10	10	Synopsis: Constitutional right to farm. Provides that the Constitution
11	11	of the State of Indiana guarantees the right of the people of Indiana to
12	12	engage in diverse farming and ranching practices. Provides that the
13	13	general assembly may not pass a law that unreasonably abridges the
14	14	right of farmers and ranchers to employ or refuse to employ effective
15	15	agricultural technology and livestock production and ranching
16	16	practices. Provides that the new constitutional provision does not
17	17	modify any: (1) provision of the common law; (2) statute relating to
18	18	trespass or eminent domain; or (3) other property right, existing or
19	19	previously enacted statute, or existing or previously adopted
20	20	administrative rule.

22	22	consecutive general assemblies and ratified by a majority of the state's
23	23	voters voting on the question to be effective.

40	40	A JOINT RESOLUTION proposing an amendment to Article 1 of
41	41	the Constitution of the State of Indiana concerning agriculture and
42	42	animals.
43	43	Be it resolved by the General Assembly of the State of Indiana:
44	44	1 SECTION 1. The following amendment to the Constitution of the
45	45	2 State of Indiana is proposed and agreed to by this, the One Hundred
46	46	3 Twenty-Second General Assembly of the State of Indiana, and is
47	47	4 referred to the next General Assembly for reconsideration and
48	48	5 agreement.
49	49	6 SECTION 2. ARTICLE 1 OF THE CONSTITUTION OF THE
50	50	7 STATE OF INDIANA IS AMENDED BY ADDING A NEW
51	51	8 SECTION TO READ AS FOLLOWS: Section 40. (a) The people of
52	52	9 Indiana desire to:
53	53	10 (1) protect the rights of ownership of property and the
54	54	11 adequate production of food, fuel, fiber, and shelter, while
55	55	12 maintaining the common law; and

57	57	1 (2) promote agriculture as a central activity to be conducted
58	58	2 in Indiana, and to maintain agriculture as a vital economic
59	59	3 activity serving as a foundation and stabilizing force of
60	60	4 Indiana's economy.
61	61	5 (b) The right of the people of Indiana to engage in diverse
62	62	6 farming and ranching practices is guaranteed by this Constitution.
63	63	7 (c) The General Assembly may not pass a law that unreasonably
64	64	8 abridges the right of farmers and ranchers to employ or refuse to
65	65	9 employ effective agricultural technology and livestock production
66	66	10 and ranching practices.
67	67	11 (d) This section does not modify any:
68	68	12 (1) provision of the common law;
69	69	13 (2) statute relating to trespass or eminent domain; or
70	70	14 (3) other property right, existing or previously enacted
71	71	15 statute, or existing or previously adopted administrative rule.
