in a motor vehicle of the first division.
129129 13 (d) No person shall drive: (1) a school bus when
130130 14 transporting school children unless such person possesses a
131131 15 valid school bus driver permit or is accompanied and
132132 16 supervised, for the specific purpose of training prior to
133133 17 routine operation of a school bus, by a person who has held a
134134 18 valid school bus driver permit for at least one year; or (2)
135135 19 any other vehicle owned or operated by or for a public or
136136 20 private school, or a school operated by a religious
137137 21 institution, where such vehicle is being used over a regularly
138138 22 scheduled route for the transportation of persons enrolled as
139139 23 a student in grade 12 or below, in connection with any activity
140140 24 of the entities unless such person possesses a valid school
141141 25 bus driver permit.

153153 1 special requirements for school buses provided in Sections
154154 2 12-801, 12-802, 12-803, and 12-805 of this Code that has been
155155 3 chartered for the sole purpose of transporting students
156156 4 regularly enrolled in grade 12 or below to or from
157157 5 interscholastic athletic or interscholastic or school
158158 6 sponsored activities unless the person has a valid and
159159 7 properly classified commercial driver's license as provided in
160160 8 subsection (c-1) of Section 6-508 of this Code in addition to
161161 9 any other permit or license that is required to operate that
162162 10 bus. This subsection (d-5) does not apply to any bus driver
163163 11 employed by a public transportation provider authorized to
164164 12 conduct local or interurban transportation of passengers when
165165 13 the bus is not traveling a specific school bus route but is on
166166 14 a regularly scheduled route for the transporting of other fare
167167 15 paying passengers.
168168 16 A person may operate a chartered bus described in this
169169 17 subsection (d-5) if he or she is not disqualified from driving
170170 18 a chartered bus of that type and if he or she holds a CDL that
171171 19 is:
172172 20 (1) issued to him or her by any other state or
173173 21 jurisdiction in accordance with 49 CFR 383;
174174 22 (2) not suspended, revoked, or canceled; and
175175 23 (3) valid under 49 CFR 383, subpart F, for the type of
176176 24 vehicle being driven.
177177 25 A person may also operate a chartered bus described in
178178 26 this subsection (d-5) if he or she holds a valid CDL and a

191191 3 (e) No person shall drive a religious organization bus
192192 4 unless such person has a valid and properly classified drivers
193193 5 license or a valid school bus driver permit.
194194 6 (f) No person shall drive a motor vehicle for the purpose
195195 7 of providing transportation for the elderly in connection with
196196 8 the activities of any public or private organization unless
197197 9 such person has a valid and properly classified driver's
198198 10 license issued by the Secretary of State.
199199 11 (g) No person shall drive a bus which meets the special
200200 12 requirements for school buses provided in Section 12-801,
201201 13 12-802, 12-803 and 12-805 of this Code for the purpose of
202202 14 transporting persons 18 years of age or less in connection
203203 15 with any youth camp licensed under the Youth Camp Act or any
204204 16 child care facility licensed under the Child Care Act of 1969
205205 17 unless such person possesses a valid school bus driver permit
206206 18 or is accompanied and supervised, for the specific purpose of
207207 19 training prior to routine operation of a school bus, by a
208208 20 person who has held a valid school bus driver permit for at
209209 21 least one year; however, a person who has a valid and properly
210210 22 classified driver's license issued by the Secretary of State
211211 23 may operate a school bus for the purpose of transporting
212212 24 persons 18 years of age or less in connection with any such
213213 25 youth camp or child care facility if the "SCHOOL BUS" signs are
214214 26 covered or concealed and the stop signal arm and flashing

230230 6 Sec. 6-106. Application for license or instruction permit.
231231 7 (a) Every application for any permit or license authorized
232232 8 to be issued under this Code shall be made upon a form
233233 9 furnished by the Secretary of State. Every application shall
234234 10 be accompanied by the proper fee and payment of such fee shall
235235 11 entitle the applicant to not more than 3 attempts to pass the
236236 12 examination within a period of one year after the date of
237237 13 application.
238238 14 (b) Every application shall state the legal name, zip
239239 15 code, date of birth, sex, and residence address of the
240240 16 applicant; briefly describe the applicant; state whether the
241241 17 applicant has theretofore been licensed as a driver, and, if
242242 18 so, when and by what state or country, and whether any such
243243 19 license has ever been cancelled, suspended, revoked or
244244 20 refused, and, if so, the date and reason for such
245245 21 cancellation, suspension, revocation or refusal; shall include
246246 22 an affirmation by the applicant that all information set forth
247247 23 is true and correct; and shall bear the applicant's signature.
248248 24 In addition to the residence address, the Secretary may allow
249249 25 the applicant to provide a mailing address. In the case of an

260260 1 applicant who is a judicial officer or peace officer, the
261261 2 Secretary may allow the applicant to provide an office or work
262262 3 address in lieu of a residence or mailing address. The
263263 4 application form may also require the statement of such
264264 5 additional relevant information as the Secretary of State
265265 6 shall deem necessary to determine the applicant's competency
266266 7 and eligibility. The Secretary of State may, in his
267267 8 discretion, by rule or regulation, provide that an application
268268 9 for a drivers license or permit may include a suitable
269269 10 photograph of the applicant in the form prescribed by the
270270 11 Secretary, and he may further provide that each drivers
271271 12 license shall include a photograph of the driver. The
272272 13 Secretary of State may utilize a photograph process or system
273273 14 most suitable to deter alteration or improper reproduction of
274274 15 a drivers license and to prevent substitution of another photo
275275 16 thereon. For the purposes of this subsection (b), "peace
276276 17 officer" means any person who by virtue of his or her office or
277277 18 public employment is vested by law with a duty to maintain
278278 19 public order or to make arrests for a violation of any penal
279279 20 statute of this State, whether that duty extends to all
280280 21 violations or is limited to specific violations.
281281 22 (b-1) Every application shall state the social security
282282 23 number of the applicant; except if the applicant is applying
283283 24 for a standard driver's license and, on the date of
284284 25 application, is ineligible for a social security number, then:

296296 1 United States Department of Homeland Security, authorizing
297297 2 the applicant's presence in this country, the applicant
298298 3 shall provide such documentation instead of a social
299299 4 security number; and
300300 5 (2) if the applicant does not have documentation
301301 6 described in paragraph (1), the applicant shall provide,
302302 7 instead of a social security number, the following:
303303 8 (A) documentation establishing that the applicant
304304 9 has resided in this State for a period in excess of one
305305 10 year;
306306 11 (B) a passport validly issued to the applicant
307307 12 from the applicant's country of citizenship or a
308308 13 consular identification document validly issued to the
309309 14 applicant by a consulate of that country as defined in
310310 15 Section 5 of the Consular Identification Document Act,
311311 16 as long as such documents are either unexpired or
312312 17 presented by an applicant within 2 years of its
313313 18 expiration date; and
314314 19 (C) a social security card, if the applicant has a
315315 20 social security number.
316316 21 (b-2) Every application form shall offer an applicant the
317317 22 option to include on the applicant's license whether the
318318 23 applicant has an intellectual disability or autism spectrum
319319 24 disorder. An applicant who wishes to include such information
320320 25 on the applicant's license shall include, with the
321321 26 application, a signed statement by a licensed health care

332332 1 provider confirming that the applicant has an intellectual
333333 2 disability or autism spectrum disorder.
334334 3 (b-3) Upon the first issuance of a request for proposals
335335 4 for a digital driver's license and identification card
336336 5 issuance and facial recognition system issued after January 1,
337337 6 2020 (the effective date of Public Act 101-513), and upon
338338 7 implementation of a new or revised system procured pursuant to
339339 8 that request for proposals, the Secretary shall permit
340340 9 applicants to choose between "male", "female" or "non-binary"
341341 10 when designating the applicant's sex on the driver's license
342342 11 application form. The sex designated by the applicant shall be
343343 12 displayed on the driver's license issued to the applicant.
344344 13 (b-5) Every applicant for a REAL ID compliant driver's
345345 14 license or permit shall provide proof of lawful status in the
346346 15 United States as defined in 6 CFR 37.3, as amended.
347347 16 (c) The application form shall include a notice to the
348348 17 applicant of the registration obligations of sex offenders
349349 18 under the Sex Offender Registration Act. The notice shall be
350350 19 provided in a form and manner prescribed by the Secretary of
351351 20 State. For purposes of this subsection (c), "sex offender" has
352352 21 the meaning ascribed to it in Section 2 of the Sex Offender
353353 22 Registration Act.
354354 23 (d) Any male United States citizen or immigrant who
355355 24 applies for any permit or license authorized to be issued
356356 25 under this Code or for a renewal of any permit or license, and
357357 26 who is at least 18 years of age but less than 26 years of age,

368368 1 must be registered in compliance with the requirements of the
369369 2 federal Military Selective Service Act. The Secretary of State
370370 3 must forward in an electronic format the necessary personal
371371 4 information regarding the applicants identified in this
372372 5 subsection (d) to the Selective Service System. The
373373 6 applicant's signature on the application serves as an
374374 7 indication that the applicant either has already registered
375375 8 with the Selective Service System or that he is authorizing
376376 9 the Secretary to forward to the Selective Service System the
377377 10 necessary information for registration. The Secretary must
378378 11 notify the applicant at the time of application that his
379379 12 signature constitutes consent to registration with the
380380 13 Selective Service System, if he is not already registered.
381381 14 (e) Beginning on or before July 1, 2015, for each original
382382 15 or renewal driver's license application under this Code, the
383383 16 Secretary shall inquire as to whether the applicant is a
384384 17 veteran for purposes of issuing a driver's license with a
385385 18 veteran designation under subsection (e-5) of Section 6-110 of
386386 19 this Code. The acceptable forms of proof shall include, but
387387 20 are not limited to, Department of Defense form DD-214,
388388 21 Department of Defense form DD-256 for applicants who did not
389389 22 receive a form DD-214 upon the completion of initial basic
390390 23 training, Department of Defense form DD-2 (Retired), an
391391 24 identification card issued under the federal Veterans
392392 25 Identification Card Act of 2015, or a United States Department
393393 26 of Veterans Affairs summary of benefits letter. If the

404404 1 document cannot be stamped, the Illinois Department of
405405 2 Veterans' Affairs shall provide a certificate to the veteran
406406 3 to provide to the Secretary of State. The Illinois Department
407407 4 of Veterans' Affairs shall advise the Secretary as to what
408408 5 other forms of proof of a person's status as a veteran are
409409 6 acceptable.
410410 7 For each applicant who is issued a driver's license with a
411411 8 veteran designation, the Secretary shall provide the
412412 9 Department of Veterans' Affairs with the applicant's name,
413413 10 address, date of birth, gender and such other demographic
414414 11 information as agreed to by the Secretary and the Department.
415415 12 The Department may take steps necessary to confirm the
416416 13 applicant is a veteran. If after due diligence, including
417417 14 writing to the applicant at the address provided by the
418418 15 Secretary, the Department is unable to verify the applicant's
419419 16 veteran status, the Department shall inform the Secretary, who
420420 17 shall notify the applicant that he or she must confirm status
421421 18 as a veteran, or the driver's license will be cancelled.
422422 19 For purposes of this subsection (e):
423423 20 "Armed forces" means any of the Armed Forces of the United
424424 21 States, including a member of any reserve component or
425425 22 National Guard unit.
426426 23 "Veteran" means a person who has served in the armed
427427 24 forces and was discharged or separated under honorable
428428 25 conditions.

450450 11 Sec. 6-110. Licenses issued to drivers.
451451 12 (a) The Secretary of State shall issue to every qualifying
452452 13 applicant a driver's license as applied for, which license
453453 14 shall bear a distinguishing number assigned to the licensee,
454454 15 the legal name, signature, zip code, date of birth, residence
455455 16 address, and a brief description of the licensee.
456456 17 Licenses issued shall also indicate the classification,
457457 18 intellectual disability or autism spectrum disorder, or and
458458 19 the restrictions under Section 6-104 of this Code. The
459459 20 Secretary may adopt rules to establish informational
460460 21 restrictions that can be placed on the driver's license
461461 22 regarding specific conditions of the licensee.
462462 23 A driver's license issued may, in the discretion of the
463463 24 Secretary, include a suitable photograph of a type prescribed
464464 25 by the Secretary.

475475 1 (a-1) If the licensee is less than 18 years of age, unless
476476 2 one of the exceptions in subsection (a-2) apply, the license
477477 3 shall, as a matter of law, be invalid for the operation of any
478478 4 motor vehicle during the following times:
479479 5 (A) Between 11:00 p.m. Friday and 6:00 a.m. Saturday;
480480 6 (B) Between 11:00 p.m. Saturday and 6:00 a.m. on
481481 7 Sunday; and
482482 8 (C) Between 10:00 p.m. on Sunday to Thursday,
483483 9 inclusive, and 6:00 a.m. on the following day.
484484 10 (a-2) The driver's license of a person under the age of 18
485485 11 shall not be invalid as described in subsection (a-1) of this
486486 12 Section if the licensee under the age of 18 was:
487487 13 (1) accompanied by the licensee's parent or guardian
488488 14 or other person in custody or control of the minor;
489489 15 (2) on an errand at the direction of the minor's
490490 16 parent or guardian, without any detour or stop;
491491 17 (3) in a motor vehicle involved in interstate travel;
492492 18 (4) going to or returning home from an employment
493493 19 activity, without any detour or stop;
494494 20 (5) involved in an emergency;
495495 21 (6) going to or returning home from, without any
496496 22 detour or stop, an official school, religious, or other
497497 23 recreational activity supervised by adults and sponsored
498498 24 by a government or governmental agency, a civic
499499 25 organization, or another similar entity that takes
500500 26 responsibility for the licensee, without any detour or

512512 2 (7) exercising First Amendment rights protected by the
513513 3 United States Constitution, such as the free exercise of
514514 4 religion, freedom of speech, and the right of assembly; or
515515 5 (8) married or had been married or is an emancipated
516516 6 minor under the Emancipation of Minors Act.
517517 7 (a-2.5) The driver's license of a person who is 17 years of
518518 8 age and has been licensed for at least 12 months is not invalid
519519 9 as described in subsection (a-1) of this Section while the
520520 10 licensee is participating as an assigned driver in a Safe
521521 11 Rides program that meets the following criteria:
522522 12 (1) the program is sponsored by the Boy Scouts of
523523 13 America or another national public service organization;
524524 14 and
525525 15 (2) the sponsoring organization carries liability
526526 16 insurance covering the program.
527527 17 (a-3) If a graduated driver's license holder over the age
528528 18 of 18 committed an offense against traffic regulations
529529 19 governing the movement of vehicles or any violation of Section
530530 20 6-107 or Section 12-603.1 of this Code in the 6 months prior to
531531 21 the graduated driver's license holder's 18th birthday, and was
532532 22 subsequently convicted of the offense, the provisions of
533533 23 subsection (a-1) shall continue to apply until such time as a
534534 24 period of 6 consecutive months has elapsed without an
535535 25 additional violation and subsequent conviction of an offense
536536 26 against traffic regulations governing the movement of vehicles

548548 2 (a-4) If an applicant for a driver's license or
549549 3 instruction permit has a current identification card issued by
550550 4 the Secretary of State, the Secretary may require the
551551 5 applicant to utilize the same residence address and name on
552552 6 the identification card, driver's license, and instruction
553553 7 permit records maintained by the Secretary. The Secretary may
554554 8 promulgate rules to implement this provision.
555555 9 (a-5) If an applicant for a driver's license is an
556556 10 employee of the Department of Children and Family Services
557557 11 with a job title of "Child Protection Specialist Trainee",
558558 12 "Child Protection Specialist", "Child Protection Advanced
559559 13 Specialist", "Child Welfare Specialist Trainee", "Child
560560 14 Welfare Specialist", or "Child Welfare Advanced Specialist" or
561561 15 a judicial officer or a peace officer, the applicant may elect
562562 16 to have his or her office or work address listed on the license
563563 17 instead of the applicant's residence or mailing address. The
564564 18 Secretary of State shall adopt rules to implement this
565565 19 subsection (a-5). For the purposes of this subsection (a-5),
566566 20 "peace officer" means any person who by virtue of his or her
567567 21 office or public employment is vested by law with a duty to
568568 22 maintain public order or to make arrests for a violation of any
569569 23 penal statute of this State, whether that duty extends to all
570570 24 violations or is limited to specific violations.
571571 25 (b) Until the Secretary of State establishes a First
572572 26 Person Consent organ and tissue donor registry under Section

583583 1 6-117 of this Code, the Secretary of State shall provide a
584584 2 format on the reverse of each driver's license issued which
585585 3 the licensee may use to execute a document of gift conforming
586586 4 to the provisions of the Illinois Anatomical Gift Act. The
587587 5 format shall allow the licensee to indicate the gift intended,
588588 6 whether specific organs, any organ, or the entire body, and
589589 7 shall accommodate the signatures of the donor and 2 witnesses.
590590 8 The Secretary shall also inform each applicant or licensee of
591591 9 this format, describe the procedure for its execution, and may
592592 10 offer the necessary witnesses; provided that in so doing, the
593593 11 Secretary shall advise the applicant or licensee that he or
594594 12 she is under no compulsion to execute a document of gift. A
595595 13 brochure explaining this method of executing an anatomical
596596 14 gift document shall be given to each applicant or licensee.
597597 15 The brochure shall advise the applicant or licensee that he or
598598 16 she is under no compulsion to execute a document of gift, and
599599 17 that he or she may wish to consult with family, friends, or
600600 18 clergy before doing so. The Secretary of State may undertake
601601 19 additional efforts, including education and awareness
602602 20 activities, to promote organ and tissue donation.
603603 21 (c) The Secretary of State shall designate on each
604604 22 driver's license issued a space where the licensee may place a
605605 23 sticker or decal of the uniform size as the Secretary may
606606 24 specify, which sticker or decal may indicate in appropriate
607607 25 language that the owner of the license carries an Emergency
608608 26 Medical Information Card.

619619 1 The sticker may be provided by any person, hospital,
620620 2 school, medical group, or association interested in assisting
621621 3 in implementing the Emergency Medical Information Card, but
622622 4 shall meet the specifications as the Secretary may by rule or
623623 5 regulation require.
624624 6 (d) The Secretary of State shall designate on each
625625 7 driver's license issued a space where the licensee may
626626 8 indicate his blood type and RH factor.
627627 9 (e) The Secretary of State shall provide that each
628628 10 original or renewal driver's license issued to a licensee
629629 11 under 21 years of age shall be of a distinct nature from those
630630 12 driver's licenses issued to individuals 21 years of age and
631631 13 older. The color designated for driver's licenses for
632632 14 licensees under 21 years of age shall be at the discretion of
633633 15 the Secretary of State.
634634 16 (e-1) The Secretary shall provide that each driver's
635635 17 license issued to a person under the age of 21 displays the
636636 18 date upon which the person becomes 18 years of age and the date
637637 19 upon which the person becomes 21 years of age.
638638 20 (e-3) The General Assembly recognizes the need to identify
639639 21 military veterans living in this State for the purpose of
640640 22 ensuring that they receive all of the services and benefits to
641641 23 which they are legally entitled, including health care
642642 24 healthcare, education assistance, and job placement. To assist
643643 25 the State in identifying these veterans and delivering these
644644 26 vital services and benefits, the Secretary of State is

656656 2 appearing on the face of the licenses. This authorization is
657657 3 predicated on the unique status of veterans. The Secretary may
658658 4 not issue any other driver's license which identifies an
659659 5 occupation, status, affiliation, hobby, or other unique
660660 6 characteristics of the license holder which is unrelated to
661661 7 the purpose of the driver's license.
662662 8 (e-5) Beginning on or before July 1, 2015, the Secretary
663663 9 of State shall designate a space on each original or renewal
664664 10 driver's license where, at the request of the applicant, the
665665 11 word "veteran" shall be placed. The veteran designation shall
666666 12 be available to a person identified as a veteran under
667667 13 subsection (e) of Section 6-106 of this Code who was
668668 14 discharged or separated under honorable conditions.
669669 15 (e-7) Upon providing the required documentation, at the
670670 16 request of the applicant, the driver's license may reflect
671671 17 Gold Star Family designation. The Secretary shall designate a
672672 18 space on each original or renewal driver's license for such
673673 19 designation. This designation shall be available to a person
674674 20 eligible for Gold Star license plates under subsection (f) of
675675 21 Section 6-106 of this Code.
676676 22 (f) The Secretary of State shall inform all Illinois
677677 23 licensed commercial motor vehicle operators of the
678678 24 requirements of the Uniform Commercial Driver License Act,
679679 25 Article V of this Chapter, and shall make provisions to insure
680680 26 that all drivers, seeking to obtain a commercial driver's

691691 1 license, be afforded an opportunity prior to April 1, 1992, to
692692 2 obtain the license. The Secretary is authorized to extend
693693 3 driver's license expiration dates, and assign specific times,
694694 4 dates and locations where these commercial driver's tests
695695 5 shall be conducted. Any applicant, regardless of the current
696696 6 expiration date of the applicant's driver's license, may be
697697 7 subject to any assignment by the Secretary. Failure to comply
698698 8 with the Secretary's assignment may result in the applicant's
699699 9 forfeiture of an opportunity to receive a commercial driver's
700700 10 license prior to April 1, 1992.
701701 11 (g) The Secretary of State shall designate on a driver's
702702 12 license issued, a space where the licensee may indicate that
703703 13 he or she has drafted a living will in accordance with the
704704 14 Illinois Living Will Act or a durable power of attorney for
705705 15 health care in accordance with the Illinois Power of Attorney
706706 16 Act.
707707 17 (g-1) The Secretary of State, in his or her discretion,
708708 18 may designate on each driver's license issued a space where
709709 19 the licensee may place a sticker or decal, issued by the
710710 20 Secretary of State, of uniform size as the Secretary may
711711 21 specify, that shall indicate in appropriate language that the
712712 22 owner of the license has renewed his or her driver's license.
713713 23 (h) A person who acts in good faith in accordance with the
714714 24 terms of this Section is not liable for damages in any civil
715715 25 action or subject to prosecution in any criminal proceeding
