1010 Synopsis: Constitutional right to farm. Provides that the Constitution
1111 of the State of Indiana guarantees the right of the people of Indiana to
1212 engage in diverse farming and ranching practices. Provides that the
1313 general assembly may not pass a law that unreasonably abridges the
1414 right of farmers and ranchers to employ or refuse to employ effective
1515 agricultural technology and livestock production and ranching
1616 practices. Provides that the new constitutional provision does not
1717 modify any: (1) provision of the common law; (2) statute relating to
1818 trespass or eminent domain; or (3) other property right, existing or
1919 previously enacted statute, or existing or previously adopted
2020 administrative rule.
2121 Effective: This proposed amendment must be agreed to by two
2222 consecutive general assemblies and ratified by a majority of the state's

3939 RESOLUTION
4040 A JOINT RESOLUTION proposing an amendment to Article 1 of
4141 the Constitution of the State of Indiana concerning agriculture and
4242 animals.
4343 Be it resolved by the General Assembly of the State of Indiana:
4444 1 SECTION 1. The following amendment to the Constitution of the
4545 2 State of Indiana is proposed and agreed to by this, the One Hundred
4646 3 Twenty-Second General Assembly of the State of Indiana, and is
4747 4 referred to the next General Assembly for reconsideration and
4848 5 agreement.
4949 6 SECTION 2. ARTICLE 1 OF THE CONSTITUTION OF THE
5050 7 STATE OF INDIANA IS AMENDED BY ADDING A NEW
5151 8 SECTION TO READ AS FOLLOWS: Section 40. (a) The people of
5252 9 Indiana desire to:
5353 10 (1) protect the rights of ownership of property and the
5454 11 adequate production of food, fuel, fiber, and shelter, while
5555 12 maintaining the common law; and

5757 1 (2) promote agriculture as a central activity to be conducted
5858 2 in Indiana, and to maintain agriculture as a vital economic
5959 3 activity serving as a foundation and stabilizing force of
6060 4 Indiana's economy.
6161 5 (b) The right of the people of Indiana to engage in diverse
6262 6 farming and ranching practices is guaranteed by this Constitution.
6363 7 (c) The General Assembly may not pass a law that unreasonably
6464 8 abridges the right of farmers and ranchers to employ or refuse to
6565 9 employ effective agricultural technology and livestock production
6666 10 and ranching practices.
6767 11 (d) This section does not modify any:
6868 12 (1) provision of the common law;
6969 13 (2) statute relating to trespass or eminent domain; or
7070 14 (3) other property right, existing or previously enacted
7171 15 statute, or existing or previously adopted administrative rule.
