exempt from licensing and special permit requirements and is
appointed by the horse racing commission; to take or supervise the
taking of biological samples from race horses.
Effective:  July 1, 2022.

HOUSE BILL No. 1021
A BILL FOR AN ACT to amend the Indiana Code concerning
gaming.
Be it enacted by the General Assembly of the State of Indiana:
1 SECTION 1. IC 4-31-2-24 IS AMENDED TO READ AS
2 FOLLOWS [EFFECTIVE JULY 1, 2022]: Sec. 24. "Veterinarian"
3 means a veterinary practitioner who: is:
4 (1) either:
5 (A) holds a license or a special permit issued by the Indiana
6 board of veterinary medical examiners licensed to practice
7 veterinary medicine in Indiana; or
8 (B) is:
9 (i) exempt from the licensing and special permit
10 requirements of IC 25-38.1-3 (as described in
11 IC 25-38.1-3-1(b)); and
12 (ii) appointed by the commission under
13 IC 4-31-12-6(a)(1) to take or supervise the taking of
14 biological samples; and
15 (2) is authorized by the holder of a permit to practice at a
16 racetrack.
17 SECTION 2. IC 4-31-12-6, AS AMENDED BY P.L.168-2019,

1 SECTION 10, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
2 JULY 1, 2022]: Sec. 6. (a) The commission:
3 (1) shall appoint, at its cost, a veterinarian licensed to practice in
4 Indiana to take or supervise the taking of biological samples
5 under section 5 of this chapter;
6 (2) shall approve a laboratory for the analysis of a biological
7 sample taken under section 5 of this chapter; and
8 (3) may require that a biological sample taken under section 5 of
9 this chapter be analyzed.
10 (b) The cost of analyzing the biological samples shall be borne by
11 the commission.
12 (c) The commission may appoint, at its cost, veterinarians or other
13 persons to supervise all activities in the state testing barn area and to
14 supervise the practice of veterinary medicine at all racetracks in
15 Indiana.
16 (d) The commission shall employ or contract for assistants to aid in
17 securing biological samples at each racetrack. These assistants shall
18 have free access, under the supervision of the commission's
19 veterinarian, to the state testing barn area. The permit holder shall, in
20 the manner prescribed by the rules of the commission, reimburse the
21 commission for the salaries and other expenses of the assistants who
22 serve at the permit holder's racetrack.
