3434 A BILL FOR AN ACT to amend the Indiana Code concerning
3535 motor vehicles.
3636 Be it enacted by the General Assembly of the State of Indiana:
3737 1 SECTION 1. IC 9-24-10-3.5 IS ADDED TO THE INDIANA CODE
3838 2 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
3939 3 1, 2022]: Sec. 3.5. The bureau shall include the following in any
4040 4 driver's manual published by the bureau:
4141 5 (1) A description of law enforcement procedures during a
4242 6 traffic stop.
4343 7 (2) Actions a motorist should take during a traffic stop,
4444 8 including appropriate interactions with law enforcement
4545 9 officers.
4646 10 SECTION 2. IC 9-27-6-5, AS AMENDED BY P.L.85-2013,
4747 11 SECTION 71, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
4848 12 JULY 1, 2022]: Sec. 5. (a) As used in this section, "advisory board"
4949 13 refers to the driver education advisory board established by subsection
5050 14 (b).
5151 15 (b) The driver education advisory board is established to advise the
5252 16 commissioner in the administration of the policies of the commission
5353 17 and the bureau regarding driver education.

5555 1 (c) The advisory board is composed of seven (7) individuals
5656 2 appointed by the commissioner as follows:
5757 3 (1) Three (3) members must be driver education professionals
5858 4 endorsed by the bureau under section 8 of this chapter. In the
5959 5 selection of individuals for membership under this subdivision,
6060 6 consideration must be given to driver education instruction
6161 7 performed in urban and rural areas.
6262 8 (2) One (1) member must be a traffic safety advocate.
6363 9 (3) One (1) member must be a representative of the bureau.
6464 10 (4) One (1) member must be a representative of higher education.
6565 11 (5) One (1) member must be a representative of the insurance
6666 12 industry.
6767 13 (d) A member of the advisory board serves a two (2) year term. A
6868 14 member may not be appointed to more than two (2) consecutive full
6969 15 terms. Each member serves until the member's successor is appointed
7070 16 and qualified.
7171 17 (e) A member of the advisory board may be removed for good
7272 18 cause.
7373 19 (f) A vacancy on the advisory board shall be filled by the
7474 20 appointment by the commissioner of an individual to fill the position
7575 21 to which the vacating member was appointed under subsection (c) for
7676 22 the vacating member's unexpired term.
7777 23 (g) The advisory board shall:
7878 24 (1) consult with and advise the commissioner in the
7979 25 administration of the policies of the commission and the bureau
8080 26 regarding driver education; and
8181 27 (2) suggest rules regarding the education and training of persons
8282 28 to operate or drive motor vehicles or to prepare a person for an
8383 29 examination or validation for a driver's license; and
8484 30 (3) consult with and advise the commissioner and the state
8585 31 police department regarding instruction on:
8686 32 (A) law enforcement procedures during traffic stops; and
8787 33 (B) actions a motorist should take during a traffic stop,
8888 34 including appropriate interactions with law enforcement
8989 35 officers.
9090 36 (h) A member of the advisory board is not subject to liability in a
9191 37 civil action for bodily injury or property damage arising from or
9292 38 thought to have arisen from an action taken in good faith as a member
9393 39 of the advisory board.
